Some in the party don't like taking the money, and some do. Each candidate's campaign decides for itself. The Party has nothing to do with it.
The money is taken from your tax payment on a check-box basis, so presumably, anyone who checked the box would rather risk it going to a candidate than to, say, the war(s).
But the main point we learn should be that if you let the government dish it out, expect it to be done "politicially." If he can afford to sue, that's probably not a bad use of funds.
Judge Gray, the VP candidate, is planning to argue the other suit to get into the debates, himself. I imagine he's pretty effective (he used to be with JAG). Maybe he will, this one, too. I imagine they have legal connections to do this at low cost.
