Actually, Worse than Evil; As well as Unconstitutional.

In Response to someone's FairTax "list" I presented answers below their misconceptions (numbered), their text found there:

1. No Tax is Fair.

Not the issue; The issue is whether or not it is ENUMERATED or CONSENSUAL or CONSTITUTIONAL. The Fairtax is none of these. See Below.

2. Fair Tax is Currently Sponsored by About 70 Congressmen and 8 Senators.

No Doubt! The FairTax will increase the taxing power and invasiveness of the Federal Government; It will increase availability of federal funds for all exclusive privileged intities, Corporate Contracts, Government Union Bureaucracies and Special Interest Grants manipulated by Lobbyists. They are either self serving, corrupt or ignorant of the limits set by the founders.

3. Fair Tax Would Eliminate the IRS, the Income Tax, and the Sixteenth Amendment.

And replace it with an invasive federal / state Business Regulatory Bureaucracy to regulate all BUSINESS and BUSINESS Transactions; Defined by THEM; which is ANYONE who involves himself with the transfer of money or goods; i.e. EVERYONE; i.e. a BUY, SELL and TRADE Tax.

4. H.R. 25 is a Tax Bill - Not A Budget.

And this makes you feel safe??? hahahaha! sorry.

5. Economic Research For Fair Tax was Privately Funded By Consumers Like You and Me.

Yeah right. All we had to do is research the Constitution to see through that sales line. As with those endorsing the FairTax, They are either self serving, corrupt or ignorant of the limits set by the founders.

6. Fair Tax Would Collect Money From the Underground Economy AND the 47% Who do Not Owe IRS Taxes.

The Income tax does that now through the "BURDEN" of taxation, which transfers the taxes onto products & services down to the lowest person on the poll who cannot write it off further. OWE has nothing to do with whether or not the consumer pays the BURDEN" of taxation, which is "EVERYONE" who buys "ANYTHING" in this country.

7. Congress Can Raise The Fair Tax Rate Any Time They Wish.

HO! THAT makes me feel safe!, First they enact an UNENUMERATED, FLAT PERCENTAGE 23% sales tax, then empower it with federal authority to RAISE IT at ANY TIME THEY WISH!!! Which will ALSO AUTOMATICALLY INCREASE with an INCREASE from income transferred to SALES from the increased private sector economy!!! YEOW! OUCH! THAT's GONNA HURT!!!

Just think of all those new Dependent Government Union Bureaucracies they can create with that increase and then watch them demand their pay and benefits when the economy drops!!! Wait a minute - That is whats happening now as well. Same Same but worse.

8. The Poor Would Not Have To Pay Taxes On Food and Necessities.

OOPS! BIG LIE! The "BURDEN" of Taxation will be passed down on the merchandise of food and necessities the same as it is passed down by the income tax; Do you really think that a business that buys products that have a 23% Sales Tax are not going to try to pass that tax onto the CONSUMER??? DREAMER!

9. The Fair Tax IS Constitutional – The Income Tax is NOT Constitutional.

BIGGEST LIE!!! The FairTax is EQUALLY as UNCONSTITUTIONAL as the income tax, as it is an UNENUMERATED tax, which is a ARROGATION of POWER, EXPRESSLY PROHIBITED; The States cannot arrogate a new power on the federal government any more than the federal government can upon itself, as that is MEANS to ARROGATE that power which is EXPRESSLY PROHIBITED.

Conclusion on the FairTax list:

The FairTax = Corruption, Lies and Deception.

EVERY LAST BIT OF IT.

These Quote from the Founders of the Virginia Ratifying Convention 6-16-1788 is part of what I posted Below, (The FairTax is Unconstitutional and Dangerous - Here is why) which has a few more quotes, links and information but it begs repeating:

George Nicholas and others in the same Virginia Convention 6-16-1788 http://www.pacificwestcom.com/americanpatriotpartynewsletter described the limitation to taxation under the welfare Clause and powers granted:

George Nicholas: "....that this "general welfare" was united, "NOT" to "the general power of legislation", but to the >particular power> of laying and collecting taxes, imposts, and excises, for the "PURPOSE" of paying the "DEBTS" and providing for the "COMMON DEFENCE", that is, that they could raise (ONLY!!!!) AS MUCH money (ONLY!!!) as would pay the DEBTS and provide for the "COMMON DEFENCE", in "CONSEQUENCE OF THIS POWER"."

The Federal Government can COLLECT TAXES UNDER THIS CLAUSE FOR "TWO THINGS ONLY", "DEFENSE" AND "DEBT" - NOTHING ELSE!

Can the states arrogate more powers to the federal government? NO.

Here is Edmond Pendleton (same convention):

"...With respect to the necessity of the "ten miles square" (Washington, DC - Federal Government) being superseded by the subsequent clause, which gives them power to make all laws which shall be necessary and proper for carrying into execution the foregoing powers, and all other powers "VESTED" by "THIS" Constitution in the government of the United States, or in "any department" or officer thereof, I understand that clause as NOT going a "single step beyond" the "DELEGATED powers". >>>What can it act upon? "Some" power given by this Constitution. If they should be about to pass a law in consequence of this clause, they must pursue some of the "DELEGATED powers", >>>>"BUT" can by "NO MEANS" depart from them, >>>>>(N)OR "ARROGATE" "ANY NEW" powers; for the PLAIN LANGUAGE of the clause is, to give them power to pass laws in order to give "effect" to the >>>"DELEGATED" powers"..."

Changing Enumerated Taxation to UNENUMERATED taxation is an ARROGATION OF POWER! Expressly Prohibited;

The States cannot "Ratify" or "Amend" ANY Power outside the limited DELEGATED Powers, as that would be a "MEANS"; EXPRESSLY PROHIBITED.
