It's a 10th amendment issue and law.

If the people of the USA desire federal control of heroin, cocaine, marijuana, smoking corn silk or tobacco, or chewing tree bark, then amend the Constitution. Otherwise, it's a State's right of determination. All other actions of federal enforcement are actions of despotic or oligarchic tyranny.
