That IS the problem

If you just assume that the USA Constitution is perfect, then Article I, Secton 8 + 10th Amendment will do.

But that is a tacticle approach in a political struggle from the weak position we are in. It has nothing to do with theoretical Libertarian thought.

1) individual liberty comes from private property.
2) to achieve individual liberty and economic prosperity, competition, hard work and ability to be rewarded or go bankrupt is all what needed (private property should not be regulated or taxed beyond some minimal level.)
3) individual liberty trumps groups' demands or those of a "society" not because of a Rothbardian axiom, god or nature (sorry, Ron Paul), but because it is derived from reason.
