No, I understand what you're saying. Honestly, I think its to our benefit to state it, otherwise you are perceived as not cooperative or otherwise just being stubborn. Once you state it, from what I understand, they have to stop questioning you. I'm pretty sure that's why they decided like they did. The case came before the court that the defendant never made it clear he was exercising his right to silence. Yes, I know, it should be obvious. But, if you never state you are exercising your right, then the cops can continue to question and badger you. Stating it ends all conversation.
