She can be charged with perjury
She swore an oath to abide by the Constitution. To violate a sworn oath is called perjury. Perjury is punishable by impeachment and removal of office. It is common sense if someone swears an oath to an office then has no intentions of abiding by that oath then they have no business being in office.
