Banks wouldn't let him free his slaves even if he wanted to. He did however free Sally Hemmings and thier sons together upon his death.

Also, at Jefferson's request, the Virginia legislature passed an act specifically allowing Madison and Eston Hemings (his sons with Sally), and three other relatives mentioned in his will, to remain in the state despite the 1806 removal law.
