In the beginning...

John Roberts (the Judicial Branch) can't change the law in order to find the law constitutional, that's unconstitutional. The law should have been found unconstitutional. If Congress (the Legislative Branch) votes on changing a penalty to a tax, it is within the Legislative Branch's power.

Keep in mind, George H.W. Bush put David Souter on the Supreme court. Seems the son put another ringer on the Supreme Court, John Roberts.
