Me three.

A little ritual mockery... The Bill of Rights was something of an afterthought. After those in power neatly crafted the document that spelled out their power in pretty terms, those who loved liberty had a little hissy fit and insisted the Bill of Rights be drafted. For Brennan to swear to "the Constitution" is fitting, it is the document that outlines the power structure that will hold him above his fellow humans. To leave out the Bill of Rights was the perfect symbolism. He has no fealty to that document at all.
