My comment was largely satirical, although

if we the victims actually had the time, energy, and/or resources to administer justice in this case, of course due process would be ideal and the "right" thing to do. However, in a time of war (declared and enacted upon us by these people, remember), for a group of people who have rigged and abused the system at the expense of our very lives, and whose continued existence represents a real and present threat (true terrorists), I think due process may be a bit extravagant. (But then again, I've never claimed to be a Libertarian with a capital 'L'.)

People who do evil deserve it right back in kind.

What would the Founders do?
