Yeah, but due to the fact that the witnesses are not available, and the unnatural nature of the situation...its not a matter of American Jurisprudence, its a matter of American Opinion. The matter wouldn't even be heard in American Judiciary. Not today, and not 230 years ago. It would be a violation of American Jurisprudence, namely the First Amendment.

Due to it being a matter of opinion, and not law, some may would hold that these men had a very real motive for lying about the event. And without the story of a small handful of men, it didn't even happen.
