That's not the significant reason

The significant reason is they only were suspects, and they didn't have an arrest warrant.

The shot the two suspects and shut down the entire city of Boston.

And they didn't even have any arrest warrants. They had "suspects".

That's a complete violation of due process not to go to a judge with your evidence to get an arrest warrant. And that is why some politicians want to shovel this away as "enemy combatants".
