Just a little more info on Heisenberg

Foreword: This post is not to attempt to discredit Andrew Napalotina, but for those who are more interested more in why Heisenberg was mentioned.

  • I love Judge Napalitano's talks, but just to clarify "Heisenberg's law of physics" he mentioned:

    This is actually not a "law"! what I believe he was referring to was the Heisenberg's Principle (after the man who is credited for coming up with it).

    What's more, he is probably confusing Heisenberg's principle (aka, the "uncertainty principle") with the "observer effect."

    Heisenberg's principle states (to put it simply) that there is a limit on our (current) accuracy of measuring complementary properties of a particle. That is, if we know the position of a particle, then we will not know the momentum.

    The observer effect refers to changes that happen when the act of observation itself happens. This is usually due to the instruments used. For example, measuring the pressure of a tire will cause some air to escape and give a (slightly) different measurement from before the air escaped.

    Seeing as he is not a physicist, it is easy to forgive him for not getting this correct, but as a speaker he should be understanding of what it is he is speaking about. As it is, I am unsure what point he is trying to make about observing people with camera's and microphones.

    To take the observer's effect and apply it to cameras in the street is confusing because we are not dealing with subatomic particles, we would be dealing with macro objects (e.g. people). It just doesn't matter enough. Psychologically, Judge Napalitano may have something more to speak of, but that is outside physic's scope and would be better off referring to something like the Hawthorne effect.

    Regardless, bringing physics into the picture is usually used as an appeal to false authority, that is simply just rhetoric and beneath Mr. Napalitano who has plenty authority in dealing with constitutional issues.

    TL;DR:

    WE KNOW WARRANTLESS SEARCHES AND BIG BROTHER STYLE GOVERNMENT IS WRONG - WE DON'T NEED FANCY PHYSICS TERMS TO CONVINCE US, GIVE IT TO US STRAIGHT!

    But kudos to the Judge Napalitano for speaking out against this. No hate on the man.
