Since they can claim the NDAA makes it "legal". An individual will have to sue for rights violations against the unlawfulness of the NDAA and it doesn't look like that's gonna happen, either. None of the Bill of Rights are subject to the feds limitations and exceptions, it's a matter of how long the american people continue to tolerate it.
