Yes, but it fits with reality. Congress has so ceded power to the executive (declaration of war, regulatory agencies essentially writing law, executive orders...) that our reality is far different from what the founders intended. Heck, it's far different than when I was a kid, when congress critters actually wielded power.

So now the latest cede is that congress is allowing the executive to restrict Congress from exercising it's oversite function. All in the name of "fighting terrorism", of course.

Congress' latest power puke just adds to the feeling that this is becoming a police state. When the people's representatives in the government fail to show up, the executive - the enforcement wing of the government - takes charge of both law making and enforcement. There's still SCOTUS, but my sense is that they're not much more than figureheads anymore either.
