no thats what i said and no jury should have found him guilty of second degree murder because who knows if he would have died had he not defended himself. but it would have been easily reasonable to charge him with assault with a deadly weapon. he had a gun, he used it against an unarmed person and who knows if he would have died if he didnt use the gun. What he did wasnt right, but it wasnt first degree murder wrong.
