One thing you're obviously missing here - if something is litigated poorly and loses, then everyone in the public, and in the media get to say "well they had their day in court and lost, must not be much of a case there." she has acheived causing people to think that.
Also, what do you mean "she made it to the supreme court." She isn;t on the supreme court. Do you mean she LOST a case at the federal appellate court and then sought certriorari by the Supreme Court? If so, which case? Was review granted? Anyone can ask for review after losing.
