States are not given the power to tax

by the Federal Constitution. The Constitution prohibits the states from doing certain federally mandated tasks. However the Constitution does not say the states lack the ability to tax and therefore the tenth amendment reserves that power to them if they wish to do so.The confusion may be in the fact that most state taxation is tied to Federal Gross Income so therefore the state cannot tax you if you have Zero Federal Gross income. All Income tax is constitutional and the law is written to make it so. I refer you to cdistasio's post to determine whether it is being misapplied to you.
