Distracted driving is the issue.

When faced with this argument, refer to studies that show people using cell phones/electronic devices are just as dangerous as those under the influence of alcohol or drugs. Reverse the debate and play devil's advocate. Should those caught texting or talking on cell phones face the same consequences as a DUI charge? Or should those that drive distracted or intoxicated be held responsible only if they are an eminent threat to or actually cause harm to others(reckless driving)?

This logic will shine light on the redundancy of preventative laws.
