A California judge today tentatively scheduled a trial for Jan. 26, 2010, for a case that challenges Barack Obama's eligibility to be president based on questions over his qualifications under the requirements of the U.S. Constitution.
If the case actually goes to arguments before U.S. District Judge David Carter, it will be the first time the merits of the dispute have been argued in open court, according to one of the attorneys working on the issue.
In a highly anticipated hearing today before Carter, several motions were heard, including a resolution to long-standing questions about whether attorney Orly Taitz properly served notice on the defendants, which she had.
In a second ruling, Carter ordered that attorney Gary Kreep of the United States Justice Foundation can be added to the case to represent plaintiffs Wiley Drake and Markham Robinson, who had been removed by an earlier court order. Drake, the vice presidential candidate for the American Independent Party, and Robinson, the party's chairman, also were restored to the case.

But the judge did not immediately rule on Taitz' motion to be granted discovery – that is the right to see the president's still-concealed records. Nor did Carter rule immediately on a motion to dismiss the case, submitted by the U.S. government, following discussion over Taitz' challenge to the work of a magistrate in the case.
The judge did comment that if there are legitimate constitutional questions regarding Obama's eligibility, they need to be addressed and resolved.
Carter ordered a hearing Oct. 5 on the motion to dismiss and ordered arguments submitted on the issue of discovery.
If the case survives that challenge, a pretrial hearing has been scheduled for Jan. 11 and the trial for two weeks later.
The case would be the first time, according to Kreep, that the actual merits of the dispute will have been heard in open court. A multitude of such disputes have been rejected out of hand by various state and federal courts. Even the U.S. Supreme Court repeatedly has rejected urgent appeals to hear the evidence.
The suit alleges Obama is actually a citizen of Indonesia and "possibly still citizen of Kenya, usurping the position of the president of the United States of America and the commander-in-chief."

is not legally able to be President, then why did Hillary not expose it? The Clinton's are very connected and if there was a problem with Obama's birth status, wouldn't the Clinton's have sniffed it out? This has always puzzled me. Coesey has been on this for a while....I wish he would drop everything he has and let's see where it goes. I think we have bigger fish to fry and other things to focus on. Besides, if Obama was forced to resign...wouldn't we get Biden...or Pelosi. The agenda would not change. My guess, is that WND will still be chasing this story as long as Obama is around...and nothing will come of it. I would rather focus on the FED...Now there IS a story there!

my question is why does it matter? I couldn't care any less who is president, as long as its a keynesian warmonger, why would anyone here care who holds the office?
Say Obama is ineligible, doesn't Biden take the job? What is to gain from such actions? is this how we will win over the masses - by exposing that their favorite candidate for president wasn't born in the US (something he himself cannot possibly know or control anyway) and then cite the constitution to remove him from office... yeah I'm sure that will fuel a new wave of constitution-lovers. and at the same time - nothing changes...

I do care that Obama is owned and run by the bankers and feels zero allegiance to the constitution. Yes I know there are many natural born bad congress critters too, but some of them are bad because they know nothing about economics and finance. Being born in the country increases the chances of having an allegiance to it.

IMO. Small infingements on the Constitution...small, like allowing a usurper to hold the highest office in the land...and saying what difference does it make. Look at the socialistic, liberty-infringing legislation he has taken on already...and look at what could happen if he was unveiled for being a dual citizen or worse. His signature is null and void, giving us time to re-create a more liberty/Constitutional and more limited government with a possible group of Americans who would be very disillusioned by that time. It does make a difference. You could say, that Obama being in his position as an ineligible president and as a potential foreigner is like a quiet takeover. I have to disagree.

I mean just look at how definitions like "regulate" have been reversed over time to give gov't authority to perpetrate the very things it was supposed to protect the people from... what about the gold clause... what about the 10th am? and now we go out of our way to protect the nat'l born citizens clause? whats going on here? and for the preposterous claim that it will attract Obama supporters to our side... i just don't see it... Nope. VP is not a ranked promotion.
If Obama goes down, Biden becomes President per Section 1 of the 25th Amendment. Then Biden can nominate whomever he wants to be Vice-President, provided that both Houses of Congress confirm by majority vote.
However, it's incorrectly believed that there's a loophole here in that Biden could nominate Obama to become Vice-President, resulting in a switcheroo and nothing changes. The caveat there is that Obama could not become President again if Biden resigned (per the natural-born status in Article II) and then the succession would go to Pelosi. The statutory rule is that when the next in line to be President is ineligible, they are skipped (as was Albrecht in the Clinton years). However, per the last sentence of the 12th Amendment, Obama would be ineligible for the Vice-Presidency as well, which is the error in that belief. So if he's out, he's out completely.
The other misconception is that Biden would not be eligible if Obama is tossed, and that is also incorrect since Biden is definitely eligible. The only way we get President Pelosi is if both Obama and Biden are removed from office while she's Speaker.

If Obama goes down and is ruled not constitutionally qualified to hold office, then there will have to be a By-election or Special Election because the voters were voting for a fraud. Obama already knows if he is qualified or not to hold office. After all he is a constitutional lawyer. If that is not being duped then I don’t know what duped is. Biden may take office for a short time until the By-election process is over. So who would I vote for in a By-election – why Ron Paul of course.

If the economy keeps doing badly, many former supoorters will be glad to see him go, but our goal should not be to appease the fanatical. He is poison for the country, probably worse than Biden in his penchant for lying, but Biden would go too if the constitution is followed.

I guess what it boils down to is I tend to have a value scale when it comes to restoring the constitution. I see what you all are saying about how we've already seen so many infringements that any new one should be fought while its still being committed. I concede that point and I thank you all. My problem is I see such positive vibes coming from things like hr 1207, rand/ schiff donations, healthcare debates, that I see the birth certificate thing as sort of a distraction. I understand the purpose of the nb citizen clause and do not oppose it, it just instinctively seems trivial in comparison... perhaps my desire to see more Obama fanatics join ranks in the liberty movement is so great that I'm willing to make minor concessions. But I suppose its never good to compromise certain clauses, no matter how trivial it may seem at the time. I guess if we give an inch, they'll take a mile, and history shows just that...
I guess there is no middle of the road position here, although I am pretty sure that Ron himself has stayed away from the whole birth certificate thing if he can help it... am i right? does he address this in a video or interview somewhere (I searched DP and Youtube and couldn't find it). How can you set a trial date and not rule on discovery?
Whats the point of a trial date if the process of collecting evidence is denied? My initial reaction was "is the judge looking for a payout or what".

They set a hearing on Oct. 5 to rule on the motion for dismissal. That is when the ruling on discovery should come down as well. WND has been the only media outlet that I regularly check that has kept up with and reported on the whole birth certificate issue. Every other news outlet has ridden their coattails on this specific issue. While(just like everywhere else) I think a large portion of their news is trash, they do cover some things that nobody else wants to touch.

The way this day started, forgive me if I wait to get excited.
I am still suspicious of Orly. She gets too much press. They waited until they had a cute blonde who gets very excited as the person cast in the role of "attorney" before they let it get any play. Next, we will see them either toss her under the bus, or make a big show of pointing out her error, and she will play the mortified, shamed, and exiled attorney.... and live out a life you and I can only imagine.
I know, I am very, very cynical these days. Funny thing is, I am enjoying life again now that I have given up on humans. Once I stopped hoping they would wake up and act honorably and speak truthfully, my life got easier. Go figure - lol!
