9/11 suspects face New York trial - in which the death penalty will be sought

The alleged 9/11 mastermind will be transferred from Guantanamo to New York for a trial in which the death penalty will be sought, the US has confirmed.
Khalid Sheikh Mohammed and four others would be tried in a civilian court near Ground Zero, the attorney general said.
Five other Guantanamo detainees would face military trials, Eric Holder said.

If they are trying this towel-head in court then shouldn't the case get thrown out?
Reasons:
1) No arrest or Miranda rights
2) No speedy trial
3) Was Tortured
4) No physical evidence...and confession was made under duress
5) Was not allows legal representation
and much more....
Yes, I suspect they do not want this guy talking..just like they don't want Osama talking..and I believe they did not want the Ft Hood shooter talking...he was supposed to die. Hmmmmm...getting clumsy are they.

but this SEEMS like a positive thing for the so-called TRUTHERS. There may be evidence that comes up in a PUBLIC trial that shocks people... maybe enough for them to WANT another more detailed investigation into WHAT happened, WHY and WHO... the NEO-CONS sure wouldn't want this... I give the O some credit with this one... I personally feel there is enough evidence to warrant another investigation. I don't like Obama in general but I also don't mind giving him credit when I think his moves are right... but I aint poifect!
