SAN LUIS OBISPO, Calif.—A California rancher who houses homeless people on his property chose to serve 90 days in jail rather than accept probation after being convicted of misdemeanor safety violations.

Dan de Vaul says the terms of probation offered Monday would prevent him from sheltering about 30 people who reside at his ranch and participate in a substance abuse recovery program.

The 66-year-old de Vaul says he is proud to go to jail for housing the homeless. About 30 supporters applauded as he was led out of court in handcuffs.

Judge John Trice says officials have offered to help de Vaul bring his property up to code, but he would not accept assistance.

A jury in San Luis Obispo convicted him of two misdemeanors for violations of building and safety code.

I'd like to see the details of this case. I wonder what exactly was a threat to life or safety? Simply having 30 people in a building is not a threat, or parties would be banned.

I believe the permit process does have some validity. I want to know that a building was constructed properly since I cant take off the dry wall and look myself, but it should be voluntary. But I smell bull sh*t here...

Yes I live in SLO county too and last year I posted here a news story about a homeless man jailed for catching and eating a fish in San Luis Obispo. I also have a friend who was jailed for firing a gun in the air when trespassers were trying to repo his car on his acreage way out in the country here in SLO county this past year.

The headline is useful to draw attention to these issues

But if the guy's property is a danger to the residents then he gives the "smaller government" cause a bad name.

If the perception is that a service provider will risk people's safety then it tends to give justification to the "more government" crowd.

Not knowing all the details (i.e. is there a "not in my backyard" force trying to stop him?) it's difficult to make a judgement for or against the local government, which incidentally has offered to help him meet the safety codes. He refused the offer.

I firmly believe that jury nullification is necessary to end the current mess peacefully. If the jury was allowed to know all the facts, the only possible explanation for that verdict is that they did not believe that they could use their sense of right and wrong. The article does not contain much info. It is quite possible that the judge did not allow the jury to know that the man was using the property for charity.

Laws are needed to get bad people into court. Juries are needed to let innocent people back out. Informing the public about jury nullification is extremely important.

When will jurors figure out that they can interpret or cast off any law in any way they see fit? The most powerful thing in this country is a jury.... I would have been the hold out, voting not guilty.

Maybe that is why I have never EVER in my entire life been picked for a jury?

I am the same way...

I never been selected to be on the actual jury...but if i was it's basically 'Not Guilty' for anyone who commited a so-called 'crime' whereas there are no victims.

I see the only way to actually break the law is to infringe upon another person's life, liberty, or property. PERIOD

He did not go to jail for housing the homeless.

He is going to jail for building and zoning code violations.

Typical MSM slant to get ratings.

If I am not mistaken, if he can prove that at least 50% of his land is used for agricultural purposes, he would be exempt from building and zoning codes.

If that is the case, I think he had a bad lawyer, not a bad outcome.

Afterall, it is a ranch according to the story.

He chose jail rather than probation because the terms of probation would've prevented him from sheltering the people.

Regardless, you make an interesting point about the exemption.

I would be speculating but ...

I would assume that the only terms of probation would be compliance with the building and zoning code.

He could have applied for a variance ...

Obtained a permit for a change of occupancy ...

Got rid of his guests ...

or appealed based on agricultural use.

No doubt, the victim of the state could have begged for permission to do what he was doing in one of a number of ways.

When will the slaves learn, right? It is far better to beg permission than simply act as though you're free.

The law is the law whether I or you like it or not.

Unless this guy bought his ranch before the building and zoning code became law, he knew, or should have known that letting 30 people live on his property was a violation of these codes. If he didn't like it, he should have bought land and property somewhere else.

I am not a big fan of most zoning codes, but the building code, for the most part, saves lives and it reduces the chance that a neighbor's, tenant's, and/or owner's property could be harmed or damaged.

And, like I said before, if he could simply prove that his property was indeed "a ranch", it would have been exempt from these codes.

In every jurisdiction in this country you need a permit to build on your property.

When you apply for that permit, you are obligated to abide by the codes during construction and to maintain those standards after construction.

It just so happens that putting 30 people in your home changes the occupancy type of your dwelling and you are obligated to jump through the hoops to comply.

Of course, all that is moot if your land is being used for agricultural purposes. For some reason that land is exempt from obtaining a permit.

That is not my opinion, that is a fact.

If you don't like it, and I would agree that it has been taken too far, then you have get the law changed.

...To do with their property as they'd wish. Zoning codes, building codes, and the like are all infringements upon that right.

Zoning codes don't save lives, BTW. What saves lives are materials that are properly designed, engineered, assembled, and installed.

No one is preventing me from driving, but if I get caught, I am going to need to get a liscence or risk criminal penalties.

Yeah, I live in San Luis Obispo, and the De Vaul Ranch is just outside the city limits near Laguna Lake- De Vaul had been told by the property inspectors that he had to remove a whole bunch of trash, cars and other stuff from his property and he didn't feel like he should have to. That is kind of what kick-started this whole thing.

Recently this part of town has seen an explosion in McMansions around, and I have a feeling that the De Vaul Ranch just 'didn't fit in the neighborhood' and Christine Mullholand decided it was time for him and his housing the recovering homeless ways to end.

I find this pretty disgusting though, seeing as how there are homeless all over San Luis Obispo, especially our city parks, where they are just everywhere. The city is doing nothing to get them out of the parks and this guy was doing something, so this sentence really doesn't make sense.

What's interesting is we have a simular situation going on

Westport CA... made headlines in Fort bragg advocate several times where a good hearted ranch owner is getting reemed by the state for abandoned cars (buses, trusks, firetrucks,, hippy vans from the beat generation..

There was a new "Ten Mile Bridge" (to Westport, "nowhere") just built and plans for a golf course and resort not too far away... McMansions have not hit this area, but we also just had AIG help build the community of 6K in Fort Bragg a recreation center that's a mini water park,.. they can't sustain it, unless they move in some McMansions..

Seems were under the Build it and they will come plan?

The parks are public property, if I'm not mistaken. I think its a crime to shove people out of public parks and not provide for an alternate place for them to go. I'm glad that man stuck up for his rights.

She lives across the road

She lives across the road from De Vaul, and was at the time the representative for the district. She was approached and asked as the city council members (probably from the area) to do something about it, and took it on as her little pet project. She came to the conclusion that it was a 'safety' issue and De Vaul would have to bring it up to code etc (which would cost an arm and a leg). I don't know how these people, or our city is any any 'safer' now that they are back on the streets though.. It was mostly because the Ranch was right across the street from new mansions though.
