Wonder if

any of the McCainiacs out there are noticing all of the nazi legislation he is trying to pull off lately? I want to see some McCain bashing signs at the next tea o con event. Even better I'll go and take them myself and see what the half awake zombies have to say ! They really been coming out of the wood work lately looking for blood and are a scary bunch. Still proudly displaying their Mccain/Palin stickers on their high dollar cars. I have had 3 unprevoked attacks by these morons in the last 2 weeks. Glen Beck parrots for the most part. Really explode when presented with facts and love to ask if you think the government had anything to do with 911. My answer is always at the very least incompetence. They can't stand that answer. They want you to say yes thinking it will confirm you are a nut and render them right and you wrong. Hate to say it, but there evidently is a problem with right wing nuts.
No real knowledge. Just pissed off because their team lost. They will call you every name in the book before you open your mouth. I've been hanging in there and backing my statements with facts and documentation. They won't even answer a question ! And get mad as heck when you show them the truth or they can't back up what they say except by quoting Beck and not even doing that very well. Meaning to or not Beck has created dangerous monsters and you never hear him talk about any of the crazy legislation the republicans are putting on the table.
No apologies to anyone here that still thinks McCain would have been better or that still sticks up for Beck.
Neither of them are friends of liberty or the Constitution. As if I am not sickened enough by Bush and Obama, I shutter to think what McCain would be doing... Well I suppose he would be doing the bidding of the NWO also, but I think he would be even more cooperative and enjoy it even more. Just look at him ! He is doing it now. In the background like a cockroach where most people won't notice because they are still asleep or half asleep being led in the wrong direction and not thinking for themselves. Sorry for the RANT !

These legislators are

These legislators are attempting to overthrow Constitutional government.

I guess that makes them anti-government.

Very important

Yes this is Obama coming for what's left of our rights

Why don't the Tea-o-cons, who are so worried about birth certificates, see this? The way you put it to a Tea-o-con is: Bush pussyfooted around with diluting our rights in the name of fighting terrorism, but still he was kind of careful, maybe hesitant. Obama's coming after them and no bones made, straight down the line and in broad daylight. New Stalinism. Point to someone and he disappears.

Come to think of it, if you look at the facts, it fits. I never in a billion years thought Bush would be looking quaint. At least he bothered with backflips and "wartime powers." Obama is a magician, he may be doing the impossible: giving Bush a run for his money for "worst ever."

If this is Obama's works,

If this is Obama's works, then why is all of the co sponsers of this bill republican? Don't get me wrong I am no fan of Obama, but I will not say he is worse than Bush, as Bush basically was very close to declaring martial law, and was probably one of the most unconstitutional presidents America has ever had.

What Zon said!

Bingo, completely agree. Bush and Obama are tied for last place when it comes to defending liberty.

A Re-Affirmation of Our Rights, This Overthrow is Treason

Moved to main thread.

A re-affirmation of our Sixth Amendment rights under the US Constitution. A letter to the Sergeant at Arms of the United States Senate:
Bill Pickle
S-151, US Senate Office 151
Washington, DC

(202)224-2341

Whereas, the first duty of all Constitutional officers who swear The Oath is to "protect, uphold and defend the United States Constitution against all enemies both foreign and domestic,"

Whereas, after 9/11 the federal government has steadily trod upon our rights under the Sixth Amendment of the Constitution, the right to a jury trial no matter what the charge, which began on May 8th, 2002, upon the arrest of American citizen Jose Padilla, who was designated "enemy combatant" in his own land under the tissue-thin claim of wartime powers in the first war declared to have "no end,"

Whereas we lend no credence whatsoever to fallacious, odious arguments which betray the bedrock principle of a presumption of innocence before the law, secured in our Bill of Rights by dint of sacrifice on ground named Lexington, Yorktown, Bunker Hill, Valley Forge, Ticondaroga, and others,

Whereas we have not forgotten these sacrifices, written in blood on battlefields,

Whereas, the claim to authority to deprive any American of his or her Sixth Amendment right to a jury trial, with counsel, no matter what the charge, is a wishful fantasy of tyrants,

Whereas, the claim that "terrorists" do not deserve Sixth Amendment rights is bankrupt prima facie, since a determination of guilt must precede the bearing of that guilt,

Whereas, the application of Ex parte Quirin by the Fourth Circuit Court of Appeals in the case of Jose Padilla is a flawed application of precedent, since an indefinite, never-ending "war on terror" has no precedent. The standard for a precedent to apply in law is "for the facts of the case to be substantially similar." The present "war" bears no similarity to the World War II context of Ex parte Quirin, since the enemy cannot be seen, cannot be determined to be defeated, and possesses no command from whom to accept surrender. In all facets the "war on terror" is a novel set of facts under law.

Whereas a war which imposes the rules of the battlefield upon ordinary citizens in their own land indefinitely can only be a dream of tyrants from time immemorial,,

We Patriots hereby call an end to these stealthy and determined incursions upon our Sixth Amendment rights, which began on May 8, 2002 and is now taking its boldest form in a call by certain senators of the Republic, who have sworn the oath to defend the Constitution, and instead seek to subvert what is the very bedrock of the Constitution, our "inalienable" rights under the Bill of Rights.

The Constitution can be changed only by Constitutional Convention. Those who propose to change it by any other means are derelict in their duty to defend her. We direct the Sergeant at Arms of the United States Senate to place Sen. John McCain (R-AZ), Sen. Scott Brown (R-MA), Sen. Saxby Chambliss (R-GA), Sen. James Inhofe (R-OK), Sen. George LeMieux (R-FL), Sen. Joseph Lieberman (I-CT), Sen. Jefferson Sessions (R-AL), Sen. John Thune (R-SD), Sen. David Vitter (R-LA), Sen. Roger Wicker (R-MS) under arrest to be tried for the crime of treason, as "domestic" enemies of the Constitution as the Oath of the arresting officer requires.

We say again to all tyrants who would follow in their path of treasonous intrigue against We the People: "Don't Tread on Me."

Well written and well said!

Your post alone deserved a bump, so here it is. I may print it off to mail to LeMeiux and Inhofe.

Consecrate the fiftieth year and proclaim liberty throughout all the land to all its inhabitants! Leviticus 20:5

Anybody know where Rand Paul stands on this issue?

I mean, given his positions on Gitmo and military tribunals, and all.

Has he given any statement about this?
Perhaps it might be a good idea to find out.

Ayla

Ayla Brown is available.

I guess I will e-mail my disgust to both Inhofe and ...

LeMieux! This really fries my brain to the point of explosion! I am particularly disappointed in Inhofe, I had respect for him because of his standing up for the Ron Paul delegates in the last primaries. Someone may have gotten to him, just as they got to Coburn on the bailouts, but it still is a huge letdown.

Consecrate the fiftieth year and proclaim liberty throughout all the land to all its inhabitants! Leviticus 20:5

I'm fed up.

They're not listening in D.C. What is it REALLY going to take?

"I will always vote what I have promised, and always vote the Constitution, as well as I will not vote for one single penny that isn't paid for, because debt is the monster, debt is what's going to eat us up and that is why our economy is on the brink.RP

YAHTZEE -

Call, email, fax & write till your blue in the face. Once their in the give a shit less what the hell you think, except for what the special interest and lobbyist want. WAKE-UP y'all. Example Scott Brown he's been in Washington for about a month and is co-signing this Gestapo piece of crap!

All hail Scott Brown and the patriotic Eight!

I'm impressed by such a bold and stunning move to protect the children. All of you here complaining about our patriotic American government that works tirelessly to defend the people ought to be ashamed of yourselves. I'm glad that our system works so well, and that even although the majority of people may not want it those people in Washington DC who are brave enough to act can 'get things done' to ensure the safety of our children!

/end sarcasm

I feel somehow polluted, and quite dirty even writing that above. But I did it to prove a point. Regardless of the issue at hand, there will always be people who are opposed to it and those who are for it. That's human nature. What you need to decide is if you want liberty and freedom or to cram your ideology down someone's throat at the end of a barrel of a gun. Pick one people, because those are your choices. I choose freedom, and consequently, I find it repugnant that those of you here crying for liberties lost are all too eager to force other people to be subjected to the rules you want under the leaders you'd approve of.

Keep complaining out of one corner of your mouth and begging for the rules and rulers you want out of the other. It's what you've all been trained to do.

Thanks for this heads-up! I

Thanks for this heads-up! I just called my CA Sens. Feinstein and Boxer to strongly oppose this monstrosity. Hopefully mentioning that it was sponsored by McCain will deter them, but I took the liberty of reading Sec. 5 to each aid I spoke with and explaining how dangerous it is to extend this treatment to US Citizens.

I'm used to getting mad, but

I'm used to getting mad, but this made me really pissed off.

Check this out:

SEC. 5. DETENTION WITHOUT TRIAL OF UNPRIVILEGED
ENEMY BELLIGERENTS.
An individual, including a citizen of the United
States, determined to be an unprivileged enemy belligerent
under section 3(c)(2) in a manner which satisfies Article
5 of the Geneva Convention Relative to the Treatment of
Prisoners of War may be detained without criminal
charges and without trial for the duration of hostilities
against the United States or its coalition partners in which
the individual has engaged, or which the individual has
purposely and materially supported, consistent with the
law of war and any authorization for the use of military
force provided by Congress pertaining to such hostilities.

God Bless America

Let's flood the talk shows

The best to way to give this visibility is to flood the talk shows. If the MSM is blocking any news on this, we can take the news to them. Flood the phones on Hannity, Mark Levin, Rush, Savage and the assorteds. Please have a polite but angry talking points ready before calling these shows. Pretend as if this is a good chance to pour some dirt on McDummy and promote "our guy" JD hayworth. Though we all know the JD is also a NeoCon, we can use his name to promote our opposition on this. Be creative and listen to previous callers and change your talking points a little bit so as to not appear to be spamming these shows.

Time for some Guerilla tactics on this. If they use cunning to screw us over, we can use the same too.

Verbal weaponry

SH: So you think terrorists who want to slaughter millions of people should be allowed to "lawyer up" and get off on a technicality?

-- Sean, in America we are presumed innocent until proven guilty. We don't know who is a terrorist until we see the evidence, and the right to an attorney is our right under the Constitution. Why would you want to give that up? It could be you who is charged.

SH: So you want to reveal all the evidence in open court and let all the other terrorists know what's going on and who we've got?

-- Sean, I'm not as worried about individual terrorists as I am about a whole machinery of government, with all it's fallibility and capacity for abuse, with this kind of power. They had Ted Kennedy on a no-fly list for months and he was powerful. If they have the wrong guy what chance does the ordinary person have? This is why the Founders wrote, that's right, THE BIL OF RIGHTS!

SH: Ted K was the right guy.

-- You are calling a dead man a terrorist who is not here to defend himself? I'm no fan of the man's politics, but that's low even for you, Sean (phone line goes dead as you "accidentally" get cut off.)

A man who views the world the same at fifty as he did at twenty has wasted thirty years of his life.

I believe Bush should have been impeached the minute

he declared Jose Padilla "enemy combatant" under his "wartime powers" in the first war any president ever defined as having "no end." The amazing thing is that every American did not see exactly where this was heading.

This was the first of many trial balloons and tests of this new power, which is nothing less than an overthrow of the Constitution, the most important part of which is the Bill of Rights.

Now that the ground has been prepared and no great expressions of outrage forthcoming from the public, they feel safe enough to advance to the logical conclusion, which is this bill. I feel that unless we call this steady advance against the Sixth Amendment what it is, treason, consistently and loudly, any political opposition is fruitless because it is within the bounds they have drawn, as if we were debating any other mundane law like stimulus or even cap-and-trade.

This is an attack on what makes Americans, Americans. It started with Jose Padilla. It must end here. Call for the authors of this bill to be arrested for treason, people, before it is too late.

To uphold and defend the United States Constitution, against all enemies both foreign and domestic.

Some of you have argued this is ridiculous, that no one will effect such an arrest. Of course no one expects this to happen. But the town of Brattleboro, VT debated a resolution to have Bush arrested by local police on war crimes should he ever set foot there. This is the level of push-back which is now required. That will get their attention. Nothing else will.

The Constitution can only be changed by Constitutional Convention. You don't "lobby" for what you were born with as an American birthright. You demand it. They have clearly upped the ante. Now we must.

Tyranny

.

John Adams defended "enemy combatants"

John Adams defended "enemy combatants". He defended the soldiers accused in the Boston Massacre.

He was under no compulsion to do so whatsoever.

He did it because he believed everyone had the right to representation before a court.

If you're every in a conversation with a sheep, point that out.

Bravo, excellent point

Yes, his adherence to the equal application to the rule of law was one his more attractive qualities.

Who's a terrorist?

The brainwashed and the sheeple always like to say "Terrorists don't have rights."

The question, though, is who gets to decide who's a terrorist?

This isn't a moot question because now people like Liz Cheney are calling Justice Department lawyers "jihadis". Some even went to the extent of calling judges who decided cases against the Bush administration the al-Qaeda bench.

NO it isn't.

And who knows...maybe the PTB will solve this whole problem by infighting and accusing each other so much that they leave us alone. (I can always hope! :)

Scott Brown is campaigning for and with John McCain in AZ,

according to McCain's website. Everything he said in Mass. was a lie to get elected. Sarah Palin is in AZ campaigning with McCain also.

There is no publicly available text yet on Thomas.gov

When it is available it will show up here:
http://thomas.gov/cgi-bin/query/z?c111:S.3081:

Until then, while I'm not happy about what it appears this bill does, without the actual text, I'm not calling anyone lest I look like a fool for arguing against something that isn't there.

They want to give this power to the *President*?

Is this for real or have I lost my mind?! At least the bill refers to unpriviledged enemy belligerents, but will you be considered a unpriviledged person if you don't report for the health care takeover's 'census'? There are too many problems with this, especially section 5.

Before reporting on the Story, I phoned Senator McCain's press office, they confirmed he introduced the Bill and that the draft copy is what has been read twice and referred to the Senate Committee on the Judiciary.

Further both OpenCongress.org and GovTrack.Us have the bill, the draft text, and the co-sponsors.

It is standard practice for SmArgus to SOURCE all articles, especially those with such dire consequences.

Truly shameful

This is just horrible.

Ron Paul is the truth here.

Call them and tell them to arrest themselves?

Call their security guard and tell him to arrest them? And people think I'm crazy?

Called my Senators Kohl and Feingold

I also brought up that I AM part of the law enforcement community, and don't support it. I feel more unsafe than I ever have when I go to someone's door, because more people than ever perceive us as thugs, associating us with these political power grabs on the federal level.

That vest is no match for a rifle or a head shot. All we're doing is kicking a hornet's nest! Maybe someday the Federal government will tell departments to get rid of people with views like mine, which I'm not afraid to express. You know, the view that we should follow the supreme law of the land.

Wisconsin!

First what part are you from.. Im originally from Muskego but im currently on active duty for the Marines..

second off topic but who are you supporting for Governor?

Im pullin for Mark Neumann

I'm in La Crosse.

Neumann is the best I've seen so far. I saw his ad on facebook and followed it. Not bad. I hope he has a chance.

I'll be volunteering to help State Senator Dan Kapanke knock Ron Kind out if his US House position. He believes in the Fed Audit and some other things I support. Meanwhile Kind is in lock step with Kohl. Kapanke listens to me at least. Oh, and his office assistant really perked up when I said I'm a Ron Paul supporter.

La Crosse Rocks!

Great school and town. We won the NCAA Football Championship on the last play of the game my junior year. And man do I ever miss the responsibility-free nights spent on 3rd street........:)

Interesting

I went to UW-L for a while, in 1999. You were on the football team? I used to practice with the track team, but I actaully ended up running for Oklahoma (Sooners). I finished at Viterbo in 2001.

3rd street is still alive and well, but there are still people spreading rumors of a serial killer because another college student walked into the river and died recently.

I hope there are lots of thinking people

in law enforcement, and thanks for your perspective. Bad laws have to result in trouble for all.
