"Senator John McCain is apparently not eligible to be elected President of the United States under the clear provisions of the Constitution. McCain is not a natural born citizen inasmuch as he was born in the U.S. Navy Hospital in the Panama Canal Zone, which was never part of the United States.
"The Constitution states, “No person except a natural born Citizen, or a Citizen of the United States at the time of the Adoption of this Constitution, shall be eligible for the Office of President.” The 14th Amendment did not alter this provision.
"The status of the U. S. Navy Hospital in the Panama Canal Zone is described by the U. S. Department of State in its Foreign Affairs Manual (7FAM1116.1-4(c)): “Despite widespread popular belief, U. S. military installations abroad and U. S. diplomatic or consular facilities are not part of the United States within the meaning of the 14th Amendment. A child born on the premises of such a facility is not subject to the jurisdiction of the United States and does not acquire U. S. citizenship by reason of birth.

reminds me of a news report I heard this morning about Obama's eligibility. It was an ABC news report on the radio which said a Federal Judge is looking at the arguments about Obama's birth certificate issues. The report went on to say Obama's birth certificate is sealed and the judge is considering unsealing the document to determine if indeed the President's birth certificate is valid. If someone finds the ABC news story - maybe you can post it.

The phrase is "a natural born Citizen" NOT "a citizen born within the borders of the U.S." Congress first extended citizenship to children born to U.S. parents overseas on March 26, 1790, under the first naturalization law: "And the children of citizens of the United States that may be born beyond sea, or outside the limits of the United States, shall be considered as natural born citizens." For the history impaired, the U.S. Constitution was adopted less than 3 years before this law was passed. Some of the men who participated in the Constitutional Convention probably wrote and then signed this law. McCain is the son of a U.S. Naval officer and his U.S. citizen wife. A child born abroad to U.S. citizens becomes a U.S. citizen at birth. The fact of the birth of the new little U.S. citizen must then be registered. Thus, as the child of two U.S. citizens, one of whom was a Naval officer. McCain IS "a natural born Citizen." Do we really want to make one of the consequences of serving in the U.S. military overseas to be that your children born while you're on duty aren't "natural born citiizens"? I certainly hope not.

Not quite true.
An American military base is considered American soil for the duration of encampment, operating as a portable embassey, I think. Not sure, but I thought that worked in that case.

Look -- the key distinction is between people who were born citizens and people who became citizens later in life.
McCain was born on a US base to US citizen parents. The moment his head popped out of his momma's coochie he was a US citizen. He's eligible.
Somebody who had to immigrate to the US and apply to become a citizen later would not be eligible.

The state of Ohio was admitted as a state in 1953 via public law 203. Look it up. Does that mean that Harding had no right to run for president or to serve? It's a valid argument, but it will get you exactly no where.
