28th Amendment Proposal: Specific Measure to End 2 Party System
Now more than ever before, Americans in February 2008 are seeing the need for their state legislatures to ratify a simple new US Constitutional Amendment that would break the back of the 2 party system that leaves the majority of Americans consistently unrepresented.
220 years ago, geography was the main determinant of what a "special interest group" was, but geography and direct geographical representation became less important in the 20th century and the Internet has made geographical representation obsolete in the extreme. Ron Paul represents you and me more than he does most of the people in his official district. Everyone knows this, but nobody has proposed an amendment to deal with this...until now.
As one of the first "democracies", America got it wrong with its "all or nothing" voting system where every Senator, Congressperson and President is directly elected (where every eligible citizen gets one vote for every position). Tyranny results when every citizen gets to vote for every position...because, in a room filled with 12 people including 7 idiots, the idiots will make sure that absolutely every person they elect will be idiot-certified by a 7 to 5 vote.
European countries, most of which were recently given their freedom by US military action, mostly have a system where, if 5% of the national population votes for an obscure political party, that party gets 5% representation in the national legislation even though. Under such a system, the idiots in the above room could always chose a country's president or prime minister, but never control more than 7/12ths of the legislature.
We probably cannot get a 28th Amendment passed where the Senate and House are entirely filled proportionately (for instance where Ron Paul supporters would be guaranteed 10% of the Senate and House members). Too many Americans might still believe the ILLUSION that they are being specifically represented when they directly elect US senators (two per state) or directly elect someone to represent their district.
But a 28th Amendment could increase the size of the Senate and House by 50% with the additional members being AT LARGE Senators and Represenatives who are UNPAID.
The "At Large" members could be selected either by party leaders in proportion to the percentage of votes a specific party gets in a national "At Large" vote or we could do the following:
Allow thousands of people to put themselves up as "At Large Candidates" where the 50 highest vote-getters become unpaid US Senators, who are JUST AS POWERFUL as the other US Senators and where the next 175 highest vote-getters become unpaid US Representatives who, unlike the other representatives, only represent the 100,000 or so people who felt the need to vote for them (the At Large person we vote for would be more important to us personally than the paid Congressman who will represent the geographical district where we happen to be temporarily living).
The dynamics of making 33.3% of Congress to become "At Large" would be that most of these extra members will NOT have been elected by a majority of people in a given geographical area and, mathematically, because the large amount of idiots in each and every precinct can only vote ONCE for the "At Large" member, they will end up all voting for the few Democrats or Republicans that they can think of who will get maybe 25 "At Large" positions, while the thinking people can then make sure that 5th place finishers and even 20th place fiinishers become US Senators as well.
This way, you won't just get a dozen Ron Paul Party members in the US Senate, you will get some "Pro Life Party" and "Pro Choice Party" and "Women's Rights Party" and "Men's Rights Party" members as well. Sure, you would get a number of movie stars and other celebrities...but only if they put themselves in for the positions and, hey, I would trust a rich movie star not to be corrupt more than I would trust John McCain.
The current "tyranny of the idiots" would end because the idiots who listen to the media would not each have one vote for every potential member of Congress, and there would be no such thing as wasted vote syndrome for the At Large candidates.
And those of us who support Ron Paul now but disagree on a few small matters like immigration...can chose to put Ron Paul in the Senate with 1 Million votes or chose to put a lesser known libertarian into the House with 100,000 votes (enough people would vote Ron Paul into the Senate under such a scenario).
But we could not do both. Everyone would get only 1 vote for just 1 of the thousands of at large candidates, and the top 225 will get their positions after each of us has had our 1 vote.
As in Europe (where parties designate the parliament members based on the proportion their party got in the national vote), this proposal for more direct non-geographical representation, would result in people not having to sacrifice their ideals in order to belong to a winning political team, which is the inevitable result of banding together in today's America to get someone into the White House with a plurality.
Here is the good part: Such an Amendment would fly through the State legislatures and could be ratified quickly, especially in the current climate where the media just convinced a bunch of idiots to make John McCain the frontrunner for conservatives.

REPEAL the direct election of Senators as an infringement on STATES rights.
This would dramatically change DC over the next decade.
Direct election of Senators; The income tax; and the Federal Reserve were the three great wounds to the US -- all in 1913...
I thought of that as fallback. States R controlled by 2 parties
Of course, when state legislatures can decide what two senators they are going to send, if they are controlled by the national parties, would that make things worse?
Please explain further why we want to stop direct election of Senators. I agree that direct election for every position, where each idiot gets the right to vote in the battle for each position, is undemocratic.

For my time I would rather put in the effort to abolish the 16th Amendment.
Huckabee already has many who are agreeing to Abolish the Income Tax.
That is Step one, abolish the Income Tax.
Then Step two is OPPOSE anyone who tries to replace the Income tax with a National Sales tax.
Lets keep Step Two to ourselves.

The two-party system was designed for our amusement. It helps us have an "A" or a "B" to choose from (which makes us feel real smart!) Kinda like we're in control.
No need that I can see for a "named" party. It's about the INDIVIDUAL, isn't it? What relevance does a "party" have. Who's party? Where is it? Will there be a band?
Our current electoral process may have been appropriate during the days of the Pony Express, but a rigid, two-party system, in the current environment is like shooting fish in a barrel. It's a rigged game.
I contend that if the Internet is secure enough for e-commerce and banking, it's secure enough for voting.
Mathematical Reality Created the 2 Party System
Under the flawed geographically-based "everyone gets to vote for every candidate who will get a position", a corrupt two party system is a mathematical certainty over time and a two party system is a mathematical certainty over a very short time.
The reason is that each idiot in a democracy, and the majority of any democracy are idiots, will have a say in each person getting elected. This guarantees that NOBODY decent will ever get elected. The idiot votes will stop that person. Mathematically then, the winner would have to be one of two people that the idiots tend to be drawn to.
And then the full-blown morons like Michael Kinsley at Time Magazine can write really low IQ articles like you see at www.realclearpolitics.com today, where he thinks he is funny by saying the Republicans are playing a dirty trick by nominating a "likeable, competent guy" like McCain.
What we want to see happen is that the 4th place and 38th place finishers (for President or for At Large) all become US Senators. That way the media and the two parties lose most of their power instantly.
At best, they can spend $200Million getting the top 10 finishers to be mostly their type of person. But, even then, Ron Paul would come in 3rd place and Tom Tancredo and Duncan Hunter would finish in the top 10.
After that, 40 "At Large" US Senators would end up representing 40 non-geographic constituencies. You would see a huge free-for-all.
All 40 of these so-called "also rans" would have just as much power as the top 10 finishers. And the House of Reps would fill up with the next 175 "also rans". Mathematically, you cannot maintain any party control over a process where the top 225 finishers in an election all go to Congress.
Extra good news: The two party system's biggest flaw is that it automatically creates for itself a mostly 50:50 tie between its two parties, regardless of whether the two parties are corruptly working with one another. A simple measure like this, where even a minor influx of non-party people enter Congress, will give these non-party people all the swing vote power.
Caution about amendments
Any consitutional experts out there?
Many years ago, in relation the Equal Rights Amendment, I believe it was pointed out that if a Constitutional Convention is called, *anything* can happen there. It is not just limited to the single Amendment request that triggered it.
Is that true?
Just as there are hopes to change the outcome to Ron Paul at a brokered convention, all sorts of Amendments could suddenly be added, like no gun ownership at all, Real I.D., illegal amnesty, marriage definition (including or excluding homosexual partnerships), ERA is making the rounds again - does it add "sexual orientation" now?
We don't need a law about term limits, just vote incumbents *out*.

The "two party system" is a myth. It is MANUFACTURED by those two parties themselves.
There is NOTHING in the Constitution or US law that dictates a two party system.
SO... the solution is to REMOVE ALL accommodations to these parties. All the caucuses, offices, majority leader yadayada in Congress.
I say, every man/woman for themselves.
If they want to band together, fine. Constitution says free association is okeydokey. So do I.
BUT.... NO SPECIAL: PRIVILEGES for Reb./Dems or whatever.

The elite of course. They created all the ...isms via social engineering and divide and conquer strategy. Better 28th Amendment: Prohibit Consecutive Terms
Giving credit where credit is due: THIS WAS THOMAS JEFFERSON'S IDEA, but it didn't reach the Continental Convention in time (damn slowboat mail delivery!).
The biggest problem in the District of Criminals is CAREER POLITICIANS. Simply get an amendment brewing from the people and the states to prohibit consecutive terms (no, this is not term limits) so that NO INCUMBANTS can run for federal office. Thus, politicians will either be IN OFFICE (and voting/working) or RUNING FOR office, but not both.
A prospective public servant will be required to be OUT OF federal office for a period of time equal to or exceeding the term of the new federal office sought. They could go back and forth between state and federal office, but just imagine of EVERY Congressiona. Senate, and Presidential race being a totally NEW OPEN race.
BONUS: Politicians would become extinct, replaced by public servants, since they wouldn't be making decisions/votes to set themselves up for their next campaign.

I don't necessarily agree
By shortening the time they are in office, there would be more pressure to get stuff done quickly (=more government interference in our lives). At the same time, I see your point, it would also correct these things much quicker. It would be quite a roller coaster ride.

I think there should also be an attempt to open up the field to 3rd party/independent candidates.
Also, add in maybe an uncommitted/unsatisfied vote so when big elections come around if a certain percentage find the choices unacceptable then the election has to be redone.
Write it up rather than explain the idea.
I'd rather just see elections be completely free of party labels, period.
