Government Concedes Vaccine-Autism Case in Federal Court - Now What?

After years of insisting there is no evidence to link vaccines with the onset of autism spectrum disorder (ASD), the US government has quietly conceded a vaccine-autism case in the Court of Federal Claims.
The unprecedented concession was filed on November 9, and sealed to protect the plaintiff's identify. It was obtained through individuals unrelated to the case.
The claim, one of 4,900 autism cases currently pending in Federal "Vaccine Court," was conceded by US Assistant Attorney General Peter Keisler and other Justice Department officials, on behalf of the Department of Health and Human Services, the "defendant" in all Vaccine Court cases.
The child's claim against the government -- that mercury-containing vaccines were the cause of her autism -- was supposed to be one of three "test cases" for the thimerosal-autism theory currently under consideration by a three-member panel of Special Masters, the presiding justices in Federal Claims Court.
Keisler wrote that medical personnel at the HHS Division of Vaccine Injury Compensation (DVIC) had reviewed the case and "concluded that compensation is appropriate."
The doctors conceded that the child was healthy and developing normally until her 18-month well-baby visit, when she received vaccinations against nine different diseases all at once (two contained thimerosal).
Days later, the girl began spiraling downward into a cascade of illnesses and setbacks that, within months, presented as symptoms of autism, including: No response to verbal direction; loss of language skills; no eye contact; loss of "relatedness;" insomnia; incessant screaming; arching; and "watching the florescent lights repeatedly during examination."
Seven months after vaccination, the patient was diagnosed by Dr. Andrew Zimmerman, a leading neurologist at the Kennedy Krieger Children's Hospital Neurology Clinic, with "regressive encephalopathy (brain disease) with features consistent with autistic spectrum disorder, following normal development." The girl also met the Diagnostic and Statistical Manual for Mental Disorders (DSM-IV) official criteria for autism.
In its written concession, the government said the child had a pre-existing mitochondrial disorder that was "aggravated" by her shots, and which ultimately resulted in an ASD diagnosis.
"The vaccinations received on July 19, 2000, significantly aggravated an underlying mitochondrial disorder," the concession says, "which predisposed her to deficits in cellular energy metabolism, and manifested as a regressive encephalopathy with features of ASD."

I am a physician and I don't have kids
but I no longer get my cats vaccinated as the last two I had reacted very badly to vaccines and I inevitably ended up taking them to the emergency vet after they got their routine shots.
Vaccines, like all medications, have serious side effects. One must balance the risks versus the benefits. Inflammation of the brain following vaccination is one of the known side effects and may play a role in autism. There have been studies that link flu vaccine with increased risk for Alzheimer's disease. The point is, the physician should inform the patient or his/her parents of the true risks and benefits and allow them to make an informed consent.
What we have now, is government trying to impose its will on everyone and you will be hard pressed to find a doctor who is well-informed on the side effects and is also willing to explain them to you. I personally would recommend you not take the flu vaccine but instead take Vit D3 daily -it will probably better protect you.
As medicine is currently being driven by big pharma and the insurance companies, it behooves anyone who cares about their health to inform themselves on health issues and not fall victim to the latest health fads, cholesterol lowering drugs being one of the biggest and most onerous. The information is available. Educate yourself.
I understand your struggle.
I have a nephew who will be 5 soon. He has autism. He was fine and doing normal baby things, up to his vaccinations. Then after his vaccinations, he became a different child. He was non-responsive, no eye contact, and in his own little world. He still cannot speak. There would be no way I would ever give a child of mine vaccinations.
Vaccinations
I really struggled with this. I have family members with mild autism. I also have read many books about the diseases that killed millions of people throughout history. I did have my children vaccinated. I really couldn't live with myself if they died of a preventable disease. My great grandma had 26 kids. Only two survived to adulthood. When vaccinations became available, I can see why people ran to get them. They had seen too much suffering and death.
The idea that a person that is not vaccinated poses no risk to a vaccinated person is not true. About 3-5% of vaccinated people will not become immune. They can still get sick. Vaccines also wear off over time. A family member had whooping cough with severe asthma as an adult and got really sick from it. He was in an area where many people decided not to get their children immunized against it. It could have killed him.
My best friend growing up was never immunized. I can't tell you the anxiety that caused her when she found out she was pregnant. She had to stay away from almost all people for the entire pregnancy. Some of these diseases cause severe birth defects and couple of them were going around at the time.
On the same note, I feel for people that have autistic children. It is a horrible epidemic. Parents should have a choice to immunize or not. I have confidence that we will eventually figure out what is causing it. I have a feeling it is something we are using every day. It will be just like when they discovered asbestos causes cancer.

I think all home owners before selling should have to get their homes tested my mothers house wasn't even when we asked they said it had no asbestos after having it tested our selves now were looking for a minnesota asbestos attorney to see if he can get her money back and out of the home.

A touchy subject, even on a forum that supports Ron Paul. The whole point behind this is that MASS vaccination may not be for everyone.
Some people think it's great. Others, not so much.
Personally, I am in the not so much camp. I have done 7 years of research into the subject and looked at both sides of the coin. After reviewing the ingredients list and seen the adverse reaction that the Hep B vaccine caused in my 3rd child, my decision has been to not vaccinate my youngest two children.
The point is CHOICE. And if other parents choose to vaccinate their children, then why are they scared that your children aren't? As I stated below, the only "choice" in my state (MS) is to vaccinate or homeschool. This, to me is not a choice because, although I am able to homeschool, not all parents have the time, they have a job, or simply do not feel capable.
Dr. Paul speaks about choice in medicine and advocates alternative means of achieving health. I have not done much research, but have heard rumors as of late of "natural vaccinations".
Please explore all of your options and be INFORMED when making a decision. Don't just do it because it's expected (even if Dr's or health "professionals" give you dirty looks) or because that's what most people do. The masses are asses.
You are so right...
it's all about choice. But as far as homeschool goes, I know of several states that are trying to mandate vaccinations as part of the requirements to homeschool....
To my knowledge, it's not working so well, but the effort behind it bothers me...
I did vaccinate my kids...I fell for the whole "you're a bad mother if you don't" impression that they give you. Luckily, they had no adverse reactions, and are extremely healthy, but who really knows what could be in their little systems that have no symptoms.... it makes me sick.... :(

if you can opt out for regular school in all states but MS and VA, then surely you could opt out for homeschool?? Do you have any links I could look at?

you still have full control over whether or not to do it if you homeschool. but there is a movement to try to force homeschoolers to supply vaccination records...
Here in NC, for example, the law states that you are only required to supply attendance and test scores. Period. But the DNPE sent out letters to "randomly selected" families, asking them to come to a "voluntary meeting" and to supply, in addition to the above, your curriculum, a homework portfolio, vaccination records, and....your kids. Best of all, this voluntary meeting was to be held at a POLICE STATION!! OMG, right??
Needless to say, no one fell for this, and it was sucessfully challenged by the HSLDA, but it's scary, nonetheless.
I had six children (still do - but they're adults now)
I struggled with the vaccine issue. My kids had severe reactions to some of them. I ended up only giving them a few and refusing the rest.
This doesn't have to be YES or NO. You can get the ones you want - like the ORAL polio one and refuse the shots.
Even though I gave every single one of them the whooping cough vaccine - they all got it. Can you imagine? six kids coughing for six weeks? My little one at the time (only 3 months) coughed for 12 weeks. It was hell.
But they all got over it. Same with Chicken pox. They all got it and all got over it. Kids used to die. My grandmother lost half of her siblings to these disease. She was the oldest and watched or held them as they left. It was a really sad story. Especially measles. I made sure my kids had that one - regardless of side effects. Measles is a nasty disease.
The positives
The positives of vaccines are far more than the negatives..You have to be nuts to not get your kids vaccinated...I had my college son vaccinated against meningitis even though my insurance said it wasn't necessary and they would not pay....A few days ago a 3 yr old neighbor boy got meningitis and died in less than 3 hours.. I'll gladly take my chances with vaccines..nothings perfect..

My dad also had polio from the time he was 2 till 12..flat on his back for 10 long years..he sure would have been better had he been vacinated..he lost both parents to polio also..Do you have any idea how many kids could die by an outbreak of chicken pox or measles or mumps, whooping cough ? I know my neighbors would have prefered their son have some side afect as opposed to dying...You remind me of the nuts that don't take their kids to a Doc because some 'god" will cure them..get your kids vacinated..I got 3 and 6 grandkids, all vacinated, all just fine..read all you like, what I'm stating is the real world

His being vaccinated would not have "instantly been the cure" is what you need to understand. So you think I'm nuts. It is about CHOICE and not being FORCED. Paul agrees with this but here you are again disputing his stance!!! And BTW, what I would decide for my kids is MY CHOICE.

I want small government..what I believe in is common sense and before vaccines diseases were rampant..Now life expectancy is much longer..and part of that is vaccines..I do not mean to offend your religious beliefs, just to point out that there are many reasons people chose not to vaccinate or seek help for their kids
My kids got whooping cough
from an epidemic of it in Montana when visiting there. The epidemic was kids who HAD been immunized. The pertussis vaccine is one of the most dangerous, and now they admit it doesn't work. My latest grandchild was vaccinated recently , had several seizures, and when checked out was told not to do it again. Vaccines destroy the immune system. My two older children were vaccinated as usual and were sick constantly their whole childhood, and my last four were not vaccinated and are RARELY ever sick.

That is a really interesting observation. All of my siblings got vaccinated except one (who stop getting the school shots at age 7) and they are always sick! colds, flu, allergies. except the one who didn't get vaccinated, who is never sick.

there are cases like yours and I would certainly heed your doctors advice....And I watched the little boy die of meningitis in the back seat of my car, gasping for air in his dads arms..Even though the hospital said if we had gotten there sooner the outcome would not have been change, I will NEVER forget that day..Had 6 brothers and sisters, 3 kids of my own, 6 grandkids, all vaccinated and all fine..Like I said, nothing is perfect....not vacinating your kids is playing russian roulettee, not only with them, but everyone they come in contact with..

I agree, vaccinating your children is almost always the safest way to go. I guess there could be scenarios like the one above where a previous medical condition could be aggravated, or people could be over-vaccinated, but look at all the diseases vaccinations have helped curtail.
One of the questions I had for Dr. Paul is whether he thought children should be vaccinated. I find it honorable of him that he said at the Killeen rally that he believes strongly in them, but that parents shouldn't be forced to vaccinate their children.

I am 29 and when my age group entered school, we only had to have around 8-10 doses. Now? The children have to have 20 some odd vaccines. And in the case of those families in NJ, you know...the judge that lined up the families with police and dogs ::cough::gestapo:: those children are now required to have 36 doses.

Bush with this Health Freedom Act is treason against the people. They have changed the meaning of words. The only freedom granted in this "Act" is the freedom from prosecution for the drug companies! They can forcefully "vaccinate" anyone they please. So much for freedom.
Recently in Maryland they did a mass "forced" vaccination, with armed presence, and dogs, at the court house!! These are the last days indeed.
I wish people would wake up and realize what is about to happen to them. How Bush and his pharma buddies make out like fat cats using you and your's as their guinie pigs!! I have tried to talk to friends and encourage them to read Dr. Sherry Tenpenny's book. That is just one on the market that discloses these MONSTERS! Most people, from my experience trust their Dr.'s and are in blissful ignorance!

Vaccination is NOT 'mandatory'. You can claim a religious or 'other' objection and not do it. My two children are 7 and 5 and other than a tetanus shot for one of them, no vaccines whatsoever. Remember that laws like these that take away your health choices almost always have an out for religious or other reasons. Don't be fooled by government propoganda. And if some parent walks up on you and says they don't feel safe because your children aren't vaccinated, just tell them, 'Well, your kids are vaccinated, they should be protected from mine, right?'

Mississippi only has medical exemption. We are in the process of trying to get a bill passed through so we have the same options as other states. But at this point, it's medical exemption or homeschool.
Do your children go to public school?
I've heard stories where parents were told their children couldn't attend school until vacinations were up to date.
I don't know about other states
but when we had our kids in public school last year in CO, we could get a religious exemption to vaccines...

My first two did have vaccines because I didn't know anybetter.
My 3rd child had developed an allergy after receiving the very first shot before leaving the hospital. Again, it's before I had the knowledge that you could refuse. My youngest two have not been vaccinated at all.
Most people don't seem to realize that with improved diet, illness rates for the diseases that we are now innoculated for had already been in severe decline by 80% BEFORE vaccines were given to the masses.
I used to buy into "Vaccination is the safest way" garbage
But after several years of research, I just don't buy that. Also, I'm a devout Catholic, and since the Rubella portion of the MMR combination vaccine is made using aborted fetal tissue, I have a moral obligation to use an alternative, if one exists. The measles and mumps portions are available separately and I think those are worth getting, so we pay the extra charge (our insurance doesn't cover the separate vaccines, only the combo). It's definitely about not having the government force us to choose what they think is best for us. Freedom and Liberty bring great responsibility, and I'm willing to accept that as I make the best decisions for me and my family.

If the state has no law then you don't have to do it. You can get a waiver for your children. Do your homework.... so your kids have a chance at doing theirs.
