The issue is actually the audio
It is technically a violation of the law in NH to record a conversation without the consent of all parties involved. In this case the police probably used poor judgement in how they responded, but there is a real issue in the way he had things set up. If he was just recording video there would be no problem.

If i videotape a burglar stealing something from my property and I try to use that as evidence, I then can be arrested for video-taping him without consent?
That basically what they are saying.
Maybe we should all put signs on our property stating there is a chance anyone who enters will be taped.
