Here is the response from the Secretary of State office after I
repeatedly called and emailed.
Sir/Madam: Thank you for inquiring about the issue surrounding
Sen. McCain and the federal matching funds program. The office
of the Ohio Secretary of State cannot respond to any questions
regarding this matter. A complaint has been filed by the DNC
with the Federal Elections Commission. At this time, it is out
of our hands.

talk to Jennifer Brunner" She is an elected official and we
should have the right to talk to her.
Questions to ask:
If John McCain got on the Ohio ballot because he was taking
public financing, why should he remain on the ballot when he
has turned down public financing now?
Is the Ohio Election Board looking into the question of John
McCain being on the ballot without having no petition
signatures and not taking public financing?
How is John McCain still on th Ohio ballot?
How did John McCain get on the ballot?
Request a list of the John McCain delegates and alternate
delegates and any petition signatures with them.
Why Jennifer Brunner will not answer any question regrading
McCain"s ballot qualifications?
Why doesn't Ohio enforce their own laws?
Why Jennifer Brunner will not answer any questions?
They will transfer you or tell you they can't answer. We will
keep the pressure on them. Contact the media and tell them that
the Secretary of State of Ohio will not answer your questions.
They have no answers for the questions.

McCain is not longer taking public funds to run for President,
Washington Post on Feb 25, 2008 article
"Potter, in his letter, challenged Mason's interpretation,
noting that federal law and agency regulations contain no
requirement for a vote to exit the system. As a result, he
said, McCain's notification to the FEC on Feb. 6 that he was
withdrawing from public financing should stand.
"The legal effect of Sen. McCain's withdrawal _ whether it is
found to occur automatically via his letter of Feb. 6 or is
later ratified by a vote of the new commissioners _ will be the
same: Sen. McCain will not be subject to the program's spending
limitations after Feb. 6, 2008," Potter wrote. "
but he took a loan in December and took matching public funds.
He also used the matching funds to get on the Ohio ballot. Here

Account Act" may file a
Declaration of Candidacy and a list of at-large and district
delegates and alternate delegates
with the Ohio secretary of state, bypassing the petition
process. The delegates must be selected
in accordance with Article X of the Ohio Republican Party State
Central and Executive
Committee Permanent Rules.

He wil soon be out of compliance
The reason he wants out of the system is to avoid spending limits. He is about to go over them, which would DISQUALIFY him fom receiving the funds. If he stays in the system, he can't spend any more money during the primary election.
Where and How...
do we keep track of his daily spending habits? Does anyone have a link? How much are we talking here?
It's a matter of if
he exceeds before or after the Ohio Primary. If he doesn't exceed until after, we have no grounds. If he does, we need to have our argument ready.
Being eligible for something
Being eligible for something doesn't mean that you necessarily take advantage of it. The law you quoted only says that the candidate must be eligible. Ron Paul is also eligible, but he would never choose to take advantage of federal funds. But, he very possibly qualified for the ballot in Ohio because he is eligible.
So Why Then
Did McCain not have to go through gathering signatures like Ron Paul did in order to be on the Ohio ballot?
Don't Forget Back in 1988 Pres. Run Ron Paul
Paul was kept off the ballot in Missouri, and received votes there only when written in, due to what the St. Louis Post-Dispatch called a "technicality".[49]
2008 campaign chair Kent Snyder first worked for Paul on the 1988 campaign—when U.S. Senator John McCain told him, "You're working for the most honest man in Congress."[13][19]
Let's hold McCain to his words.
They'll give McCain the benefit of the doubt
We had some of this debate when it was clear some Patriots would have to put in a lot of driving time in a winter storm to complete the ballot access process.
Because the wording says "eligible to receive payments", an establishment candidate would be given the benefit of the doubt and would be given ballot access even if refusing the funds. (It was assumed Ron Paul would not receive the benefit of the doubt--hence the need for all the dangerous driving.) The doubt here lies in that McCain has not just refused the funds; he has accepted and then withdrawn. He would be given the benefit of the doubt at this time because, until the moment he spends beyond the limit that would make him no longer eligible, he could re-enter the program at any time. Has he spent beyond the limit yet?
I'd love to see some media coverage
I'm sure McCain hopes everybody will just ignore this too. But why isn't this even mentioned in the news?

We are NOT causing a big enough roar. We need to contact the media about this. This includes newspapers, radio stations, TV stations, our local representatives and our Congressman.

Share this information with EVERY meetup group. The organization of our party is already in place and we can ALL make a difference. This can be bigger than campaign contributions.
This would be a TRUE grassroots effort that can make an impact.
The more I think about this
The more I think about this the more outraged I am! I was one of the many who went around the state getting petitions for Dr. Paul. We spent many man hours getting this done.
Here comes John McCain, Mr. Caimpaign Reform, applies for Federal Matching funds. Doesn't take them, but receives all the other benefits of applying for them.
This makes me sick to my stomach!
Spoke With Congressman LaTourette's Office Regarding This Today
Did you know Congressman LaTourette, Congressional District 14 in Ohio, sits with Dr. Paul on the Federal Economic Board? I spoke with representatives of his office regarding this problem that we uncovered and he told me that this is where TRUE Grassroots movements can start to make people notice. We need to spread the word and challenge his Ohio ballot access. LaTourette's office has noticed many signs for Ron Paul and his message is getting out. Don't give up no matter what they say, write every newspaper and media outlet to notify them of this.
They also noted that it is not in the best interest of the Republican party to alienate Ron Paul and his supporters. The fact is Dr. Paul has attracted many to politics that would have never been involved before and it would be a mistake to ignore them.
