Senator McCaskill submitts unconstitutional bill on McCain's eligibility.. Help needed!

John McCain is not a natural born citizen of the United States. Unlike Ted Olson McCain’s lawyer (you remember the Bush lawyer of hanging chads fame) Muddy Thoughts boggler of the “Internet is officially screwed” camp. Has written a very sound defense of the reasons why the constitution has to be changed.

Now it seem that Senator Claire McCaskill of Missouri is claiming that she can change the constitution of the United States of America by making a legislative declaration. When she took the oath of office she swore to up hold the Constitution of the United States. I have included this little issue that she has avoided.
Article V
The Congress, whenever two thirds of both Houses shall deem it necessary, shall propose Amendments to this Constitution, or, on the Application of the Legislatures of two thirds of the several States, shall call a Convention for proposing Amendments, which, in either Case, shall be valid to all Intents and Purposes, as Part of this Constitution, when ratified by the Legislatures of three fourths of the several States, or by Conventions in three fourths thereof, as the one or the other Mode of Ratification may be proposed by the Congress; Provided that no Amendment which may be made prior to the Year One thousand eight hundred and eight shall in any Manner affect the first and fourth Clauses in the Ninth Section of the first Article; and that no State, without its Consent, shall be deprived of its equal Suffrage in the Senate.
Who should care about this? Well every democrat that saw 2000 election and had any doubt about the Supreme Court ruling, which made George Bush president. All conservatives both Libertarian thinking and Statist leaning who respect the rule of law. Anyone who disagrees strongly with the neo-con or Council on Foreign relations policy of global policing the world with entangling alliances. What we have is mainstream media cartel push candidates intending to maintain an empire. As a huge Ron Paul freedom advocate please write and voice your displeasure with politicians not living up to the oath taken to uphold the Constitution … The Main Stream Media is very Orwellian in exactly the big brother way…

Has Ron weighed in on this issue? He has proposed ending 'birthright citizenship' for illegal immigrants, and although the two situations are different, I'd like to know where he stands.
I think we are all missing the point here.
The fact (if it is indeed a fact that such a bill exists) that a bill is needed at all to make McInsane eligible should be the point. If a bill is needed, it proves what others on here have been saying all along. That McInsane is, in fact, ineligible at this point. If such a bill exists, I guarantee you no lesss than 20 lawyers have looked over both the bill and the situation and deemed it necessary.

Let's face it, "natural born" is hapax legomenon in the american legal coda. The Ninth Amendment reminds us that the spirit of the constitution is in the event of doubt, to not be restrictive except in the power of the government, not to the individual. Congress sets the rules for citizenship through 14th amendment and USC 1401 clearly states that McCain was born a citizen. You can argue till you're blue in the face about how citizenship conferred by code is "naturalized" and therefore "natural", but except for USC 1403 (which due to the primacy of 1401 does not apply to McCain anyway) there is no mention of naturalized birth, and there is certainly no mention of 'natural born' anywhere except the constitution; much less anything saying that codified birth cannot be natural birth. Everything else is interpretative inference, which is what constitutionalists rail against.
Let's get rid of McCain the right way, not through gimmickery. That way we win because our ideas are better.

Now, as for the topic. Typical of them to just wave their magical legislative wand and demand that we ignore the Constitution. Sorry folks, homey don't play that!
Ex Post Facto Law?
According to Wikipedia, the legislation proposed by Claire McCaskill falls into the category of an ex post facto law:
"An ex post facto law (from the Latin for 'from something done afterward') or retroactive law, is a law that retroactively changes the legal consequences of acts committed or the legal status of facts [emphasis added] and relationships that existed prior to the enactment of the law. Conversely, a form of ex post facto law commonly known as an amnesty law [emphasis added] may decriminalize certain acts or alleviate possible punishments (for example by replacing the death sentence with life-long imprisonment) retroactively."
It seems that Obama Supporters such as McCaskill also support McCain as Obama's opponent. Why would that be? Simply in the interest of a "fair fight", or could it be construed that Obama and his supporters PREFER to have McCain as an apparently-strong (but, in fact fairly weak) opponent?

But wouldn't USC 1403 (a) which is used by the mccain ineligibility arguments also be, in a way, an ex post facto law?
It says all individuals born before [date of passage] are now considered "naturalized".
Not supporting the 1403 argument anyways (1401 supercedes it), but jus' sayin.

Just wrote a polite e-mail asking her to rethink her position regarding senator McCain's elgibility to run for president. I also suggest that we phone her D.C. office and help her see things in a constitutional light.

write her at least once a week. just make sure you're professional with what you say. don't accuse her of anything. just state that you do not agree with such a bill.
also be careful with how much you contact her. it can be considered harassment by the Dept of Homeland Security. i think it was just last year they arrested a man for contacting the VA "too much." he never made any threats. he just called them all the time bitching about how they were screwing him over. i don't know all the details, but we all know what kind of a Nazi government we have at this time.

The New Republic smear on Paul before NH on an unrelated guilt by association is abusive of the privilege extended by the 1st amendment. Being a propaganda engine is NOT freedom of the press.. McCain won NH in 2000 by 18% of the vote in 2008 by 5%.. NOT REPORTED. Paul's New Republic smear moved him out of a front runner status.. This should not happen
Claire McCaskill is my Senator and I can't believe that she would even consider a Constitutional amendment addressing this issue. This is a matter for the US courts, not the Congress.
One example, a child is born to parents that are stationed in Iraq or any other middle eastern country. The child grows up in the Iraqi culture and around Iraqi children. What if some of these children have parents that are insurgents or disidents? Could this child not possible be influenced by his or her sympathy for their peers?
When you are a child, you are like a sponge and whatever is around you affects what your beliefs are and what type of person you grow up to be. The US Constitution was written for a reason and it amazes me to see that our forefathers so long ago could possibly have known what would happen when our government did NOT follow their document. Exactly what is happening right now, the demise of our freedoms and liberties and the economic death of our country.
Congress and Claire should keep their noses OUT of the Constitution and let the courts decide and I will personally call her office tomorrow and tell her so. I will also tell her that after campaigning for her when she was elected to the Senate that I am appauled because she is a Senator for the State of Missouri and NOT supposed to be wasting her time campaigning for Obama. She just lost my support and my respect.

What I mean is I think this whole McCain thing is a ruse that will allow the puppet masters to slip something in that would allow anyone who has held a state or federal job and was elected by the people to run for President. That includes Arnold. Something like that anyway. And to all those that say there is no way this would ever happen, do you really believe that. How many things have happened in the last 8 to 16 years that before people would have said would never happen.
