Is John McCain LEGALLY on Ohio Ballot?

I was reading about Wolf Blitzer's March 2nd interview with Howard Dean and discovered this comment by Dean:

Dean: “…Look, John McCain is a flawed candidate. Here’s a guy who is a typical situational ethicist, he runs on his integrity, but he doesn’t seem to have any. We’re familiar with the fact that he got on the ballot in Ohio with what now turns out to be false pretenses. He qualified because he was taking public financing, and now he says he’s not going to. [Emphasis added.] He doesn’t have the permission of the FEC to do that, and just this week he refused to denounce and reject John Hagee, a militant, anti-Catholic right wing pastor and John McCain has a history of doing what it takes regardless of what the ethics of this are. I think he’s going to be a flawed candidate, I don’t think people want four more years of what is essentially four more years of George Bush.”

Is this true?

I contacted Maryanne at Ohio4RonPaul.com. She said:

"Yes, we know about it. We were all contacting the SOS in Ohio last week.

In a nutshell, this is what is happening.

John McCain entered ballot access in Ohio by declaring he would apply for matching funds. He then presented his list of delegates to the SOS and he was on the ballot.

Every other candidate, none of whom were applying for matching funds, had to collect 150 valid signatures ( no more than 300) from republican or unaffiliated voters for the slate of delegates in each of the 18 congressional districts and an additional 1000 valid signatures ( no more than 3000) across the state for the at large delegates.

John McCain didn't have to do that. He then went to the FEC and told them he wasn't going to use matching funds. ??? Hmmm...he didn't get signatures to get on the ballot in Ohio, isn't that a default?

Problem: The FEC needs a quorum to make a decision. The FEC only has two sitting members right now. The Senate has held up the vote on the three appointees the president made. This has been going on for upwards of 2 years right now. The FEC is supposed to have 6 members on the commission, evenly divided between the two parties. They need 4 to make a decision. Harry Reid ( D-Nevada) sets the agenda for the Senate. He hasn't scheduled any debate for the appointees. Pretty shoddy for a presidential election year, huh?

The SOS in the State of Ohio can't make a decision without a decision from the FEC.

If the FEC could make a decision, then the SOS in Ohio could make a decision.

Fault: Harry Reid and the Senate for not voting on these appointments.

Fault: None of us know the ins and outs of this enough or otherwise, we all would have been calling Reid and our own Senators demanding they do something with these appointments.

The FEC is a lame duck quite possibly done intentionally so no decisions could be made during a presidential election year.

Hope this clears up the situation. McCain remains on the ballot, quite possibly will do very well in Ohio doing almost 0 campaigning because of his money trouble, because of all his friends in the media. He sent out no campaign literature, he has no signage here but quite possible, he will still do well because we all know he is the front runner, right? (just a joke)

I hear Ohio is having really bad weather. Calling and getting out the Ron Paul vote is crucial. Plus, Ron Paul got on the ballot the honorable way!

Just more facts to be ignored

This just kind of got swept under the rug, the media was busy talking bout him being born in Panama, which is a question. This issue doesn't seem to be a question though. He either used his matching funds status for ballot access or he collected signatures. Might just be another inconvenient factoid that he'd prefer to ignore.

Something to Consider

Just a reminder that as this story develops, voters in Ohio may see it as an attempt to reduce the number of candidates they can vote for, rather than an attempt to treat every candidate equally.

It might be okay to call McCain a cheater, but it won't help to call for his name to come off the ballot tomorrow.

Does anyone know if this state is winner-take-all? Also, is the public vote binding on the delegates or is it just advisory? Did McCain just have to meet the requirements for financing or did he have to use the funds?

Dear Sir/Madam:

I am writing to you about Sen. McCain's situation in Ohio primaries. An article caught my attention that he failed to collect the signatures required to be in the ballot and he backed-out of the FEC financing.

These two conditions, I believe make him inelligible for the state primaries in Ohio.
