Homeschoolers! Read This!

I love living in my native Golden State, but I may have to pack up and move. I have not seen this posted elsewhere on DP today (but this place has been pretty filled up with posts discussing whether RP is dropping out of the race!), so I'm posting it here for all homeschoolers, even those not in California, to read and pay heed to.

California State Appellate Court Says Those Who Teach Children in Private Must Have A Credential

"Parents do not have a constitutional right to home school their children," wrote Justice H. Walter Croskey in a Feb. 28 opinion signed by the two other members of the district court. "Parents who fail to [comply with school enrollment laws] may be subject to a criminal complaint against them, found guilty of an infraction, and subject to imposition of fines or an order to complete a parent education and counseling program."

And this, from the San Francisco Gate:

The decision "not only attacks traditional home-schooling, but also calls into question home-schooling through charter schools and teaching children at home via independent study through public and private schools," said attorney Brad Dacus, president of the Pacific Justice Institute, which represented the school.

Michael Smith, president of the Home School Legal Defense Association, said the ruling would effectively ban home-schooling in the state.

"California is now on the path to being the only state to deny the vast majority of home-schooling parents their fundamental right to teach their own children at home," he said in a statement.

I generally pride myself on my expansive vocabulary, but for this particular instance, the only adjectives suitable to describe how I feel about this decision is best left to your imaginations. Suffice it to say, it is mostly unprintable in gracious company.

Education is under authority of the parent not the state

There is no moral ground whatever for the claim that education is the perogative of the state - or for the claim that it is proper to to expropriate the wealth of some men for the unearned benefit of others.

The doctrine that education should be controlled by the State is consistent with the Nazi or communist theory of government It is not consistent with the American theory of government.

Should education be compulsory and tax supported?

Should the government be permitted to remove children forcibly from their homes, with or without the parents consent and subject the children to educational training and procedures of which the parents may or may not approve?

Seriously, is there any way

Seriously, is there any way this ruling can be challenged? I say we as a Movement need to start flexing our political arm.... what are we waiting for?!

I think I've got

you guys beat. LOL. There are no "requirements" in Mississippi. There is no curriculum. They do not check their progress. There are no yearly tests to show what level they are on. I have to send a letter of intent to the school board every year along with a list of the books that I am using. That's it.

Every bill that was put up in MS regarding homeschool this year in the State House was defeated and never made it out of committee. :D

Move to Texas.... I haven't

Move to Texas.... I haven't found a state that gives parents their Constitutional Right to homeschool their kids as Texas....That's why we're not moving from here anytime soon.... Believe me, I've looked.... :o)

...if my children should happen along through life, and discover something new on their own, and learn from it...

...and there's not a credentialed teacher on hand to point it out to them...

...are they breaking the law?

for that matter, can you even teach your children anything at home legally (afterschooling)?

Is it illegal to sell Leap Frog talking Geography globes in California? My nieces have been "taught" a lot by that thing and I'm pretty sure it doesn't have teaching credentials.

Then I guess too

That's crazy

I home schooled my children in California and it was one of the more liberal home schooling states then. I had to fill out a "private school affadavit" each year but I didn't mind. Nothing ever became of it. I tested my children each year to keep on hand in case someone challenged my abilities. My children tested well over the 90 percentile each year. Charter schools were also another umbrella because they let you do a lot of your own thing.

I know a lot of home schooling families in California. I wonder what will happen with this.

...it may be THE most free state as far as homeschooling goes. The only requirements are that you teach at least 600 hours of reading, language arts, mathematics, social studies, and science per year, with at least 400 of the 600 hours being taught in the home location, and you must keep a log and the kids' work to prove that they're actually schooling..

No registering or even notifying anybody if you don't want to. The law says the parent "may" notify the school superintendent, but is not mandatory.

I'm sorry to hear what's going on in your state. Hope everything works out for the best.

Arkansas homeschool requirements

is that grades 3-9 test on math and reading once a year...that's it! Other than filing the waiver and notice to intent...no big deal....anyway, get enrolled for legal protection wherever you go at: http://www.hslda.org

Other States: For How Long?

Frankly, I am beginning to suspect that no state will soon be safe for homeschooling. Only a few days ago, I was informing someone who was considering homeschooling about how easy it is to homeschool in CA; either through charter or independent study, or even set up your very own private school (R-4) in your own home. She got all excited at the prospects of easily converting her public schooled children into homeschool children! It was all so easy to do this in California! Then, in the blink of an eye...

I sincerely hope I'm wrong, but I do sense this might be the writing on the wall for the rest of the nation soon.

Suck up your hesitations about the HSLDA

and go sign their petition to depublish the court's findings. It takes 10 seconds. Depublishing prevents the case from being cited in other California courts.
