most of the amicus curiae briefs, even from some liberal groups, submit that the 2nd amendment is an individual right, and it's likely that the court will finally clarify the amendment as being an individual right. In fact, if you read the case carefully, the DC (anti-handgun) position acknowledges the individual right to bear arms, but that there also is a reasonable local government duty to determine at what point bearing arms is too unsafe to be allowed anymore (remember, even under free speech you cannot yell "fire" in a crowded theater, and it's up to local government to decide what those limits are) -- keeping in mind that the DC government DOES allow rifles and shotguns in the house, and no government allows an individual to possess a tank, or a hellfire missile, under the 2nd amendment.
So the court could rule in favor of DC and in favor of allowing it to restrict handguns while still resolving the ambiguity of the 2nd amendment as an individual right.
Unfortunately, circumstances now might cause them to chicken out
If, with the current meltdown, the Court rules RKBA is personal instead of militia, then they just sowed the seeds of the next revolution...
No they won't...
They'll LABEL it as an "individual right" but WITHIN THE CONTEXT of a "government organized militia" or some other similar mealy-mouthed weasel ambiguity.
Or they will avoid all of that altogether and state that DC is an "exception" and is NOT governed by the 2nd Amendment because of it's "special status" as a legal non-sovereign district.

There is no way I would allow anyone to take my guns without having a stand off in my front yard. I'm not a hunter and I've rarely ever used them I just keep them for personal security and they were given to me by my father and my uncle after they passed but I would never give them up to any legislation. You only have one recourse against tyranny and that is self defense.

On March 18th the Supreme Court is scheduled to hear the oral arguments regarding the case "District of Columbia v. Heller" and is expected to publish their decision in summer of 2008. Anyone not familiar with this case should read up on it at http://en.wikipedia.org/w...
Fortunately there are at least 31 States which are in favor of the respondent (meaning they are in favor of the second amendment, basically, and our right to keep and bear arms.). In addition to that, the State of Montana has filed some type of legal document stating that an unfavorable decision in this case would violate its compact with the United States. Basically, they are saying that the United States would be in breach of contract. I don't believe this is stated anywhere, but it seems that Montana is possibly considering a secession due to breach of contract if the Supreme Court rules in favor of the petitioner (D.C.). Ridiculous argument...
The whole reason the Bill of Rights was even written was that the states wouldn't ratify the Constitution without the INDIVIDUAL being protected. If those self-righteous justices have ever studied history in even an arbitrary way that fact should be obvious as it is contained in many writings of the day. The whole argument that it is a collective right is fairy ridiculous if you ask me. First they decide that it is a collective right... then they decide that the National Guard is a militia... the slippery slope in action... Beings that by executive order the President can now declare a state of emergency that can not be reviewed by congress for 6 months and take direct control of the National Guard without the permission of the governor frankly scares the crap out of me. If they come down on the side of this being a collective right I wouldn't be suprised if they quickly find out the true meaning of the second amendment. I'll see you there.

SCOTUS is only hearing arguments this week. Ruling is expected in June.
BTW, this is long overdue. There have been conflicting district rulings on the issue (Emmerson ruled on the People RKBA, as did DC, but the 9th did the militia argument), so maybe they'll finally grow a pair and make a ruling broad enough to put to rest the milita argument, overturn Miller, all the NFAs, the Brady BIll, and the rest of that garbage. I'm not holding my breath on that, though. SCOTUS is rarely that smart.
