Governor sends clarification to Homeland Security over Real ID

HELENA (AP) — Gov. Brian Schweitzer sent a letter to Homeland Security officials this week assuring them that he agrees with the state attorney general about making Montana driver’s licenses more secure even though he opposes the federal Real ID program.
The governor’s staff said the letter was not a conciliatory gesture, nor should it be construed as a change in the governor’s stance on the Real ID program.
Montana officials have been adamant that they can not comply with Real ID because the Legislature last year banned any compliance.
Schweitzer declared victory last week after Attorney General Mike McGrath sent Homeland Security a letter saying state officials would not comply with Real ID. That letter also noted the steps Montana has already taken, and will take, to strengthen security of its driver’s licenses.
Homeland Security responded, saying they viewed that letter as a request for an extension, and would consider Montana among the states complying with Real ID. The agency was seeking such an extension request from all the states along with a promise to implement Real ID in the future.
Schweitzer described McGrath’s letter as just a way to give bureaucrats “some piece of paper.” Schweitzer, at the time, said DHS had “painted themselves in a corner” and was backing down.
Homeland Security then sought assurances from Schweitzer that he supported the security measures outlined in McGrath’s letter.
In Schweitzer’s Monday letter, addressed to Homeland Security Director Michael Chertoff, the governor said “I recognize the question that some recent press coverage might have raised, but I can assure you I stand behind the Attorney General’s letter in its entirety.”
Homeland Security said it is simply interested in results. The agency says the security steps McGrath and Schweitzer outline will indeed clear the first hurdles of Real ID.
“We care about results, not sound bites, labels or interpretations on whether someone said uncle,” said Homeland Security spokesman Russ Knocke. “We’re pleased that Montana is on the road to more secure licenses. That’s what matters for Montanans, and for the rest of the country.”
McGrath’s letter says the state has done things to make it harder for people to fraudulently get a driver’s licenses. More steps are coming, such as plans to unveil an enhanced card with three levels of security — including a new data management system that predates Real ID.
The attorney general’s office said Tuesday that the federal government would not be given a copy of the database, one of the larger concerns state lawmakers held last year when they rejected the federal plan.

It seems as if this is a very vague assertion at best. I hope the states see that past the whole "security" bullcrap and stand up for themselves. Its really a sign of personal weakness to relent and give in to such a thing.

There is no, "no compliance". It does not matter what you say or what your position is you will and/or have already complied. Any statements made writen or verbal will be construed as a messure of compliance. Compliance is ubiquitous. Your words mean nothing.

It's not about security features
like some hologram or magnetic strip. The issue here is the federal government keeping us all in a database and tracking our movements as we travel and conduct personal business. Counterfeiting prevention measures on the actual Montana drivers' licenses is not what is being debated. The governor did stand up for his statesmen because he refused to turn over the information to the federal government. Also, their legislature passed a law that forbids the state from complying with these federal intrusions.
Please, let's all try to be more reasonable about this.

CONCORD, N.H. -- New Hampshire and four other states, including Maine, face a critical deadline this month regarding the federal REAL ID program that could determine whether state residents have a more difficult time flying.March 31 is the last day for states to ask for extra time to comply with the new federal rules. The post-Sept. 11 security measure would create a tamperproof identification card in all 50 states.The program is designed to ensure that the government knows who is traveling through the nation's airports. But critics said it's akin to Big Brother, and New Hampshire should continue to oppose it.State lawmakers are pushing a bill ordering Gov. John Lynch to ask for a time extension. If REAL ID becomes law and the state does nothing, Granite Staters will face greater difficulties traveling through airports starting May 11. Officials said they should have a valid passport or military ID, and if they don't, they will face a secondary security check and will have their carry-on luggage searched."New Hampshire travelers will be inconvenienced -- those without passports, which is probably a reasonable percentage of the traveling public," said state Sen. Harold Janeway.Under REAL ID, states must meet certain requirements for driver's licenses, such as include a name, picture, signature, Social Security number and more. New Hampshire already does that, but the state doesn't keep license data on file, accessible by the federal government.New Hampshire lawmakers recently voted against REAL ID but are now pushing for a time extension. "Do I have the right to travel without being tracked?"State officials said an announcement about a time extension is expected any day.
