Republican presumptive nominee John McCain has ignored official campaign expenditure limits and has overspent millions in the primary.
According to spending reports filed last week by McCain's campaign, the Arizona senator has broken the limits set by the presidential public financing system.
Candidates such as McCain, who have committed to public financing, are only allowed to spend up to $54 million on the primary. McCain, however, spent $58.4 million.
This is while lawyers of the 71-year-old senator contend that the spending cap does not apply in the current situation.
They allege since the Republican hopeful announced after February 6's Super Tuesday victories that he would withdraw from the matching-funds program he had entered last year, the spending cap does not apply to him.
'The FEC regulations specifically state that candidates who do not receive public funding payments from the US Treasury are exempt from the primary spending ceiling,' expounded one of his senior campaign officials.
Chairman of the commission David Mason, however, warned McCain last month that his withdrawal request had not yet been granted.
' McCain has 2 problems with this issue.
1: If the FEC allows Mccain to withdraw from FED matching funds he will be revoked from many delegates in states that he was able to be on the ballot without the required number of signatures therefore he will lose any delegates for him in those states.
2: If the FEC doesn't release him from matching funds he will be capped at 50 million dollars and will kill his run for president because he will not have the money to compete.
The problem is even more complicated than this. McCain used the matching funds eligibility to avoid having to collect signatures to qualify for ballot access in several states, including Ohio, Pennsylvania and Delaware.
Those state wins must be voided according to most experts on the issue. That means he does not have the necessary delegates.
Ironic that it was his law (McCain-Feingold) that got him in this mess.

I was one of the people that have addressed this and did so on record on the radio.
You people can not wait for the FEC to rule on this.
The delegates in these states need to file the motion at their conventions for Mccain to be revoked of all his delegates in those states for failure to comply with election ballot state law requirements.
Find out if your state allowed Mccain to be on the ballot without obtaining petition signtures.

Every state different
Missouri just requires a filing fee.
Being eligible for federal funding does not mean you have to take it. Some states require that you be eligible for federal funding. RP qualified for federal funding, but chose not to apply. He very well got on the ballot in those states because he was eligible.
According to some
The United States is a corporation (read some of the other posts on DP). If that is true then the FEC is part of the corporation which means that John McCain broke a contract and not a law since he was actually agreeing with a corporation. Therefore the corporation is the only one that could bring legal proceedings in civil court since technically no crime was committed, just a broken contract.
I'm not sure taking the red pill was the right choice. Ingnorance really is bliss.

I believe the applicable law is public law number 107-155; The Campaign Reform Act aka The McCain-Feingold Act.
It is no contract, it is federal law as approved by congress and signed into law by the President.

I could care less about the Republican party, but gheesh! How can they keep propping this guy up? He's an embarrassment.

If the FEC is basically closed for business (until new directors are appointed) and unable to formally charge McCain for violating (his own) federal law, then can another party prosecute based on violation of the FEC law?
Is the FEC the only organization that can do anything?
McCain broke the law, so shouldn't some prosecutor somewhere be filing charges against him?
Or maybe an individual citizen who has the funds could launch a lawsuit against McCain based on his violation of federal election laws?

Anyone in Idaho should definitely be filing complaints about this. McCain got on the ballot without the petitions because of taking federal matching funds. Now that he wants out of the federal program he should not have the benefit of remaining on any ballots which he did not have the required number of petition signatures for.

I have heard that the FEC cannot raise a quorum to hold an official meeting because the Senate has failed to appoint new Commissioners to fill 4 vacancies on a 6-member panel. Until this is done, complaints will go nowhere. The Senate needs to fill these vacancies immediately! Otherwise there is effectively NO NATIONAL OVERSIGHT over the 2008 election. Where Would One Start
to find out whether McCain was on a state's ballot without obtaining petition signatures? I know I can spend the next hour or so looking this up on my own, but does anyone know the answer outright?
Petition signatures not required in all states
California for one. Here's how I found out: go to your state's official website, find the Secretary of State's page, and pick out something like "Summary of Qualifications and Requirements for President of the United States" In California, candidates simply need to be "generally recognized candidates" in the judgment of the Secretary of State. McCain will not be losing his California delegates over this issue. Unfortunately.

I really think Ron Paul's strategy is to lay low for awhile and let mccain be his own downfall. Mccain is so hated and so dislikeable and such a stiff... no way is he gonna make it all the way to the convention. No way!
