Okay to lay some ground work we have a guy running for senate and I have been communicating with him.
I talked to him and I thought he was pretty up in arms over all the liberties we have been losing. THEN I listened to him debate our former governor who he is running against and he stated that he thought the patriot act actually was a good thing and persevered our liberties...HELLO !!
So I e-mailed him about it.

It is good to hear from you. Regarding the Patriot Act and Habeas Corpus, maybe I am wrong, but I do not think it gets rid of Habeas Corpus for Americans. The Patriot Act has done very well on spying on foreigners outside our borders and, since these foreigners are not U.S. citizens and are enemy combatants, I am for this Act. I do not believe an enemy combatant who is held at Guantanamo Bay.
Which Constitutional Rights do you feel this Act restricts? It may not be a perfect law but was voted in at 99-1. The U.S. Senate had almost a unanimous vote and I doubt they were totally wrong on this vote?

Its very simple
a bank account is just a number, what the government wants to do is track the individuals. To track individuals they need personal information and the government thinks the bigger they can make computers the more rights they have to track you. Its the just because we can look into every aspect of you life we should have the right to do it. Its a lie when they say we are just going after any boggy man they say because it just gives them the freedom to look. Wake up, read the constitution, The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized. Papers means that the government must have probable cause and get a warrant before a judge before any search is done. We the people must demand that our bank records are private. Be fucking real, the 9/11 guys did not have a us bank account, but I am sure everyone that donated to Ron Paul is on a list.

The Patriot Act breaches the First Amendment, which declares our rights to freedom expression, speech and information.
Would you mind if another country secretly kidnapped you and put you in a prison with no access to a lawyer with occasional torture to get
you to confess even if there was no crime committed. No innocent until proven guilty clause.
I can't help but to think of Mexico and their corrupt justice system when I think of the Patriot Act. We all have
memories of hearing about people being thrown in jail in Mexico and how it was impossible to get them a fair trial.
Is this the image we want to project for the United States ?
Most bills are not even read before they are voted on..I think you would be quite shocked to find out how Washington really works.
The Patriot Act was only read by two senators and both of the senators that actually took the time to read it voted against it.
The house of representatives where given 15 minutes to review the Patriot Act and not one congressman read it,
let alone if they did read it they could not have possibly understood it within 15 minutes.

This list could go on and on..but I think by now you should be getting the
picture that the Patriot Act is most definitely used against American Citizens, in fact by early 2006 there
where 9,254 instances where it was used on US Citizens and the FBI have been accused of under reporting.
The Patriot Act violates the 4th amendment most of all and authorizes sneak and peek.
Now what is even more alarming is the " Homegrown Terrorist Act" HR 1955 and S1959 that is directed directly at US Citizens and not foreigners hence
the "Homegrown" in the title.
Combine that with the Patriot Act and it would be disastrous for this country and our freedoms. I don't know about
you but I would like to be able to face my accusers and have the ability to go before a judge and have a trial before my peers.

Now I could go on about how the Patriot Act is an affront to our constitutional rights but I want to refer you to people I think are more
capable of explaining the dangers of the Patriot Act and have better credentials than I do. ;-)
First off...Judge Andrew Napolitano who is the senior judicial analyst on Fox News and prior to that
was a superior court judge in New Jersey from 1987 through 1995. I could go on about his experience but I will
leave it up to you if you decide to research his background further.
This video of Judge Napolitano is a must watch but if you are short on time and want to skip ahead to the part
where he discusses the Patriot Act. It is at 21:00 minutes into the video where he addresses it, but I would suggest to fully
understand the implications of the patriot act you should watch the entire video.

But foremost I'm a conservative life long republican.
I spent the Clinton years writing my congressmen and spent many hours worrying about what the Clintons where doing to undermine our country.

A few things to bring up
It was not read by the senators before passing it. This is well documented.
It violates the 4th amendment most of all and authorizes sneak and peek. The act has been used on Americans citizens more than it has foreign intelligence. You can find some statistics I am sure that spell out that it is used more on American citizens than on "terrorists".
It also allows the DHS or any member of the DHS to search voicemail without a having to follow wiretap laws.
It allows nationwide jurisdiction for courts, so a court from a remote state can issue a warrant making it difficult for the defendant to even be able to appear before the issuing court (example: a California business gets a warrant issued from New York).
The definition for "terrorist" in the patriot act is very generalized and can be applied to almost anyone or any group.
It can be used to indefinitely hold anyone who is not a natural US citizen (i.e.: legal immigrant) even with little or no evidence.
Because the patriot act allows data snooping on any data sent through the United States, even beyond the control of service providers (international communications hubs), it violates all other nations sovereignty (because even if that country passes legislation banning the U.S. from snooping it's data, the Patriot Act is supposed to supersede their law). This has been an especially big issue for Canada, as there is a lot of data communication between Canada and the US and the patriot act allows the DHS to even snoop on Canadian citizen's medical and other private records.

In an interview with Rep. Ron Paul (R-TX), The Beacon has uncovered at least one Congressman that admits that Congress sometimes passes unconstitutional laws. Furthermore, Congressmen know that these laws are unconstitutional at the time that the bills are passed. In addition, Rep. Paul revealed that laws are sometimes passed without the bills being available for reading and that often bills are passed on a "voice vote" (not a roll call vote) so that people back home will not know how a specific Congressman voted.
A recent example cited by Rep. Paul is the USA Patriot Act. This bill violates several constitutional protections and defines a "terrorist" as anyone who opposes a federal government program or policy. According to Rep. Paul, this means that a person who differs with the government on issues such as abortion, gun control laws, Free Trade Agreements, the United Nations, or any number of programs and activities could be defined as a terrorist and investigated by the government even though no crime is committed. The USA Patriot Act also gives the government the authority to establish a National ID Card for tracking and surveillance.

Another example cited by Rep. Paul is the recently passed Campaign Finance Reform Bill. "Many Congressmen are now saying that they know it is unconstitutional but that is up to the courts. That, to me, is one of the most despicable arguments I've ever heard", said Rep. Paul. "What's the sense of taking an oath of office if you're going to pass things that are unconstitutional and hope the courts will save you from yourself", Rep. Paul continued.
Rep. Paul also pointed out that the United States is currently in a war and invading foreign countries. The only constitutional provision for declaring war rests with Congress. Yet, Congress has not declared a war and refuses to challenge our government's current activities on constitutional grounds or support President Bush by declaring a war.
"What bothers me the most is that there is an assumption in the media that the President can declare war. We should know who the enemy is and what are the objectives, but the media does not ask these questions", stated Rep. Paul.

Also, ask him if he knows that AMERICANS can be declared enemy combatants which means that HIS OWN country could secretly kidnap him, declare him an enemy combatant, and not allow him any trial. Also, ask him if he is familiar with the whistleblower that made public a secret room by the government to monitor AMERICAN CITIZEN'S Internet traffic at AT&T's central office on Folsom Street in San Francisco in 2006.
