Ron Paul Delegates Forced out of Republican Convention

At the Nueces County Republican party convention, March 29th, in Corpus Christ Texas, Ron Paul supporters walked out in protest and held their own emergency convention in the parking lot. Republican party Chairperson Mike Bertuzzi grossly violated party rules by announcing new delegates to the morning’s roll call who were never elected as precinct delegates on the night of the Republican primary, then again by ignoring repeated objections by party delegates, which he is required to recognize.

Mr. Bertuzzi claims that he avoided a ‘party takeover’ by unruly Ron Paul supporters, but a recently released audio tape of the event clearly shows otherwise. As a blatant violation of convention rules is underway by the Chairperson, many delegates can be heard rising to voice objections with no avail until a local man, Paul Hunt , is escorted out by the Sergeant at Arms.

listening to this over and over today

checking it against Roberts Rule and it seems to me that have at minimum a chance to appeal the motion. Not that I think it will do any good but it is a legal challenge.

I also think we should keep this bumped because as other states work on their delegates our RP delagates should know.

And if we are working to get as many RP delegates as possible, what are we doing to take McCain down. Of course in any manner that is technically, legally and professionally as possible. We have to remember our actions will reflect on Ron Paul and the revolution.

GOP Rule 38 Unit Rule

No delegate or alternate delegate shall be bound by any attempt of any state or congressional district to impose the unit rule.

Roberts Rule of Order - 10th addition

"Prior to or during a convention, members of a delagation may need or wish to meet as a group to decide how they will act with reference to certain matters to come before the convention; a meeting of this kind is usually called a caucus. Unless such a caucus is so large that it is governed by the rules of procedure applicable to committees (50), since the delegation is in effect a committee to represent and act at the convention for the constituent society or unit that chose it....

As in the case of any committee, in the absence of a superior rule to the contrary a constituent society or unit can instruct it's delegation, although this is not always a good practice in ordinary societies. Such instructions are binding, upon the delegation to the extent that the conventions presiding officer and other officials should enforce instructions of which they have been properly and officially notified. Such instructions, for example, frequently require a delegation to take a position for or against a measure expected to come before the convention, or to vote for certain candidates. As stated above, the delegates are free to vote as they see fit except where an instruction has been given; but a society can, by instructing it's delegation, bind it to vote as a unit (that is to cast all of its votes in accord with the decision of the majority of the delegation) on all issues, on a particular class of business, or on certain matters to be acted on by the convention.

My questions are:

If delegates are a committee representing the body that chose it (your state), then instructions on who to vote for are decided by the delegates, not the state body or the national body. This seems like a system that funnels the opinion of the people upwards not the other way around. What is clearly happening is the National Committee is steering the state committee's essentially the county committee's to pick John McCain. This is direct violation of the GOP 38 No delegate or alternate delegate shall be bound by any attempt of any state or congressional district to impose the unit rule.

Secondly, if they can be bound by Roberts Rule, they are not bound until they have received instruction of such - so when and where has this instruction been given? If I am reading this right, the delegates of your state are to caucus and decide that desire, if they desire to bind and what the bound is? Has this formally happened in any of these states?

And if the delegates decided to bind, doesn't rule 38 of the GOP prevent it?

I have since done some further reading and some of what I posted is not technically correct - as Florida is considered a winner take all state (can't seem to find where that is legally), meaning the delegates are bound to the winner of our state's election...

Those of you who are still drinking the GOP Kool-aid, or, even worse, entertaining vainglorious thoughts that we can take away the nomination from McCain---please WAKE UP.

It's not too late to sever this movement from the Republican umbilical cord.
It's not even too late to nominate Ron Paul on a Third Party and get him elected president in November. But the clock is ticking.

The only way he'll be on the ballot this fall is if he's running Third Party or Independent. Going to the convention to educate and promote is a good idea. Going there to take over McCain's delegates? You're going to be disappointed, folks.

Ron Paul is a very modest man. I think he has no expectations of being elected president, and has settled for his congressional seat again. Personally, I think he has no understanding of his importance to this generation of voters.

If you care about him actually being on the ballot in November, please consider the Third Party/Independent option now, and write him and his campaign accordingly.

yeah- Ive yet to hear him say "read my lips" no 3rd party

His mantra seems to be "um naww I really have no intention of doing that ...we're still seeing so much support ...so..." He is a man who would so love to be nominated by the very party he's loved and been faithful to his entire political career and sees the GOP as worth fighting to restore dignity to...but a prophet has no honour in his own land. I see it like this: If a day comes when Ron Paul runs 3rd party- noone can call him a liar-as he never intended for it to come to that.

I googled "Mike Bertuzzi" and got so many disgusting links Im sick. In addition to alot of hipocritical statements made by him in the past about how "govt should be a reflection of the will of the people" etc were Repub websites discussing how various precincts had personally dealt with those nasty "Paulistas". Here is a paste of a typical post by an opposing veiwpoint: "Surprisingly they didn’t get too tough on the Delegates but there were several ballot votes on the resolutions. They lost most biggies but we killed 2 resolutions, one very important to them (declare war before going to war) ..." They must be so proud in SD where they were succsessful in ensuring that the preisident can continue to wage war whenever he damned well feels like it. ..on the link you provided sickened me. Acting as if American citizens are somehow wrong or bad because they're trying to get their voices heard in political races, discrediting Ron Paul as if he was not even running any longer, using 3rd grade bully insults to diminish what we are trying to accomplish, its all so grotesque. I really find it hard to understand why some Americans are so willing to ignore the reality of what they are seeing and doing in favor of this fantasy that "everything is always ok because America is always right and always perfect in every way." Change isn't that difficult, only changing the minds of the stubborn is. It's a long fight ahead, this revolution to restore our liberty and way of life, I'm settled in for this ride though.

Nueces County Republican party convention, only a very corrupt Republican party would officially approve and accept the results.

they convened in Austin and made last minute rule changes. This is what happened in Missouri, and I know there was a GOP meeting in Austin shortly after the Texas Primary to deal with the huge number of Paul delegates.

What good are laws if nobody follows them?

the state chairperson? MN CD6 beat down a motion that passed because it was 'unconstitutional' according to the Republican rules of our state. Look up your rules, and fight back! Robert's Rules, your state's Republican party rules, and your state constitution. Know them, use them.
