Husband gets a ticket for unsigned registration, while putting out Ron Paul signs--Please read and comment!
My husband was just out putting up Ron Paul signs in Lumberton, NC.
Now, I realize it is almost 2:00 in the morning, but please read this and comment. This is the compact version.
He left the house at around 12:00 AM. He was using a stool to put the signs on light poles, due to having signs stolen when we put them in the ground. So a cop in an unmarked car was watching him across the street putting up a sign. When my husband got in the car the cop followed him and pulled him over. When my husband asked why he was being pulled the cop told him,"You were across from a trailer park. Wouldn't you be suspicious of someone riding around with a stool?" Now this cop saw my husband putting up this last sign. My husband saw the cop sitting and watching him. The cop had called in his plates and had gotten his identity. He asked for license and registration, Everything was in order, except my husband's registration card was not signed. So due to not having anything else on him, the cop wrote him a ticket. It is a $145 ticket.
Was this justified? Please comment!

The Real ID in the future, in my opinion, will really be a "Real" ID. By that I mean DNA / biologic identification with DNA ID scanners that will be able to work at a distance...

No the car registration was not signed. Thank you imunplugged for the link. I searched last night, but didn't think to put in the code.
Here is what it says:
(c) Every owner upon receipt of a registration card, shall write his signature thereon with pen and ink in the space provided. Every such registration card shall at all times be carried in the vehicle to which it refers or in the vehicle to which transfer is being effected, as provided by G.S. 20‑64 at the time of its operation, and such registration card shall be displayed upon demand of any peace officer or any officer of the Division: Provided, however, any person charged with failing to so carry such registration card shall not be convicted if he produces in court a registration card theretofore issued to him and valid at the time of his arrest: Provided further, that in case of a transfer of a license plate from one vehicle to another under the provisions of G.S. 20‑72, evidence of application for transfer shall be carried in the vehicle in lieu of the registration card.
I am thankful that he was not shot or tasered.
We talked to a guy who was a magistrate for 20 years or so and he said this will be thrown out of court. Thank you all for responding.

Cops never ask for it in Colorado as far as I've experienced. Just license and insurance because all the registration info is in their database. What a crook.

Now, all you have to do is look up the code, which should be listed on the ticket somewhere.

What state do you live in? I have been studying traffic law for some time, and I have never heard of this. Look at the ticket, there should be a section that gives the specific code that he supposedly violated. Then look for that in the law for your state. If you will let me know this information, I can help you look it up. More than likely there is no code for this. Let me know.

You have not stated yourself if it was signed or not? So if it was signed I would go to court present the signed document and if the cop is there charge him with harassment. And damages for your loss of time going to court and missing work etc.

at least your husband wasn't shot at 50 times. or shocked to death with a taser. so you do have that to be thankful for.
this may be one of those tickets that gives you a few days to correct the problem. not sure how NC works, but i suggest taking it to court. there should be a date on there.

Well, what kind of registration, car registration? There should be no right to ticket someone because of whats not on your registration. Unless your state has some weird law.

of course not, but this isn't some freak incident, this is what the police spend most of their time doing, harassing citizens and generating revenue for the state in the form of fines, they aren't there to protect and serve you, they are there to protect and serve the interests of the state. In my own experiences I have been continuously harassed about a lack of a front license plate on one of my vehicles (the manufacturer of the vehicle simply provides no place to put it, this is not uncommon, maufacturers deliberately do this to make cars more aerodynamic/fuel efficient, and burden of compliance is on the citizen), I got sick of being stopped for it so I looked up the law (which has been on the books since the 1950's) and called the DMV to ask what to do, they told me to put it on the dash, but doing so created vision issues w/the reflection of the plate on the inside of the windshield, so I put it up on the passenger side visor (where it was visible from the outside but no more obstructing to vision than the visor itself when lowered) and told the next cop that pulled me over for it that the written law permitted the front plate to be displayed that way and the DMV confirmed this, so if he didn't like it he could either go look at the one on the back of the vehicle or he could go f**k himself (I'm just sick of being pulled over by these nazi's for no real reason, so sick in fact that when I see a report that one of them has been killed I'm generally glad about the fact that there's one less of them and I didn't have to sacrifice my own life or freedom to make it happen). He was of course incensed that I would question his knowledge of the law (in his mind, he is the law) and that I would have such disrespect for a police officer that I would tell him to f-off right to his face (I make it known to those f-heads that I am not intimidated by their posturing and not happy about having my constitutional rights violated by those sworn to protect them) and he wrote me a big fat $150 a ticket (two actually, he added "obstruction to drivers view" to the list of frivolous charges) which was what I wanted, I was sick of being pulled over and given "warnings", I wanted him to read the law out loud in court and make him look like the ass that he is in front of god and everyone and then he would think twice about pulling me over for it in the future. When my day in court came the judge started out by sayng I was innocent until proven guilty and burden of proof was on the state, the reality was quite different, first the scumbag lied on the stand and claimed it was blocking my view but somehow not visible from the outside/front of the vehicle (beware citiznes of Brookline NH, there is a man walking around your community with a loaded firearm and authorization to use deadly force who claims he cannot see a 12"x6" reflective plate with big bold numbers from 20 feet away, I think his name is officer Magoo), and he convinced the judge that it needed to be on the outside of the vehicle, the prosection provided no evidence to back up the claims of the lying toad (to do so would have meant using the dash-cam footage from the cruiser, which would have shown a vehicle with 2 license plates displayed front and back and no obstruction to the drivers view), the judge refused to even look at the written law, and would not allow me to have the officer read it out loud to the court during my cross- examination. I was of course found guilty on both charges and the officer walked out with a big sense of satisfaction (I was so pissed I waited for him in the parking lot intent on beating his ass good but he saved me from myself by being the coward that he is and not showing his face). Anyway, my point here is that you have no constitutional rights when operating a motor vehicle on public roads (your constitutional right to travel is not applicable), and you have none in court, you also have no right to a fair trial by a jury of your peers, you are not inncoent until proven guilty and burden of proof is not on the state. This is all stuff they make up so the general populace accepts their criminal racket as being a necessary evil (and it makes the jack-booted thugs and pompous-ass judges feel good about what they do, after all, it is for ""public safety"). So if you want to keep your money (and stay out of jail) you need to conduct yourself accordingly when dealing with these criminals...

However having said that the other problem is that you are ignorant of the law.
First of all I would never have gone to court but if I did when they called my name I would have said that I am here about that matter but not state my name.
If they then asked me to state my name for the record I would have said: "I am not the accuser". They would probably insisted that I identify myself which amounts to testifying against yourself something which you can not be compelled to do. (fifth amendment) If you are compelled to do so then that evidence becomes inadmissable in a court of law. So had the judge tried to hold you in contempt for not stating your name by threatining to put you in jail you should have said this: In that case you honor let it be known for the record that I am giving you my name under threat and coercion without granting jurisdiction and without prejudice. At which point the judge would know that when you stated your name it would be held inadmissable under appeal.
You can not be compelled to testify against yourself in a court of law that is you 5th amendment protection but people routinely go in to court and voluntarily testify against themselve when they identify themselves by name and face in person. IDIOTS!

there was more dialogue prior to me inviting him to have intimate relations with himself, he was a total d*ck and I also didn't mention that before he pulled me over he had someone else pulled over on the other side of the road when I went by him, it was in an area that they always sit (where the speed limit drops from 50 to 30) and bust people going through at anything over 35, there's a dangerous intersection there and I never go more than a couple mph over the limit (that day was no exception), I'm already a mile down the road in the 50 mph zone when I see him blasting up from behind me without his lights on going at least 80, through the slow zone and the dangerous intersection WITHOUT his emergency lights on (did I mention this guy sits there all day and hands out $150 tickets to anyone going thru at over 35?), then he tailgates me at highway speeds (50) for about a mile before turning his lights on (he's profiling, young looking guy in a modded sport-compact). his a-hole behavior didn't stop when I was back on the road, he tailgated me all the way to the town line. but the point here isn't what an a-hole the guy is, it's that you're right, I was ignorant, but it was that ignorance that led me to ask the question: why is it that the constitution guarantees certain rights, in this case the right to travel without being detained by law enforcement unless there is probable cause for suspicion of criminal activity, but I cannot enjoy this right when I drive anywhere. finding the answer to that question led to alot of enlightening information and to Ron Paul and this movement (the incident occurred about a year ago, since I have learned much and done everything I can to further the cause and recruit fellow patriots). so it actually was a good thing, and a perfect example of how morally bankrupt the police/dmv/courts are, the whole system is fundamentally un-American, our constitution and common law have been replaced with non-representative non-constitutional government that uses civil law on it's citizens like a blunt object (civil law is based on Roman law, and the spongehead masses think this is "progress") in order to steal even more of our money (it's all quite legal, even if we had constitutional rights you waive them when you sign the drivers license "contract" that they don't tell you you're agreeing to)...

LOL if you don't state your name??? LOL like they'll never find out who you are. yeah right. And how would you end up in court in the first place if they do not know who you are? If you have to goto court you likely already received a ticket so if you do not show up to defend yourself your ticket just goes to collections. You say you never would have gone to court so I guess what? You'd just have pay fine? Or not and it will go to collections and you may possibly be issued a warrant for you arrest. You're doing a lot of talking out of one side of your ass to be calling other people idiots.

I'm with the State Patrol in WY and no where near NC,... but that just sounds bad.
We checked here and there was a city ordinance against posting any signs (in our case, RP signs) without a permit. Might want to check that out since I wouldn't be shocked if they dropped the original citation and brought a bigger violation against him.
that being said. I would fight it.
It isn't a moving violation so it won't go on your record and who knows, you may get a reasonable judge.
A letter of complaint may do some good, but don't look for the cite to be dropped because of a letter.
Another warning; Lots of these guys are very well versed in the law. They may be jerks, but they could very well be within the law. (the very flawed law, bt there nonetheless)

.. it wasn't justified. Your hubby was just putting up political campaign signs and the police critter knew this and was just being petty and vindictive and had to strain credibility to "pin something" on him.
In actuality, it was the police critter who is guilty of a crime. He is literally a goon and a thug. If I had his name I (me) would personally give him a call and ask him why he is being a goon and a thug...
Sign the registration card and go to court.
Seriously, do it and don't listen to any county attorney. They try to collect on these tickets for the county and will try to persuade you to not take it to the judge. Don't buy the lies. The cop probably won't show up anyway.
What is so scary about being across the street from a trailer park with a stool? If anything, he should have been protecting your husband, not harassing him.

I'd guess not though, so I'd fight it/complain.... you don't have anything to lose.... it's not like they'll make it bigger if you try to complain... I'd hesitate though from accusing them of writing it for political reasons... But, there's nothing illegal about putting up the sign...
it's weird because it's kind of the cop's choice about what he thinks is suspicious/wierd, and the stool/putting up a sign might qualify, at least in his mind, but it's still not illegal, so it doesn't make any sense why you got a ticket.
I would fight it/complain and first say, I don't even know why I was given this ticket. I wasn't doing anything illegal. Then just explain the story that your husband was putting up a sign... explain to them everything you told us.

Fight it. Personally i would just pay my attorney the $350 bucks to make it disappear. However, at the risk of assumption I'll say the registration was not confiscated and your husband has signed it now. It is very likely it would be thrown out of court if you showed up with it signed. Do a Google search, key words, -fight traffic ticket. (funny, i did this and my attorney actually showed up in the search)
