Technically, or maybe I should say Constitutionally, Cheney should not even be Vice President. John Kerry should actually be the VP of the United States. Let me back that up by fact:

As per Article II Section 3 of The Constitution of the United States of America: "In every Case, after the Choice of President, the Person having the greatest Number of Votes of the Electors shall be the Vice President."

The way we are Constitutionally supposed to vote for President is that each Elector votes for two people, with at least one not being from the same state as the Elector. Then the votes from all state electors are tallied. Person with the most votes becomes President and person with the second most votes becomes Vice President. That is the way we ought to be holding the Presidential election, as mandated by the Constitution.

Dick Cheney himself, as Vice President, is UNCONSTITUTIONAL!

John, I don't have my pocket Constitution right in front of me, and I'm heading to bed so I'm not going to look it up right now, BUT...

This was changed early on in our country's history. It was quickly discovered that using the top number of votes to choose the President, and then the next higher number of votes choosing the VP, didn't result in a harmonious Executive Branch. A Republican President and a Democratic VP merely ended up in a lot of head-butting. So it was changed with an amendment, although I'm not sure which one (I think 12th Amendment) to set it up such that Pres and VP would run on one ticket.

I just reviewed Amendment

I just reviewed Amendment 12. Voting for President was changed a bit in that, but not to where President and VP run together. Originally we only voted for President, with the person who got the second most votes becoming VP. Amendment 12 changed that to where we vote for President and vote for Vice President separately. So, with #12 in mind, the Constitutional way to vote for President and Vice President is for them to be voted upon separately and not together on a "party ticket."

As far as I can tell, it is not Constitutional for the nominee to choose their running mate. We, or rather the Electors, are still supposed to vote for Vice President out of all the people who are running for the VP position. This is as per Amendment 12.

I suppose this method does prevent in some way the head butting that you describe. This way would likely result in both a President and VP being of the same party while the "choice" of VP still being made by the people.
