Wow. I can hardly believe the good news, out just minutes ago from Texas. Nearly two months after the Texas CPS and Texas Rangers rode onto their farm with tanks and machine guns, held parents at gun point, and kidnapped 400 children, also holding dozens of women hostage claiming they too were children, the Supreme Court of Texas has ruled the raid was ILLEGAL.

turned down the state's request to overturn an lower court's ruling
that that hundreds of FLDS children have been taken into state
custody improperly.
The high court's ruling comes a week after the Third Court of
Appeals ruled that some if not all of the more than 450 children in
state custody should be returned home to the Fundamentalist Church
of Jesus Christ of Latter Day Saints' ranch in West Texas.
The children were taken into state custody during an early April
raid on the YFZ Ranch, based on the state's contention that all were
at risk of sexual and physical abuse due to the sect's practice of
polygamy.
The children are in foster care or shelters scattered about the
state. Those 12 months and younger can have their nursing mothers
with them, and some have been reunited with their families but
remain in the state's care.
The raid was authorized by 51st District Judge Barbara Walther
in San Angelo, who also ruled after two days of hearings that the
children should remain in custody. The appeals court found last week
that Walther lacked sufficient evidence to support the state's
claims that all of the FLDS children were at risk.

SAN ANGELO — As custody status hearings unfolded
concerning more than 400 children taken from a
polygamist sect’s ranch, a spokesman for the sect said
he heard state workers were on the way to the property
to search for more youngsters.

"We hear that CPS (Child Protective Services) is on
the way to the ranch to search for additional
children. These people never give up," said Rod
Parker, spokesman for the Fundamentalist Church of
Jesus Christ of Latter Day Saints, after a rush of
media vehicles left the courtroom parking lot and
headed toward the ranch near Eldorado.

Parker said he didn’t know of any additional children
at the ranch. A CPS spokesman didn’t have an immediate
comment.

The development came after more proceedings in which
more "girls" taken into custody by Texas Child
Protective Services convinced the agency they are
really adults, for a total of 10.

(Updated 5-3-08) The Official Bishop's List of families residing at YFZ Ranch has been released. I hate that the courts would release such personal information, but it actually helps the FLDS people. Here's why: CPS testified under oath that "every" household in YFZ had wives who are under 18 years old. Bzzzzt. Try again, CPS. The Official Bishop's list of families, stolen from the temple by Texas Rangers, and entered into evidence, shows that out of 35 households, 8 of them have wives under 18. From a quick glance at the 45-page listing, it appears that four of those are married to men in their 20s, one to a man who is 35, two to men in their teens. Hardly the picture that is painted when the media talks about old men forcing little girls into marriage. Also, get this: the official household rosters show (gasp) tons of teenage girls and boys living at home with mom(s) and dad! What? Not married off at 14 like the media wants us to think????     I've been having an email debate with a lawyer friend of mine about this whole business, and here is my latest email to him:

    Texas Authorities Cancel Warrant For Man Accused of Abusing FLDS Girl

    AMARILLO, Texas -- Texas authorities have canceled the arrest warrant for the Arizona man who had been suspected of physically and sexually abusing a teenage girl -- allegations that launched last month's raid on an FLDS ranch in Eldorado.

    Law enforcement did not find the teenage girl or Barlow at the YFZ Ranch, owned by the polygamous Fundamentalist Church of Jesus Christ of Latter Day Saints.

    The man named in the warrant, Dale E. Barlow, was never arrested and denied knowing the girl. Officials have not located or idenified her.
    A spokesman for the Texas Department of Safety said he could not elaborate on why the warrant was canceled.
    "The bottom line is the warrant is no longer active," said Tom Vinger.

    Vinger said he did not know when the cancellation occurred. He would not comment on whether the cancellation confirms the girl's calls for help were a hoax.
    "We're still investigating that," he said.

    The warrant had alleged a 16-year-old girl called a San Angelo family violence shelter to report she was married to Barlow, 50, and he was abusing her. The allegations were the basis for a search and arrest warrant executed April 3 on the FLDS ranch.

    Two weeks later, Texas authorities announced they were investigating a Colorado Springs, Colo., woman suspected of making the phone calls claiming abuse. The woman has no known connection to the FLDS and a history of making phone calls falsely claiming abuse.

    But once on the ranch, authorities said, child welfare workers found children who were abused or at risk for abuse, and more than 460 children were taken into custody. They are now in state facilities throughout Texas.

    Rod Parker, a Salt Lake City attorney representing the FLDS, said, "The cancellation of this warrant is just one more piece of evidence that this call was a hoax and the state of Texas did not properly check this out before they raided the ranch."

    Parker acknowledged the cancellation of the warrant would have little legal significance to the childrens' pending custody cases.

    Barlow had denied knowing the girl or having visited Texas in 30 years. He continued living at his home in Colorado City, Ariz. Texas Rangers traveled to St. George to interview Barlow but did not arrest him.

    SOOOooo, it now appears that more than 450 children have been ripped from their homes and placed into foster care based on NOT EVEN ONE ALLEGATION AGAINST ANYBODY FROM ANYBODY! Now I'm no FLDS apologist, but to say I'm having a bit of trouble with how this thing was handled and is playing out would be a vast understatement. Now there are more than 450 children who are being distributed into the foster care system and not a single charge has been levied against a single adult to justify it. I can't help but think that the professional foster parents must be absolutely drooling at the prospect of this windfall. But wait! There AREN'T any professional foster families who do it for the money, are there? And of course, children are ALWAYS better off in the foster care system than with their own families, especially if it can be ASSUMED that they are being abused by their parents (emphasis on the "assumed"). IF there were foster parents who were in it for the money, they of course would never maltreat their charges. AND...are we to assume that the foster care system is prepared to handle a sudden influx of more than 450 children? That there are hundreds of folks just waiting around just overflowing with love and open arms to receive these poor kids into their homes? Just how competent is government in these areas (see Katrina)? What are the untold stories here? Just how are they finding the incredible numbers of families to take these children in? When they herded all these children into the stadium to live, did they do it better than they did in New Orleans? Now I will be the first to admit that I have not read either of the books that you mention, but I'm wondering if entire communities should be raided and families destroyed based on such things alone. I'm also wondering if it wouldn't have been better for all concerned if they just went in there and shot everybody. It's a tactic that has worked out for them in the past. I'm also wondering if, based on the same reasoning, an invasion of the state of Utah might be appropriate. I guess I shouldn't be too surprised at this. After all, we live in a culture where every state in the union not just tolerates but seems to condone the very public and continued sodomization of young boys by the Catholic church.

    The media is getting a lot of $ out of this. Sensationalism sells better than the truth. "News" has for a long time, been just that. Might as well watch a soap opera with a few real names added in.

    Media

    MSNBC and CNN have done a few very good, even sympathetic stories, on this issue. For newspaper, the Salt Lake Tribune has been setting the gold standard on coverage (www.sltrib.com) with both their news and their blog by Brooke Adams, who covers the polygamy beat. The Deseret News has done a decent job, too, though there is slight bias against the FLDS that creeps into their stories, likely because they are owned by the LDS church (www.desnews.com).

    The local media in Texas started out very much supportive of the raid. TV news still seems to be that way. But a few newspaper reporters in Texas are beginning to see the light. However, numerous, VERY bigoted editorials and cartoons have appeared in major Texas papers, as Texas can't stand the thought of people different than them living in their midst, apparently.

    I love your blog, http://fldsview.blogspot..... In fact, I send posts from it to everyone I know. I am so glad you write it every day and keep us posted with your thoughts.

    I, too, am cheered by the support the Ron Paul crowd has shown in support of the FLDS people. I am LDS, not FLDS, but I love the FLDS as my brothers and sisters, and I know they are Saints in the truest sense of the word, and I advocate tirelessly for them in the wake of this awful thing which Texas has done.

    Thanks again, Allen, for your blog and for your efforts. I love your Ron Paul articles, too, by the way.

    The 5 degrees of FLDS-to-RP Support

    I'm neither FLDS or LDS; in fact, I take issue with many LDS beliefs. But that is entirely beside the point. As an American, I am shocked and sickened by the atrocities carried out in this whole debacle.

    I am also shocked and stunned that there are those who view this topic as unrelated to the quest for getting RP into office:

    Step 1 - Spread the truth about this terrible FLDS injustice
    Step 2 - Point out similarities between these events and other, legally authorized injustices, and how those affect other populations of Americans
    Step 3 - Reveal InSane's support for unjust and unconstitutional actions
    Step 4 - Contrast with RP's fully constitutional stands and principles
    Step 5 - Convert to RP supporter!

    It is human nature to not change until things get "bad enough." As people wake up to the horrific injustices with the FLDS situation, recognize similar injustices that affect THEM personally, and see that InSane represents more of the same -- then they might be finally ready to discover that the "wacko longshot" candidate had it right all along.

    I've learned to archive these discussions, as they are proving to be *valuable tools* for converting people to RP. I therefore want this information to remain available, unlike some who don't see the issue's relationship to RP so clearly.

    people who have become Ron Paul supporters directly because of this FLDS issue. One of them posted on here a few days ago. A few others I know of offline. People are waking up to the way the Constitution is being trampled and spit upon right now in Texas, and it is leading them to this Revolution.

    Of course lets not forget that the bible does not expressly forbid child rape (quite the contrary) many verses encourage child rape.

    Hardcore fundamentelists should be kept under constant supervision by the feds, Groups like the FLDS as well as the backwoods snakehandeler penticostals are growing at an alarming rate. Timothy McVeigh was a member of one such group and various militant "christion" groups are popping up all over the country with member numbers in the hundreds of thousands. Some of these groups claim leaders to be the second coming of the Lord, or god and convince their followers their
    message is that of the lord. Any group or person who claims to hath spoken or heard the voice of the lord firsthand is trying to control a group or individual. this includes every single poet who wrote the original bibles and every founder of every dogma. Any christian who dosn't seeith that "the word of god" is only the word of man with an appendix at the end stating that god had mentioned to them as they were the special "annointed one" to hear the word and write it down and establish rule over
    those in which "he" commandeth to are in fact just as brainwashed as and child member of some idiotic dogma.

    The Bible contains tons of history. To say that God (is that you, "theholylord?") approves of every historical event that was recorded would be like saying that Ron Paul agrees with every post on this site, which is named for him.

    You know I have to say I

    You know I have to say I really don't know if there is abuse or not at the FLDS
    center. But the evidence of its existence is weak. Let me make it clear that I am not religious at all. But I watched the videos that the FLDS has on their website and I wept as any mother would when I watched those children taken from their mother's arms and/or from their home. Let's just say for arguments sake that there is some existing underage child brides, pisses most people off and I don't agree with it myself but does this justify tanks, guns and sheer force to ALL the women and children? I have watched judges return hardcore neglect cases back to their abusive drug addict parents for the sake of keeping the nuclear family intact. Again don't you think if true concern were present by these "officials" that they would take a different stance? Come on NO ONE is condoning molesting children! WE ARE QUESTIONING AUTHORITY!! Cough up the evidence of abuse, give these children back to their loving parents and deal with underage brides if need be. If you cannot see this as a tactic for further loss of our civil liberties you are very narrow minded.

I had email back few days ago from the impeachperry website that said their blog was down and anyone could post there. My thought was to fish around seeing if there was any sign of hope that the people of TX are not yet too far gone as they all seem to support what their state is doing from what I've observed in comments on other related news articles. I'm ashamed that Texas is part of my country and would vote to give them back to Mexico.

    by and large the media wants us to be opposed to these people. They print endless lies, and never any retractions when the lies are debunked. Today an editorialist in the Houston Chronicle says the CPS has legions of pregnant 13 year olds, one of whom just gave birth. BUT IT IS ALL A LIE. There are no 13 year old wives, and no pregnant 13 year olds. CPS doesn't even claim that anymore! BUT THE MEDIA DOES NOT CARE. They just want to make us hate and belittle people who are less powerful and different.

    Once we can be convinced they are less than us, we are ripe for a Hitler-like leader to lead us as we subjugate, purge, or even exterminate all who are different from our Leader.

    ...are that the mainstream press has so painted these people as freaks, perverts, child molesters, spousal abusers, horse thieves, witches, etc., that most people won't even bother to get past the media reports and weigh the evidence.

    And then, even if they do weigh the evidence, they know that all their friends, family, coworkers, and the rest of the people in their sphere of influence will begin to think they are crackpots and cultists themselves if they come out in support of the FLDS.

    Never underestimate the value and power of government propaganda, spread through a supposedly free press. The propaganda machine was turned on full bore with this issue, and has continued to crank out the kind of manipulative media that makes Herr Goebbels look as harmless and respectable as Walter Cronkite or Edward Murrow.

    CPS Agent Angie Voss, whom a friend of ours says has progressed from 'Professor Umbridge' to 'She Who Must Not Be Named' testified at the hearing that there were under-aged brides in every single household. I have yet to see any evidence that this is true:

Several entries omitted ages of wives, however.

    They seem to have cherry-picked what they wanted from the Bishop's records and ignored anything that didn't support their assertions:
    The bishop's records released Thursday were used by CPS to demonstrate a pattern of abuse justifying the removal of all FLDS children in a hearing two weeks ago. The records indicate that about two-thirds of the ranch's households were polygamous while the others were young couples or traditional nuclear families.

    So, we have 35 households, yet only 8 'wives' under the age of 18, and 1/3 of the families are young monogamous couples or traditional nuclear families. This is from the Bishop's records that were used, as far as I can tell, at the original hearing, where CPS supervisor Angie Voss testified under oath:
    "Up to this point in the investigation, there are over 20 girls in the investigation who have conceived or given birth at the age of 16 or 17," Voss says. "What I'm telling you is that there is a culture of young girls being pregnant by old men."

    So there was a girl like that in all 19 residences on the ranch?

    "Yes, sir, there was," Voss says.

    To get to more than 8 'wives' under 18, she may be including women who are no longer 18, but were once, such as the one we know of who conceived of her first child when she was 13 in the 1990s (I've seen three different years given, but all were in the 90's, when the group wasn't even in the state of Texas, and this woman is now at least 30 years old)- but it does not appear to be the truth that each of the 35, not 19, households had a teenager who conceived with an adult man. This also brings up another question- if the court didn't even seem to realize that there were, in fact, 35 households, were the missing 16 households actually represented fairly at the hearing? Can the judge truly be said to have fairly determined that the 16 households she didn't even know about were shown to be so troublesome that CPS could not return the children yet?
