citizens arrest on public official and trial results (Minnesota)
Well, folks, judicial tyranny is alive and well in Minnesota. All week long I went through my "jury" trial in St. Paul for my doing a Citizen's arrest of a public employee (Bob Humphrey) for Misconduct in Office. Because I did the Citizen's arrest, I was charged with disorderly conduct and trespassing. My SOLE defense was that I did a Citizen's arrest (and immediately called the police for assistance). The person that I arrested fled the arrest and I followed him, into a secure office area. When you do a Citizen's arrest, you are allowed, under the law, to follow the person you arrested, ANYWHERE if the person tries to flee the arrest. I did not actually get a jury trial. Judge Van De North was the presiding judge. The judge decided that allowing the jury to have the statutes that defined the criminal actions of the person that I arrested would be too confusing for the jury, so the jury did not have these statutes with them when they deliberated. Five (5) times during the trial, because of the actions of the prosecutor or the judge, my attorney called for a Mistrial, and was denied. After my defense was rested, which means there is no more to be said, the judge decided that the jury could NOT consider my only defense, that I was doing a Citizen's arrest. He told this to the jury three times, and put it in the written jury instructions, that the jury was not allowed to consider the Ctiizen's arrest as a valid defense. So, the jury was first presented my defense, that I had been doing a Citizen's arrest, and then the judge instructed the jury that it was not a valid defense. The jury was left with only my making some noise and entering a secured area, for "no apparent reason". Of course, the jury had to find me guilty. I was denied my due process rights, I was denied making my defense to the jury. I was denied a TRUE jury trial. Long road...appeal is being written this weekend. Stay strong. Nancy Lazaryan

I didn't know what it meant until I got picked for Jury Duty. I made a big stink during the jury selection process about unfair drug laws and that I would not follow the law as the judge instructed me the law was to be followed. I was going to follow the law as I read the law. I was very nervous and scared. I didn't know if I was going to be charged with contempt of court or something else. The judge was telling me that "I was to follow the law as he said it was" and I was saying "No I Am Not Going To Blindly Follow What You Say". Needless to say I got booted from the jury, but later found out that I was performing Jury Nullification.
It is the duty of the Jury to not only interpret the law and judge the truth of the testimony, but also to judge the law. Your duty as a juror during a trial of your peers is to determine if the law even applies to the case and/or is a just law. For example, some states have laws against gay sexual conduct. Would you convict someone for being gay if you were on that jury? Another example, some states have laws against raw milk sales. Would you convict someone from buying milk directly from a farmer? You would convict if you blinding follow the law as the judge instructs. You might even give them the electric chair if they were gay raw milk hippies living in a commune in Texas who didn't vaccinate and used gold to buy their groceries and smoked pot on Sunday morning while singing hymns. You would let them go if you followed the Constitution and Declaration of Independence. The whole purpose for the trail of your peers is to be the ultimate final check and balance against an overbearing government.
Educated juries can overturn hundreds of years of bad laws overnight. The problem is that the legal system will not inform us of this awesome power. There have been several court decisions about jury nullification over the years supporting our ability to perform nullification if we know about the process. Unfortunately, it's one of those hidden items that's not talked about.

The State Supreme court will allow the State Appellate to rule? Though I'm busy now, I'm interested in the relevant case law in State and out. I'm curious too see if the Supreme court takes it from the Appellate, thus not allowing the afformentioned Appellate to make a ruling. You are a person of great courage and fortitude. Congratulations on your strength of conviction. I am sorry that the corruption of the judicial system prevented you from a fair trial. The biggest farce of all is, of course, that it was YOU that was on trial. You should have been the plaintiff, not the defendant.

i attended this trial and she has the citizens arrest all on tape, Ill try to get a copy of it and post it when its available. we have a lot ofgood stuff on tape here of us in MN but dont know how to get it online. One guy is working on it.
