CPS
CPS is starting to put social workers in all public schools. They are there to pinpoint
"potential" victims. I say they are there to baby shop.

UPDATE!!!
CPS has not been allowed to interrogate this family. They stood up for their rights and stood their ground. The officer in the video messed up the serving so badly that he did not even fill out the paper work. He was served with a big dose of Constitution and public accountability.
The judge tossed the paperwork and CPS has to start all over. This will be a fruitless venture for the family moved to another state and will be homeschooling their children now. The family mentioned this site as being a wealth of knowledge and patriots. From what I have read, I have to agree.

First off, I want to inform people that I am not a radical person. I am not the type that jumps on the band wagon of every so-called cause but,------I believe that every parent has the right to fight for their family. This is what this great nation of ours was all about when we first were founded. Our children are our future and if we give the rights of how they are raised over to someone else then how can we expect to have the type of future we have fought and died for throughout the years. I am sixty-two years old and I was around when the shoe wielding Kruschev beat on the desk and made the statement that he would come in like a thief in the night and take our children. He stated that it would be such a subtle thing that we would not even be aware of it. Well my friends it has been happening. We are slowly giving away our rights one by one and we are not even aware of it. One day we will all awake and say,"What happened?" but it will be too late. I call on every parent in the United States to stand up and say, enough is enough, we are not going to sit around and take it anymore. Right is Right!!

Better sign up as a member of HSLDA right away, and let them know what is going on. They will assist your attorney if they can.
You want to be sure you have given proper legal notice to the school system, etc.

Thank God you got your children out of their...I am worried for
you and your husband though. Please know that you will have many holding you up in prayer. I am wondering how your husband is handling all of this.
I am afraid that if this were to happen to us that my husband would not tolerate this well...maybe that is why they continue to come when he is not home. If it were my husband...all I can say is God help the people who would come to our home to take our child.
Their basis
They are trying to say that we are interferring with a CPS investigation but the law states that we do not have to voluntarily submit our children to them. They served a court order 24 hours after the children were sent to reside in another state. We no longer were able to make the children available to them and they no longer have juristiction. They are mad that we were smarter and faster than them.
You don't have to comply
with anything. Tell them NOTHING. It seems you are doing just fine.

We had planned to move to another state this summer.Now, we hindered by court orders.

not that it's any of my business, but I'm pretty good with this stuff.

The orders say we must assist CPS in their investigation. The children no longer reside with us or in Texas. CPS has no juristiction to conduct an investigation anymore and we are unable to adhere to the order.The children had a new state of residence over 24 hours before the order was served. We sent our children out of the state to protect them from further violations of their rights and to keep them safe from CPS.
CPS can strip search your children if they have custody, they can dope them up, they can require vaginal exams of little girls, phsyc-evals...the list goes on and on. There does not have to be anything but an accusation and that is a violation of their rights and mine as a parent.
CPS acts
CPS acts above the law of the land and parents are too afraid to challenge them. They have been given more power than the letter of the law allows and it is time we stood up for our families. It is disgusting that I have had to place my children out of the home to keep them safe. We are a good Christian family that love and adore our babies. This is a crime against God's people and all Americans. This is why I love Ron Paul so much. He believes in the Constitution.
There is no law of the land anymore
only law of the sea. You are under British Maritime Law. And in reality there is no law at all. It's a shell game and you have no rights. Get use to it. CPS has no authority over you.
If you act like a wolf, they will eventually back away
they want to deal with sheep. They will only have power over you in the end if you give it to them. The "law" will not be of much help to you.

Can anyone in your statehouse help and/or get this out of control department straightened out? Surely CPS is answerable to someone or something.

Attack on my family
I am writing to inform as many people as I can about the experience that forced me to send my five children in exile to save them from the abuse of the system. On May 1, 2008, the school (Montague ISD) in which four out of five of my children attend violated my rights as a parent and my children's rights guaranteed under my husband and me.
The principal pulled my 10 and 12-year-old daughters into a room and interrogated them for almost an hour. She called them liars and said she did not believe them and that she would get to the bottom of this one way or another. It was alleged that my son touched my daughter in her bad places.
My children denied this but the woman was insistent that she knew what she was talking about. She called CPS. At no point was my husband, our lawyer, or I contacted to say there was a concern with one of our children.
That day, a CPS Nazi showed up at my home at 3:45PM. I had not had a chance for my children to tell me what had happened at school yet so I did not have a clue what this woman wanted. She did not show ID or tell me her name. She only said that she was there to investigate an allegation of sexual abuse. I was shocked to say the least. I have avidly protested the situation in Eldorado for the last month and sent several letters to all involved. I thought this was some sort of retaliation. I told the woman that she could contact my lawyer and that she would not be speaking with my children without him, my husband or me present.
She would not leave and my children were terrified. I called 911 to have her removed from my property and told her that I would call the newspapers and TV channels. Finally, she moved her car to the other side of and the Sheriff's Dept. showed up. At this point, they treated me like a criminal. Even though I was the one to call for help. They told me that because I refused to cooperate with this woman, they would be back in the morning with a warrant to remove my five children. They finally left.
I returned inside and my children bombarded me with their version of what had happened that day. These were totally false accusations and as a mother, I cannot submit my children to the sort of abuse CPS is all about. My husband and I prayed about this and did the only thing we could do to protect our babies. We sent them away. We sent them in several different directions and out of the state of Texas . I would never be able to live with myself if any harm came to one of my precious babies.
The next morning, I called their school and told them that my children would no longer be attending there and they should be officially dis-enrolled. They asked where I would be sending their records and I told them that my children would be homeschooled. I will never subject them to this again.
That evening, my husband left for work. About two minutes after he pulled away, Six armed Sheriff's deputies swarmed me house with two CPS Nazi's. I am five foot two inches tall. It was a matter of then trying to intimidate me and coerce me. They asked if my children were here and I told them no. They asked if my husband was home and I said no.
They then proceeding in handing me a paper and not allowing me to read it. They began to scream at me and order me to produce my children to the CPS Nazi women. I told them that they could contact my lawyer and that I would give the papers to him to review. They then proceeded in telling me that I would rot in jail and not be able to give them to my lawyer if I did not give them my babies.
They continually screamed for me to tell them where my children were and I continued to tell them my lawyers name and number. Some family friends showed up and the officers stopped screaming. They ask them who they were and told them they could not be here. My friends told the officers that they were here to witness and they finally let them through.
My husband arrived and they served him with papers. They did not have a warrant. What they had was an illegal court order for us to comply and assist CPS with their investigation. As if we would ever help CPS do anything.
Tonight (May 5, 2008), after my husband left for work, they came again. This time it was only one officer and the two CPS Nazis. I asked if he had a warrant and he said no. I asked his name, he would not give it. I asked his badge number, he would not give it. I video recorded all of this evening's events. I told him he could leave my property and hand the papers through the gate. He refused. He took out his baton and hit my dog, as he claimed that she bit him. She did not.
I continued to ask him to remove himself from my property and he continued to ignore my rights. This man was around six feet five and had to weigh at least 250 or more and was wielding a gun and a baton that he kept striking the ground with. He was sent to threaten and coerce me. He slung the paper on the ground and did not even sign it. He continued to stand around for several more minutes after he finally left my yard.
My friend Dianna took a full audio recording and I have a full video recording. The officer threatened to have my dog impounded. He threatened my home to serve papers and this was yet again a clear abuse of his power and position. The paper he served is not a legal document. No disclaimers are in bold caps as if they should be. It is a Motion to Show Cause. It claims that my husband and I violated a court order. The same court order that did not have the legal disclaimers in bold caps either.
I feel violated in my home and of my Constitutional rights. There has to be justice out there against this oppression. How could I ever be expected to subject my babies to this tyranny? I am afraid to be left alone. They keep driving by to scare me further. Please send this to as many people as you can

Is there any more to this story? Who was it that originally alleged that your son touched your daughter? How did the principal find out?
I watched the video, I don't think it does the situation any justice or will garner you much sympathy. Yes, the Officer may have overstepped his bounds, but it comes across more as you harrassing him. I'm sure you were extremely stressed though, and I admire your courage. I don't think you need to post the whole video to get the point across. Maybe some editing is due.

It sounds to me as if it is time to fight fire with fire. Every single instance of the police or CPS violating the law should be followed-up with. Nobody is above the law, even them. I wish you the best of luck in all of this.
TRO
I live in a different state, though the process should be similar in TX.
If you feel threatened when a specific person is near you, file a temporary restraining order against that person (not the agency). You will likely need a lawyer with different expertise.
In the state where I live, a TRO is easy to get and happens the day you request it. After the TRO is in place, they set up a hearing so the other party can respond. At that point, either the TRO will be lifted, continued, or the process will turn it into a permanent restraining order.
During the TRO process, do not mention the agency. Don't try to use the TRO to interfere with CPS. Use the TRO to keep that one threatening individual away from you.
Once you get the TRO (easy to get it), then that person will have issues with completing the duties of their job, and they will possibly change to softer and less threatening tactics.
You were threatened. Get the TRO _now_. Don't wait.
If they tried to scare you that much
it means they have nothing on you. What they try and do is to get you to incriminate yourself and give up your rights. From your description, you did a great job. You should be very proud of yourself. Texas is a really bad state in terms of children's issues. I have heard nothing but horror stories from there. Try and stay out of court. Since your kids are now out of state, they have no jurisdiction over them. You may eventually have to go too. It's a very sad reality. I know from experience.
Take good care of yourself and keep your energy level up. Eat the right foods, get plenty of sleep and don't drink booze.

to you and your family. Where you advised to respond the way you did? It was probably the right thing to do. I homeschool a child (8) he is a slow reader. My teenager expressed concern to her "counselor" at school who then picked up the phone and dialed CPS for her to report it as child neglect. No mention that the National Report Card says 40% of American school kids read below their gade level. They have yet to come "investigate"...and she called back in December! They could make my child attend public school. This will be a long road for you, be strong and encouraged. Sometimes what happens to us is not so much about us but how the world sees our response to it -you have the power in your hands--don't let anyone tell you otherwise.
another story:
15 years ago I was at the CPS office to renew my childcare benefits and the interviewer left the office went down the hall and reported that my child had a severe burn on her arm then came back and completed the papaerwork and granted the extension of benefits. Well, if she had reached across the desk or hesitated at the door before she left the room and taken a closer look she would have seen that it was a birthmark, one of those strawberry marks that eventually go away on most people. Next thing I know an officer and CPS show up at my door to investigate. I had to show pictures of my newborn with the mark, allow the investigaters and officer to touch the mark and it was done-not quite, I had my name put on the National Child Abuse Registry for a year and a record of unfounded abuse put in my case file.

They are tyrants and target poor and middle class families for their child trafficing ring. A few years ago, there were over 3000 children missing from FL social services. Some were found over sea in shallow graves with their heads chopped off. And again, I am suppose to subject my babies to that???
