Road Check Points/ Nebraska

I posted last month how I was pulled over at check point and asked to give my identification, insurance and registration and politely declined and they finally let me go without requiring me to show my information.

Yesterday I'm headed to town and ARGH they had another road check point. Grrrrr
They stop me again but this time ask me to pull off the road and the state patrol officer says to me...You are the RON PAUL SUPPORTER that refused to give us your information last time.
Then said GO RON PAUL !!
We just voted in Nebraska..so I was like so did you vote for him ??
He laughed and said No, so I asked him why did you say Go Ron Paul then if you didn't vote for him ? He just laughed again and said I bet you voted for Bush the last two times didn't you. I was yes and it was a huge mistake. So I said WHO did you vote for..he said Obama. I told him not to be fooled by Obama.
While this is happening the guy in charge walks over and leans in my window and hands me a statute out of the State Patrol Nebr. governing laws he had printed out that he claimed gave them the right to stop anyone anytime without probable cause and request their information be provided. He had highlighted
the part he felt applied. Then went on to chastise me for being rude last time they stopped me. I was polite and told him that he was a civil servant and that a citizen of Nebraska asking him a question concerning the law was not an indicator of being rude..He walked off
while I was speaking.

This time because they handed me the so called law that takes away my rights, I gave them my information. BUT when I left I went directly to the office of a local lawyer that is running for Nebr. legislator and showed him the statute and he is going to check into it for me.
He did tell me there was as case in which someone took it higher up
in the courts and they ruled they have to be uniform in how
they preform the road checks. They either have to stop all the cars or do every 3rd or 4th cars.

Later the same day I talked to a guy I know that is a recently retired state patrol officer and asked him about the check points. He told me that they are stepping them up in Nebraska and will be having more of them because of the price of gas. It is cheaper for them to stay stationary themselves and put up check points than to drive the highways. Which in my opinion is a crock of shit !!

If you are reading this and you are from Nebraska and don't like the idea of being stopped to show your papers..contact your representatives, local sheriff's office, county attorney etc etc.
The only way this is going to stop is if people raise a stink about it.

The Fourth Amendment

I am not a lawyer, but does this not violate the fourth amendment to the Constitution:

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized. (emphasis added)

Wouldn't this preclude any road side check points as there is not probable cause to search your vehicle or a description of what exactly it is they they are searching or seizing?

You would think so..but according to the

state patrol guy I know I talked to..when you drive on the roads you give up your rights. He told me if I didn't want to be subject to being asked to give my papers not to drive on public roads.

said there are to be nationwide national emergency drills across the country from june third to june sixth,,,a good time to stay off the roads id say...they are drills but of course do make arrests and rounds ups during the "drills"

I just want to say that I love this post in its entirety. You are really trying to make a difference and these are the actions that WILL make a difference. The cops remembered you, and found the statute. That alone was great. The time is NOW for that statute to change, and you are doing your part to bring it up.

Your post made me feel better..I was feeling like a heal for giving them my information. But crazy enough I had just watched a You Tube clip the night before where a woman was arrested for not giving her information at a check point. I confess I was scared and not ready to go to jail.

I agree, contact your representatives and raise a stink.

Here in PA we are working hard against the Real ID and seem to be gaining momentum - due to continued pressure and public hearings. Reps are re-elected here every two years so want to try to keep us happy.

We cannot give up - this is huge!
