Sect children to begin returning home Monday
Tentative deal reached between state, polygamists
SAN ANGELO, Texas - Texas authorities and a polygamist sect reached a tentative agreement to begin returning children taken by the state starting Monday.
A draft agreement released in court by Texas Child Protective Services attorney Gary Banks on Friday said the parents can get their children back after showing identifications and pledging to take parenting classes and remain in Texas.
The agreement was reached with the 38 mothers of the 124 children who filed the complaint that prompted the Texas Supreme Court to rule Thursday that the state overstepped its authority in taking more than 400 children.

But the deal would affect nearly all the children since they were removed under identical circumstances.
Huge custody case shattered
The ruling shattered one of the largest child-custody cases in U.S. history. State officials said the removals were necessary to end a cycle of sexual abuse at the ranch in which teenage girls were forced to marry and have sex with older men, but parents denied any abuse and said they were being persecuted for their religious beliefs.
Every child at the ranch run by the Fundamentalist Church of Jesus Christ of Latter Day Saints in Eldorado was removed; half were 5 or younger.

FLDS elder Willie Jessop said parents were excited about the court’s decision but would remain apprehensive until they get their children back.
“We’re just looking forward to when little children can be in the arms of their parents,” he said. “Until you have your children in your hands, there’s no relief. But we have hope.”

How DNA tests reveal polygamist sex practices
The Third Court of Appeals in Austin ruled last week that the state failed to show that any more than five of the teenage girls were being sexually abused, and had offered no evidence of sexual or physical abuse against the other children.
The FLDS, which teaches that polygamy brings glorification in heaven, is a breakaway sect of the Mormon church, which renounced polygamy more than a century ago.
Home base
Some facts about the Fundamentalist Church of Jesus Christ of Latter Day Saints, the polygamous sect whose Eldorado, Texas, compound was raided by authorities.
The traditional home base of the church has been the twin border towns of Colorado City, Ariz., and Hildale, Utah. The church also has enclaves in Colorado, South Dakota, Texas and British Columbia.
There are an estimated 40,000 fundamentalists practicing polygamy across the Intermountain West. Some are part of organized churches and others are independents.
The FLDS is the largest-known polygamous sect. Membership is not published, but is estimated at roughly 6,000 based on U.S. Census numbers.
The FLDS incorporated as a church in the 1940s.
Roughly 430 children from the ranch are in foster care after two births, numerous reclassifications of adult women initially held as minors and a handful of agreements allowing parents to keep custody while the Supreme Court considered the case.
Texas officials claimed at one point that there were 31 teenage girls at the ranch who were pregnant or had been pregnant, but later conceded that about half of those mothers, if not more, were adults. One was 27.
Falling short of legal standard
Under state law, children can be taken from their parents if there’s a danger to their physical safety, an urgent need for protection and if officials made a reasonable effort to keep the children in their homes. The high court agreed with the appellate court that the seizures fell short of that standard.
CPS lawyers had argued that parents could remove their children from state jurisdiction if they regain custody, that DNA tests needed to confirm parentage are still pending and that the lower-court judge had discretion in the case.
The justices said child welfare officials can take numerous actions to protect children short of separating them from their parents and placing them in foster care, and that Walther may still put restrictions on the children and parents to address concerns that they may flee once reunited.
DNA taken from polygamist leader
Also Friday, Texas authorities collected DNA swabs from jailed polygamist sect leader Warren Jeffs for an ongoing criminal investigation, an official said Friday.
A spokesman for the Texas Attorney General’s office, Jerry Strickland, said the samples were taken Thursday at an Arizona jail where Jeffs awaits trial on abuse charges.
A search warrant for the DNA alleges that Jeffs had so-called “spiritual” marriages with four girls, ages 12 to 15.
The criminal investigation is separate from the Texas custody case.

Which judge?
I skipped answering the first question, because of the lack of clarity.
The story spoke of not only Judge Walther's decision, but also the decisions of the Austin Appellate and the TX Supreme Court.
The question, "Do you agree with the judge's decision?" is intended, I believe, to mean Walther's decision, but, since it's not spelled out, it could refer to the other judges' decisions. I can just see a bunch of people voting "NO", and having AOL come back with a summary saying most people voted that they did not agree with the decision of the Austin Appellate Court or the TX SC.
Further, assuming it definitely means Walther's decision -- then, which one? Honestly, there's not one decision of Walther's that I'd agree with, but again, for the sake of clarity, she made several decisions: to authorize the warrant, bring the families in for a group hearing, storming out of the courtroom without signing the release, etc. etc.
Personally, I believe it is important to know precisely what one is agreeing or disagreeing with. The way the question is phrased is nebulous at best.
And this may be the confusion reflected in the results. Most respondents feel the FLDS were treated fairly...yet, most respondents DISagreed with the judge's decision. ???
If the majority of respondents disagreed with Judge Walthers' decision -- that her decision to take the kids was wrong in the first place -- how, then, is it that a majority of respondents believe the FLDS were treated fairly?
Should I have paid better attention in statistics classes? Am I missing something obvious?

The shame of Texas deepens as — in the face of contrary rulings by the Texas Supreme Court and Third Court of Appeals — Judge Barbara Walther today defiantly signed an order vacating only the piece of her original order against the FLDS that granted custody of the children to the State. The presumptions of guilt against the FLDS remain. The new order also falsely characterizes as an “adversary hearing” the three-ring circus that Walther conducted in her courtroom back on April 17-18, 2008.
It is clear that some of the children will be released under the order if the parents comply with its intrusive terms. It is an open question how many of the children will return home (or when) given that the State of Texas has bled the FLDS financially dry by scattering their children all across a State that talks big but is, in reality, a moral and legal ant.
When the children do return, it won’t really be “home” because Texas CPS will have the right to barge in any time during business hours. The Austin Statesman is reporting that all of the children can return home, but I’ll believe it when I see it. Additional insights on the Sunday negotiations that led to today’s order are offered by Brooke Adams.
A house is only a home if you enjoy the protections against search and seizure that all Americans are supposed to enjoy. This distinction is obviously lost on the judge who — for what reason God only knows — continues to preside over the case. Because of their religion and the venomous bigotry of Judge Barbara Walther, these Americans citizens are being denied their basic constitutional rights.
Barbara Walther should be removed from the case and replaced by someone who can judge impartially. If I were representing any of the FLDS in the case, I think my next move — after getting my kids back — would be to challenge this new order at the Court of Appeals. The agreement was reached under duress. It was, in effect, extortion and gives the State prerogatives that it should not have. The one who should be taking classes is Barbara Walther, not the FLDS parents.

the families are essentially under house arrest, the mothers and fathers are forced to take state-approved parenting classes, and they must all remain in Texas indefinitely.
This is an incremental victory. The children are coming home. That is a joyous thing. Every day those children were separated from their parents was another day of irreparable harm against them. Willie Jessop, a YFZ spokeman, and some of the parents also say that the order is not the greatest, but it is important to get the children back home.
Now, it's time to IMPEACH MRS. WALTHER. Of course if she can't be impeached, she should be UNELECTED at the next appropriate time, and the pending voter registration of about 500 FLDS members might just be enough to make sure that happens.
In the meantime, here's a petition to impeach Walther.

Guilty With No Charges?
I signed without hesitation. The crimes that Judge Walther has committed against these U.S. Citizens and the U.S Constitution are far worse than anything the FLDS people have been accused of. The Constitution is the Supreme Law of the land, and Walther is obviously violating it with intent; no judge would make it through law school without learning the Constitution would they?
What I don't understand, is how come, after everything and the Supreme Court ruling that CPS must return the children, the state is not even going to transport these children back to where they took them from? The parents have to drive all over the state to pickup their kids?
On top of that, why are the parents being treated like criminals still, under house arrest and requirements to complete arbitrary government classes? CPS still does not have any charges filed against any parents, so why are they being treated like they are guilty?
This thing is not over.
My thing has
always been what is the sexual abuse ratio in a standard town in the U.S. of 400 people, what hasn't that been brought foward. I bet it's a hell of alot higher than the poligamist compound. Did they ever compare that compound to a town? Shouldn't that information be available just looking at that web site that reports the state released sexual abuse perpatraters. Just a question.

I understand that you, Mr. Dinnin, and/or related associates, were the incident commander who helped unlawfully seize and hold hundreds of babies, children and women, taken at gunpoint, from the FLDS ranch in Eldorado, Texas. In addition, as governor Rick Perry allowed, most of Texas' fostercare/adoption 'services' are 'outsourced'; meaning, you are under contract with the state of Texas. Your web site reports that you are still holding 75 FLDS children.
Two higher Courts have determined that the State took illegal custody of FLDS children, and the courts order their return.
I am not FLDS, I am not Mormon. Rather, I am a Bible believer of over 35 years.
As the child of holocaust survivors and a citizen of the United States, I insist that you do the righteous and lawful thing.
1. Return the 75 children, taken at gunpoint, that you are now holding at your Luling (or other) facility that you, as ICS commander, helped the State of Texas kidnap in your Gestapo-style raid.
