temporary illegal seizure

As if someone is going to say anything other than American??? Then what? Afterwards, I'm sure they would ask for license and registration at which point it does become a checkpoint. Complete with temporary RV station house. That is illegal.

She was committing an illegal act just by asking some questions according to our constitution. Although our government agencies get away with just about anything they want these days a checkpoint is part of "unreasonable search and seizure" because by stopping you it becomes a "temporary seizure of your property and person".

I'm sure Gonzalez would disagree because the word "temporary" isn't explicit in the constitution. Use common sense.

Why not just have tollbooth with thumb and eye scanners that say "IDENTIFY" in a computer voice when you pull up to them. Wouldn't that make her job much easier? Sadly I don't think we are too far off from that at the rate we are going thanks to the UK and their cctv stuff. Orwell is here, he's living large.

Truck drivers are "pull-over heaven" to the authorities. Its my understanding that they can pull them over at anytime and a multitude of offices can do it.

Speaking for myself, I have been in jail, its really not a lot of fun. And you laugh, saying, "its not suppose to be"! You can laugh, thats fine.

Jail is where you learn that they make any rules (laws) that they want and change those rules (laws) anytime that they want, without warning.

There are two phrases everyone needs to understand when being pulled over by authorities. Obviously, as so well noted in the video, one is "Am I begin detained and am I free to go?" The other is "I do not consent to any searches." Simple enough and worth it.

So, what do you do if they

So, what do you do if they say, "yes, you are being detained." Or, "no, you are not free to go?"

Just let them do their thing and have to fight it later in court?

If They Are Detaining You

Then you have a right to know what grounds they have for detaining you. In order to be detained, and I am not a lawyer, would be if the police officer has either seen you break a specific law or has a witness to provide statement that some law was broken that can call for detaining of you the suspect.

In checkpoints, they have no scope to interrogate you or search you or your possessions. The thing with the checkpoints is that they catch the unsuspecting people who were drinking or have paraphernalia sitting right out in the open. So if they smell alcohol or see some pipes, then they now have a right to detain you. Otherwise, you don't have to answer a damn thing.

That guy was

a bit over the top. He was traveling close to the border and he gets stopped by a border check point. They ask him a simple question "What country are you from?" is what it sounded like to me.

The video would have merit if they would ask for anything more once he answered American. How do you propose we protect our borders if not with random checks and surveillance?

I understand the issue at hand. I despise the idea of supplying papers as much as the next guy. What I'm asking is how do we protect the borders without this type of behavior?

You may wish to know...

That my family and I traveled to Rocky Point Mexico, then on the way back, we were stopped at customs at the boarder. I showed my DL and we were not asked for Id's or passports.

Then about 100 miles inside the USA was this check stop. (Why two?) Unlike the border check point, this check point had us get our DL and passports and so forth. These people seemed drunk on power just ready and willing to pounce, and sad they could not pounce on us.

He was traveling "CLOSE" to the border. He wasn't passing through the border... he was in the U.S. and wasn't passing in or out of the country. No reason to stop him or question him without probable cause.

do n not give out free education, free food, and free medical care... don't build the welfare system for illegals and they won't come! we do not even need a wall! read your constitution!

Don't give the incentive to come and problem solved.

This is why we're losing our rights.

Because when people exercise their rights, others take the opinion that the person is being over the top, being rude to police.

Last time I checked, the job of law enforcement was to uphold the law. Well, you have the right to do what this guy did. So isn't it the job of police to respect that?

You would think not though with how many people now say refusing to answer these questions asked by police, is being rude to them.

Immigration laws are just as

Immigration laws are just as lame as drug laws. Immigration laws create crime. Just like drug laws, the more they are enforced, the more crime that is created.

We do not need "protection" of our borders. We need freedom of access.

Those were his rights

Period end. He has a right to be a hard-as* if he so chooses and I wish more people would excercise their rights. If borders were such a close issue to our security, then why are our social programs not connected to the same line of questioning? They do not ask in a hospital if you are a US citizen and a hospital will lose its federal payments of medicade if they refuse to treat anyone, illegal or not.

You tell me if the border are really that important? The policies of the administration comment otherwise. The North American Union is just a cough away.

The borders are being penetrated because walls cannot hold back someone from free medical care, education, and welfare. Take a look at Mexico's rights for illegals and you will be shocked that we handle things the way we do.
