Impeach the Wicked Witch of West Texas: Judge Barbara Walther needs to be fired before she causes more irreparable harm
Submitted by AK4RP2012 on Tue, 06/03/2008 - 01:11
Dear RP Revolutionaries and all persons of good will, concerned with preservation of constitutional rights:
Many of us have been appalled to see the complete disregard one woman has had for the constitutional rights of an entire community of peaceful, religious persons. We must not allow this sort of behavior to go unnoticed. Legal means are available and should be pursued to unseat this avowed opponent of the first, fourth, fifth, and fourteenth amendments to the U.S. Constitution.
Judge Barbara Cohen Walther, infamous for her anti-constitutional violations of civil rights on a massive scale unseen at any time in recent history, needs to be impeach, unelected, or pressured to resign. Choose any one of the above, whichever one is most expedient and will remove her from the bench the soonest! She has proven unable to appropriately discharge her duties.
Please sign the petition to Impeach Barbara Walther now. http://www.gopetition.com/online/19682.html
If you need more background on how Lord Barbara came to be known as The Wicked Witch of West Texas, read on. Forgive my writing, this is being typed out quickly in the interest of getting this petition spread far and wide.
First, she completely ignored Texas statute and considered an entire ranch community of nearly 700 persons as one household for purposes of child protection (there were actually nearly 40 individual households in the community). She issued a search warrant to Texas Rangers who had been turned down by another judge, to raid the YFZ Ranch in search of an alleged victim of child abuse. The result was the herding onto busses of 450+/- innocent children and approximately 150 mothers, who accompanied their children to an 1800's fort where a concentration camp-styled "shelter" would house many of these mothers and their children for weeks.
When it became apparent that treating these persons as individuals would be too much work, Judge Walther refused all of them their right to an individual hearing and instead treated the entire community to one farce of a hearing, in which most parents' and children's attorneys were forbidden from participating or simply not included.
Judge Walther ordered the confiscation of private property from these U.S. citizens when she demanded the confiscation of their cellular phones, leaving these innocent women with no way to contact their lawyers, husbands, or the press, which had published photos snapped on camera phones of the deplorable conditions the State had provided them.
Mrs. Walther allowed CPS to house children in substandard facilities where they were enclosed in close quarters, spreading illness, eating unhealthy foods to which they were unaccustomed, and using forced invasive medical examinations and interrogation style interviews to pressure children to confess to being victims of imagined crimes (the call that led to the raid has all but proved to have been a hoax, yet CPS, under Walthers' orders, badgered teenage girls, trying to force numerous girls into confessing that they were the "victim"; none were).
When time came to get the children into "permanent" foster facilities, wailing and weeping children were forcibly pulled from mothers' arms by CPS, acting under Judge Walther's temporary custody order which awarded CPS parentage of all children, and 26 adults held as minors.
Mrs. Walther ruled that nursing infants were to be forcibly removed from their mothers and placed in foster homes. La Leche leagues and other mother's groups nationwide cried foul that this judge would dare remove a nursing baby by force from its mother.
Mrs. Walther continued to allow CPS to hold children captive even after being ordered by the Supreme Court to vacate her temporary custody order which led to the mass dispersal of innocent children into strange homes or group shelters. When she finally relented and agreed to vacate her order, it was only to give way to an awful agreement that essentially keeps FLDS parents under near-house arrest and assumes all members of the ranch to be guilty. She has even demanded that FLDS mothers, witnessed by state-hired mental health professionals to be among the best mothers ever known, to take state-approved parenting classes. Licensed professional counselors and psychologists hired by the state have testified that Texans at large could stand to learn how to parent FROM the FLDS mother.
Below is the official langauge on the petition to impeach Mrs. Walther. Please spread this post far and wide.
Also, as this case is by no means over, please consider a donation to the FLDS legal defense fund: http://www.captivefldschildren.org/Donate.php.
Those inclined to speak directly with their elected officials may wish to call the good Judge and share their thoughts with her, maybe ask her about her re-election plans and hopes. Mrs. Walther can be reached with your comments and praise at:
(325) 659-6571 (work)
(325) 655-7922 (home; this is a White Pages publicly-listed number)
It is a constitutional and well-respected right and duty of Americans to hold their civil servants and elected officials responsible to the People for their actions. Mrs. Walther must be held accountable for the irreparable harm she has caused to the 700 members of the FLDS who found themselves unfortunate enough to fall under her jurisdiction, and to the people of Schleicher County and the State of Texas, who will bear the burden of millions of dollars spent on Walthers' ordered raid and subsequent mis-steps.
Mrs. Walther must be stopped before she compounds the irreparable harm she has already caused to hundreds of children and their families.
With best regards and sincere appreciation to all people of goodwill,
AlaskaRon

Whereas Texas 51st District Judge Barbara Walther has violated the constitutional rights of more than 400 children and their parents of the Fundamentalist Latter Day Saints Church (FLDS);
and whereas Judge Barbara Walther took an oath to defend and protect the Constitution of the United States and the Constitution of the State of Texas and has violated that oath;
and whereas both an appellate court and the Texas Supreme Court have sided with the FLDS children and their parents against Judge Barbara Walther;
and whereas the actions of Judge Barbara Walther have resulted in a great financial cost to the State of Texas and its taxpayers;
and whereas Judge Barbara Walther's actions constitute one of the greatest violations of constitutional rights in the history of the State of Texas;
and whereas Judge Barbara Walther should have known ahead of time that what she was doing was unconstitutional, since the Island Pond Raid in the State of Vermont in 1984 was almost identical, and there are other similar cases on record where judges refused to support unconstitutional raids by Child Protective Services;
and whereas Judge Barbara Walther has impeded the reunification of parents with their children, even after the Texas Supreme Court ruled that they should be reunified;
we ask that proceedings begin immediately for the impeachment of District Judge Barbara Walther of the State of Texas.

Why isn't the FLDS suing the crap out of this judge
and the county. If they're affiliated with the Latter Day Saints I'm sure the hierarchy of the church is not happy with this situation.

What a freaking joke!
There are so many people in that county and state that need to be fired. And then have criminal charges brought against them.
Yeah for their toilets no
Yeah for their toilets no less!
Is this what the government is for? To come people's thousand acre ranches with search warrants and police to tell them their toilets do not meet zoning? Zoning for where?
I'll bet the government was hoping to get them on bigger violations though, it's as if the government is attacking these people in retaliation now for being found innocent and embarrassing government.

How come the hoax caller of this whole disaster has not been charged yet?
1. The calls were traced to her phone.
2. They have recorded tapes of her calls.
3. FLDS evidence was found in her home.

5. She has a history of hoax calls.

But no charges for the FLDS hoax calls? Texas just hoping this thing will go away eventually?

Shhh. You'll embarrass the Texas Rangers.
We wouldn't want to hurt their little feelings by mentioning how idiotic, sophomoric, unprofessional, and ILLEGAL their entire operation was, from day one to the present.
"Must...keep...up...all....appearance of having done the right thing!!!!!"
Now, when are those criminal indictments going to be handed down for all those child molesting, pre-pubescent-marrying, welfare fraudsters????
Oh yeah....thats right! There were NO "child brides" and NO "pregnant minors" and not a single FLDS member at the ranch was using any sort of welfare at all! Whoops! And those dozens of so-called minors that were mothers actually turned out to be adults in their 20s or 30s once they were allowed to show CPS their drivers licenses and birth certificates! So much for all those criminal charges!
And what's that I hear? The women of the ranch have started a clothing sales business to try to support themselves, since they were forced to leave their beautiful homes and farms? www.FLDSDress.com, you say?
This has dropped out of the spotlight precisely because the scandalous angle of "old men marrying pre-teens" all proved to be completely false. However, even though the reporters have all gone home, hundreds of children and scores of parents are trying to work through the ridiculous CPS requirements that still hang over their heads. They are still trying to pick up the pieces and get on with life, which will never be the same. How can it be when your children were kidnapped for over 2 months and every indication was that you would never see them again?
I can't wait till all of the lawsuits against the Texas Rangers, CPS, Her Dishonor Barbie Walther, the Sheriff's department, etc., begin to be filed. These people WILL get their day in court, and you can surely bet that the damages awarded will be (and SHOULD rightfully be) quite significant.

FLDS Raid Exposes More CPS Abuse
Well, here's a new video that all Americans should be able to identify with and watch in disbelief as another family's kids were stolen from them and the parents made out to be criminals by CPS, even after the court dismissed the case, ordered the children returned immediately, and an independent psychologist praised the parents, saying they could raise his own children:

Watch it and pass it around. Some people were blinded by the polygamy, but everyone should be able to see there is no justification for this one!

this is what bothers me
this is what bothers me about our government. If I screwed up someone life they could sue me, and I could be liable for damages. when government employees screw up they never get in trouble because they have "immunity" I want people who swear to protect our constitution and then violate it go to jail for treason!!! They should be liable for damages, not just inpeached.
I think you've just done a pretty good job of explaining
why it is that they do what they do. They claim "sovereign immunity" when they commit an act in the discharge of their official duties, no matter how outside the law that their act traverses. In essence, they claim the "Nuremberg Defense".......they were only following orders. I entirely agree. They should be charged, prosecuted and, if convicted, subjected to criminal penalties that would be available for any citizen charged with a similar offense.

Execute them!
No kidding.
If CPS was charged and found guilty of 468 cases of kidnapping, which is exactly what they did. They would never do it again.
Kidnapping carries the death penalty does it not?
If you remove their government titles, what would have happened to a group of armed men that raided someone's ranch and kidnapped all the children using tanks and machine guns?
First of all, it probably would have been a federal crime to even own the weapons they used, and then each of them probably would have been locked up for life or executed. On top of that, their entire organization would probably be dismantaled and banned.
But no, these people were wearing fine hats when they kidnapped a whole community of children, so, "oops, sorry."
Actually, not even, "oops, sorry," but "damn it, we screwed up, we need to slander and pin something on these people to justify it, we can't let them get away with humiliating us with their innocence."

This district court judge seems entirely determined to
carry through with her own personal ideology and dictum with regard to what she thinks that the law in Texas "ought to be", even though her original ruling was soundly rejected by the Texas Court of Appeals as well as the Texas Supreme Court. The Court of Appeals even threatened to "take action" if their rebuke (by way of their ruling) was not adhered to by the District Court judge. The Supreme Court, in only a 5 page opinion, affirmed the judgement of the Court of Appeals, but that hasn't stopped this District Court judge from attempting to attach all kinds of limitations and conditions on the return of these children to their lawful parents. Evidently, she has her own view of the what she thinks the law should be, regardless of what either the legislature or the appellate courts say, and she doesn't show any signs that she is going to comply with the appellate court decisions. This gal needs to be removed and soundly disciplined.

Lawyer for polygamous prophet's daughter says Texas judge biased
http://www.sltrib.com/Polygamy/ci_9685005
So, now, we have the same tyrannical bias judge Walther, continuing her persecution. A request for a new judge was denied.
And Walther allows a lawyer to conflictingly represent both the state and a FLDS girl at the same time, even when the lawyer has been found to be making false statements against the girl and her religion, and after the girl has requested a new attorney.
See if you are smart enough to pick up on all the injustices going on, reported in the above article. I am sure it will be quite obvious to almost everyone.

New Article Summarizes FLDS Raid
Whose Children Are They, Anyway?
http://www.thenewamerican.com/node/8344#SlideFrame_1
...
"How does a state child protective services agency even begin to take nearly 500 children from families living in a peaceful religious community in West Texas? Answer: a night-time raid with tanks, riot police, SWAT teams, snipers, and cars full of Texas Rangers and sheriff’s deputies. That is the new face of state child protection — social workers backed up with automatic weapons."
...
"The agency asserted that 31 children, aged 14 to 17, were pregnant or had borne children by adults. However, the agency now admits that over half of those 31 persons are actually adults, including one who is 27 years old. At the time of the hearing, the agency could not identify a single child married below the legal age, including the nonexistent “Sarah.” (Texas law allows marriage at age 16, or younger with court approval.) Nor was there testimony that any person was physically abused at the ranch."
...
"This episode should be a warning to all families that an arbitrary attack by the state against a family can happen to any of us and that a court will likely not protect the family from overreaching state social workers or false reports of child abuse."

Final Tally: Zero pregnant teenagers
I just wanted to pass along that of those so-called 31 teenagers who were either pregnant or mothers, you will recall that 26 of them turned out to be adults age 18-37 (yes, a 37 year old mother was counted by CPS as a teen, as was a 29 year old, a 27 year old, several others in their 20s, and some 18 and 19 year old). 5 of them were 16 and 17 year olds. Of those, 4 of the five were sent back home to their PARENTS, as none of them were pregnant or married. That left one, who is 16, who was finally admitted just yesterday to be neither married nor pregnant.
Just thought that those of you all who are following this story might like to know :)

Deceitful Media Perspective
Exactly, the media trumps up all the horrible lies fed to it by CPS, but when the evidence turns up that these were lies, the media does not report about how deceitful the government was, or how terrible the accusations were.
At the most, the media merely puts a little footnote in to say they were 'mistaken'. But, usually the media just says "it did not pan out" or "everything evenutally checked out OK" or similarly unremarkeable statements.
Shouldn't those headlines that were stating FLDS was breaking the bones of their children, now be reading, CPS was trying to deceive America?

#1 result is this article, which has a rating of 9.5 out of 10:
In Shame They Live - polygamous cults, the FLDS - child rape, incest, infanticide, domestic violence
...which starts off with claiming they suffocate babies with pillows.
Then it goes on to say;
"Mormons who adhered to polygamy (like my great-grandfather who had six wives and 44 children) were hardworking people from Britain or Scandinavia, who had left their country and their church, in search of a promised land where they would not be persecuted.
The Mormons who settled Utah were mainstream men and women of the 19th century.
In contrast, the leaders of the FLDS and other fundamentalist polygamous sects are often deranged, mentally ill, and/or criminals who are forced to live underground because their religious beliefs are against all laws known to humankind."
#2 is a blog, Mirror On America : Child Rape Now Legal In State of Texas And, it's a good example of how ignorant people are, because it was written Monday, June 02, 2008;

So absurd it's beyond words!
From that first article you linked: "My mother and I talked about Colorado City-Hildale in 1980. It was considered very dangerous to try to appraoch the compounds. They are often gated and armed."
Huh? Oh, so that major state highway that GOES RIGHT THROUGH THE MIDDLE OF THE TOWNS must be considered "very dangerous"? Despite the fact that thousands of non-FLDS people drive on this highway, all year, day in and day out, right through the "compound"????? Utterly laughable.
And I guess all those businesses in town, like the Texaco station, the Merry Wives Cafe, the CMC Food Town grocery, and Craigo's Pizza, those must all be gated and armed, too? Maybe they have moats around them? Or armed guard towers, ready to shoot you if you try to do business with them? Huh. Here I thought that any person off the public highway could park their car, walk out of their car, and go right in to any of them and be served? Wow. I must have missed the armed guards and gates. Dang. I'm lucky to be alive. I missed all the sniper fire last time I drove through Colorado City.

It's not just Judge Walther - it's also the TX AG's office
From William Grigg's blog, Pro Libertate:
"During Monday's hearing, CPS counsel Frank King whined for a change of venue to ... guess where? That's right: Barbara Walthers' courtroom, the only one in which the kidnappers have enjoyed any success.
[District Judge Martha] Tanner wasn't having any of it, and her comments from the bench suggested that she's had a surfeit of the CPS's [insert sibilant slang term for fecal material].
"I am not going to allow CPS or any other agency to interfere with parents in this state," declared Judge Tanner, at the risk of inspiring the tiniest tremor of respect for at least one representative of the judicial branch.
Undeterred, the Texas attorney general's office has announced its intention to file an amended petition with the 4th Court of Appeals, in the hope -- once again -- of getting the Keate case in front of Barbara Walther once again. This, despite the fact the 4th Court already denied an earlier request of that sort on May 22nd."

Government Crimes
Why is the government able to get away with all these crimes; mass kidnapping, mass slander, mass theft, massive Constitutional violations? If it was anyone except for the government that did all this, they would be rotting for life in prison or dead.
Shouldn't the government officials be held just as responsible, if not more so, than any other citizen? If we allow government officials to get away with violating the law, then they will be emboldened to do so. Apparently, from the FLDS case, government employees in Texas already feel they have a free pass to massively violate the Supreme Law of the U.S.
What would be done to citizen Jon Doe, that kidnapped all his neighbor's kids at gunpoint and held them for a couple of months, based upon an anonymous phone call he received and other rumors? Would we just say he was acting in the best interest of the children? Or would he be doing hard time, or more likely be shot dead?

Texas Circus Adds Another Tent
This whole FLDS story is so unbelievable, that if you put in all in a book and gave it to anyone that had not heard of this case, they would think it was fiction.
Is anyone working on a documentary of this? I would hate to see all the details, articles, and videos lost due to time.
A threat is now determined by how someone's face looks? You must express no emotion on your face even for things that are very important to you, or the government will label you as a threat?
The facial expression police? I mean seriously, what the hell is going on in Texas?
They may as well add thousands of Americans to their threat list, because I'm sure there are many thousands of Americans that are absolutely disgusted with the dishonorable Walther authorizing the kidnapping of hundreds of children, and then keeping them detained even after she was told to let them go. Is it any surprise that Americans are highly upset with her?
I think the government is just hoping that their absurd actions will become so commonplace that we will begin accepting it and give up on being upset.
Would it be bad to feel happy upon hearing governor Perry's house caught on fire - and think to yourself, too bad he was not inside? Would there be any justification for feeling that way after everything that has transpired in this child raid?

You will be amazed when you see this article and its companion article, at http://deseretnews.com/article/1,5143,700233581,00.html
Apparently you can be a criminal tried and convicted in the media for thought crimes, and for looking at people funny. I am not kidding.
Anyway....
"Texas police have been standing guard outside the home of the Texas judge who ordered the removal of all the FLDS children from the YFZ Ranch. . . .
"Law enforcement in Texas has been on alert since a Fundamentalist LDS Church-related Web site published Walther's home address and work and home telephone numbers. . . .
"As for the threat to "pay Ms. Walther's home a visit," on the site www.flds.ws, Parker said the site is not sanctioned by the FLDS Church. The site is run by Bill Medvecky, a Fort Myers, Fla., man who has donated to the fund for captive FLDS children, Parker said.
"Once Parker told church leaders that the post could be construed as a threat, they contacted Medvecky and had him remove the judge's address, he said.
"However, Walther's work and phone numbers are still listed on the Web site. The site calls Walther the "leader of the Gestapo," and includes a link to a petition to impeach the judge.
"Medvecky doesn't see the harm in publishing Walther's address on the Internet. After all, it's in the phone book, he said.
"They are not confrontational whatsoever. I am," Medvecky told the Deseret News. "They are not me, and they have nothing to do with the site. We support them 100 percent."

Thank you for the post! 2
Thank you for the post! 2 and 1/2 months and still no charges filed, so now they have to stir it up some more. I hope after Walther's impeachment each family that was torn apart sues her. And I am waiting for some charges to be brought against that woman!
She should be afraid! How can she possibly think that she is above the constitutuion and the oath she swore? And thank GOD so many people are watching this nation wide so there can't be another Waco.
