In a major rebuke to the Bush administration's theories of presidential power -- and in an equally stinging rebuke to the bipartisan political class which has supported the Bush detention policies -- the U.S. Supreme Court today, in a 5-4 decision (.pdf), declared Section 7 of the Military Commissions Act of 2006 unconstitutional. The Court struck down that section of the MCA because it purported to abolish the writ of habeas corpus -- the means by which a detainee challenges his detention in a court -- despite the fact that the Constitution permits suspension of that writ only "in Cases of Rebellion or Invasion."
The article is really long. This is the intro text. I didn't know they could deny your rights in the event of a rebellion (revolution). Is that right? They can't really do that. That takes the power out of a rebellion. I mean it's only ok to be a part of a revolution if you don't get caught? That sounds Stalinist...
The constitution is just a piece of paper for Bush. I doubt this ruling will really mean much to him. He will defy it and I guarantee nobody will do a damn thing to him. We have the constitution, and he ignores it. Think he's going to give a rats ass about a ruling on it, if it means nothing to him to begin with?
By the way, where the hell has the Supreme Court been when it comes to our 4th amendment being violated? Does it not care to protect its own citizens from violation of the laws? I'm all for allowing those in our custody to be given the rights they are suppose to have, but why the hell does our court system seem to care less about ordering our rights to be respected too? We can be spied on illegally, and god knows what else they are doing that we don't know about, and they stay silent as could be. Makes no sense.

This is bigger than most people think. Just when I lost complete confidence in our system. I am shocked that they ruled the way they did. This may have bought our democracy some time.
We aint no stinkin democracy! We're a REPUBLIC! Learn the difference between the two. A democracy is two wolves and a sheep trying to decide what to have for dinner. A REPUBLIC is a well armed sheep.
the only thing democratic about our country, is suppose to be our style of voting and representation.. to an extent. we may have a little bit of democracy in the way things are run, but it is not suppose to be a full on democracy. But honestly, we're not even a democracy... heck... I think that might be better than what we are now. To me we're pretty much a socialist country now days.
