You know as well as I do that this Bill violates the Constitution, specifically, the 4th amendment which reads- "The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.". By not supporting this bill, you will be supporting the Constitution, exactly what we the people put you in office to do.
PLEASE do not let us down and OPOSE this disgusting piece of legislation which, by the way, does not help the men and women soldiers, but instead funds the encruitment of military slaves with which to send on Unconstitutional missions both here in our very own nation (marines in Indiana) and abroad, Iraq, Afghanistan etc. Someone has to stand up and do what is right. PLEASE do the job you took oath to do and OPOSE this legislation.

This intelligent guy in my congressman's office ASSURED me that this bill is COMPLETELY constitutional, that it puts an END to illegal wiretapping without a warrant and the only secrecy involved would be that that is definitely marked as "national security" as usual. He said that the previous wire-tapping that Bush did WAS illegal, this bill stops it and lets the courts decide if the Telecoms deserve immunity or not, just not the House. He read parts to me. He seemed to know it very well, and he said I was wrong. Ar we wrong?

It comes down to this...

First of all, you have to ask yourself whether or not the government has a right to spy on its own citizens - even with a warrant. That is the first question, because the 4th amendment says that even search and arrest warrants must be supported by probable cause. The new bill can be said to be Constitutional because the FISA court will issue any warrants. However, the FISA court itself meets in secret with no public record or published orders, so the FISA court is not all that great to begin with. But the main problem is that the earlier spying was done WITHOUT ANY warrant of any kind, even from the secretive FISA court. That was ILLEGAL and breaking the law should not go unpunished. This bill gives IMMUNITY to the telecoms if they can show that the Bush adminstration told them that everything was legal. Well, duh, of course Bush will provide that. That will be a simple formality of granting IMMUNITY to them getting CAUGHT. This bill has questionable Constitutionality going forward, but it definitely steps on us citizens looking backward.

Someone help. I called my Congressman"s office and this VERY intelligent person answered the phone and told me in no uncertain terms that this bill was NOT against the Constitution and was ONLY to let the courts decide if they were guilty or not. I had not researched it well, so I was totally unprepared for his questions of where EXACTLY in the bill were unconstitutional things, which he did NOT believe were in there. I mumbled angrily that I would find the parts in the bill that WERE, and call him back next week. God! I need some help..anyone?

Well, he may sound intelligent but I believe he is there telling everyone how good it is because he was told to. It is unconstitutional under the 4th Amendment which states,

This is why the government needs a warrant to eavesdrop on your phone calls. They are saying that bill H.R. 6304 is Constitutional because the phone companies, not the Government, are the entity spying on you. The phone companies are given incentives to record your PRIVATE conversations, which is ILLEGAL but then they will be given immunity to prosecution of any kind. Its just the way our Government is sidestepping the 4th Amendment to the Constitution. Even if this person insists it is Constitutional you can say you just disagree with the policy giving an entire special interest group immunity and incentives when we are supposed to be a nation of laws where everyone is accountable by the same standard of justice. It is just bad policy.

My own representative (McCaul) voted for it. He's

a die-hard neocon and is on a leash that is being tugged by Bush and his crowd. I've seen the letters written to him (congress.org) by others in the district and there was not a single letter written in support of this criminal act. All were against it. After all, we're only citizens and we must be "led" to the promised land, kicking and screaming. So far, the answers I've gotten from Senators Hutchison and Cornyn are all to the effect that they intend to support the measure as well. All are card-carrying members of the neocon-GOP element; not that everything they've done has been wrong, but they tend to go-along to get-along. Michael McCaul has never responded to a single letter that I have written to him, ever. Some representation. If you use downsize.org to try to communicate with them, be advised that many in congress have certain blocking or filtering mechanisms that will prevent such organizationally-generated messages from getting through, unless they are initiated from the web site actually operated by an individual member of congress.

They decided to vote on this bill yesterday without letting everyone know. Ron Paul didn't even have a chance to vote on this bill. The good news is the Senate hasn't voted yet and we need to bombard our Senators with phone calls and letters. How dare they just by-pass the Constitution whenever they like.

but i just finished a letter to my senator, told Clair McCaskill if she voted for the bill she was not honoring her oath of office or the constitution.
