Bad news from Nevada
Saying internal party disputes are best left to political parties and not judges, Washoe District Judge Jerry Polaha rejected a lawsuit by a group of disaffected Republicans trying to get to the party's national convention.
The group of about 20 national delegates elected at an insurgent convention of Ron Paul supporters earlier this summer were attempting to halt the Nevada Republican Party from appointing a slate to the national convention during a private conference call scheduled for this afternoon.
But the party's lawyer, David O'Mara, successfully argued that courts do not have the jurisdiction to interfere with a political party's constitutional right to make its own rules and decide its own delegates.
Polaha agreed. He also argued that the breakaway Republicans don't know yet whether they will be included on the party's eventual slate and that the party has mechanisms to resolve disputes.
"They could sit down and say, 'Look what's happening to us,'" Polaha said of the party's scheduled meeting this afternoon. "'We thought the Democrats had problems.'"
Sparks dentist Wayne Terhune, who filed the lawsuit, said he hasn't decided yet whether to appeal.

If that is how the judge ruled then political parties would be considered private entities and should pay their own way for conventions, primaries and such. Also a private entity can not be above others in preference in the law "ballot access laws".

The first step was to request an injunction in an attempt to prevent them from proceeding, which we all knew we probably wouldn't win. The good news is that Judge stated that after reviewing more than 5 hours of video from the April convention that contrary to what was being reported in the media, the convention proceeded in an orderly fashion until the sudden and unexpected recess. This now is a matter of public record and folks here in Northern Nevada are reacting to the fact that the party has lied to them once again about what really happened and they're losing even more credibility. Remember McCain came in third in the Nevada caucuses and there are already many voters upset that he is being pushed as the candidate so each and every opportunity we have to expose their corruption, we must take advantage of it.
The second step would be to contest their "appointment by committee" of OUR State Delegates and I'm sure at some point litigation in that area will proceed, as well as their primary focus of educating/influencing the Contest Committee at the national convention. The Terhunes and Webers and all those involved in the decision-making process here in Nevada are approaching these issues with integrity and genuine resolve to succeed in efforts to create a fair and open party.

We tend, which is only natural, to look at things from the point of view of Ron Paul's candidacy, but what about how NV Romney supporters must feel after giving such tremendous support to their candidate? He had suspended by then, but the NV GOP's heavy hand in the process here essentially quieted their voices, too. It was even mentioned elsewhere that maybe a September Surprise could be Romney...thinking out of the box a bit, but anyone seeing something unexpected, especially considering how unpopular McCain is? Would it be unlikely to expect the NV GOP has ulterior motives and might be lying to us again...something else is afoot?

As a Precinct Chairperson with over 60 voters participating in our caucus where we elected 9 Delegates and 9 Alternates, I am approached regularly by disgusted participants who were never contacted about the county conventions and were not allowed to participate because the party couldn't produce their paperwork. Not one of them was a McCain supporter... I saw the only McCain supporters from our precinct where else... at the county convention... funny how they never have trouble getting their paperwork from the party.
There is an overwhelming majority of people here in Northern Nevada that are ready to use their votes to send a message... they just don't have any real candidates to get behind besides our local Constitution-based Candidates... so we have to try and give them a cause... preserving liberty in Nevada, etc. But I truly believe the people WILL rise up if given the opportunity.
Keep McCain off the ballot in Nevada
While the "good" judge might be correct in his ruling, there should be nothing to stop you from enjoining the state of Nevada from putting McCain on the ballot because the Nevada Republican Party defrauded its members. The GOP wants to act like a "private organization," then use same rules people use against corporations who cheat their customers and stockholders.

...it would send a loud and clear message that the party can no longer manipulate the desires and votes of individual delegates.

My thought is to starve the Republican Party. No donations to anyone other than a RP Republicans. No money to the state or national organizations...the McCain campaign is already suffering from lack of interest...er, funding. I get appeals for $$ frequently. Are they kidding? Me, master of the budget and scared of this economy...donating to that group after what they have done across the country. I think they that the corrupt machine is about money. You "get" to be a delegate if you vote the right way and pay them money. So, o.k., lots of us didn't "get".....so cut the purse-strings as stringently as we can. Donate time, money and effort to the Campaign for Liberty (inflate those coffers for future benefit to liberty) and to RP efforts and supporters...no one else. If there is a reasonable way to beat them in court...that, imo, is worth spending $$ on as well.

That the delegates HAVE TO BE CHOSEN at the convention. The law even stipulates how many days prior to the national convention this must be done.

The attorneys and the judge were only presenting who had jurisdiction the courts, or the Republican party....The lawyer for the State GOP argued that the party had a way to deal with this and that it should be left out of the courts ...the judge agreed. ...
however, now that they have broken the law...by appointing delegates...It may be that they can appeal it on different grounds....I got an email from Wayne, and he said they are looking into an appeal...

I understand they were just "looking into" a possible appeal before the Supreme Court. Maybe if we all went to www.nevada4ronpaul.com and chipped in for legal expenses, it might help? I know there has been trash talk against the Terhunes, Mike Weber and others, so this has not been an easy road for them. The Terhunes are such genuine, unassuming almost people and one of our top Patriot families....it must be hard for them. Their consolation is, of course, to realize that they are right and have done all of us a great service. Here! Here!

It's disappointing.
However, we have served notice on the GOP that we are serious, and going to fight all the way for what we believe.
There are always setbacks, but we should just use this as a way to help us define how best to move forward.
I'd say that the next order of business for NV freedom lovers is to vote out any of these GOP party people who opposed us, and replace them with our people.
This kind of thing will continue to happen to us until WE control the process, and not the neocons.
We can do it one step at a time.

i dont disagree with the argument to dismiss the suit (even though the whole situation which ive been closely following disgusts me). political parties can turn their own conventions inside out and they cant really be held legally accountable because the delegate and party business elections that are being held are not state or federally sanctioned/sponsored, but are being held within the party/organizations and as long as no federal or state laws are being abused, theres not much that a judge could really feel justify even hearing let alone ruling in one sides favor. That is of course assuming the state doesnt have laws set in place that governs the actions of political parties.
What can we do? I dont have a great answer. try to contact media to get the story out to the people, abandon the party, protest at the convention, really whatever you need to do to let people know outside of nevada that the wishes of an entire state were entirely ignored.

why can't the Nevada delegates ask for a hearing within the national GOP party itself - a hearing at the national level? May not win but would put some pressure on the national party to recognize what is going on....

Correct I think That the Wa State Republican party will have the same conundrum with their lawsuit. If they win it's as you stated "Private Party's do not get the state beni's" If they lose well then they lose.
The judge is correct to rule this way.
Unless there was some contractual agreement violated by the NV GOP then the courts have not business in this issue. Like it or not it is called freedom. Republicans of NV need to take the party leaders to the woodshed to resolve this. Remember, the GOP is just a club like any other club.
