Judge Polaha Refuses to Uphold State Law
RENO, NV, July 25, 2008 – Judge Jerry Polaha today refused to uphold NRS 293, the statute that requires national delegates be elected by the state delegates at a state convention. Judge Polaha refused to grant the preliminary injunction requested by the Nevada State delegates, who filed a lawsuit last week attempting to stop the Nevada State GOP from appointing delegates.
“This is a very disappointing ruling,” said Wayne Terhune, a Washoe County Republican activist who was a plaintiff in the case. “The Judge would not uphold the law.” Judge Polaha said that the complaint was premature because the State Party has not announced their slate of appointees. However, the plaintiffs, represented by local attorney Mark Goodman, pointed out that the State Party had already violated NRS 293 because the State GOP has announced they will not reconvene, but will appoint delegates to the National Convention. "I knew we had a challenging case, but still I'm puzzled by the ruling."
The meeting began with Judge Polaha stating that he had reviewed five hours of footage from the April 26th and June 28th meetings. He emphatically stated that the characterization of the April 26th meeting commonly reported in the media as unruly and disruptive was not supported by the footage of the Convention. The Judge stated that the April 26th meeting proceeded in an orderly fashion until the abrupt recess.
Terhune says that the matter will now be appealed by the Republican National Convention’s Committee on Contests, an effort being organized by long-time Republican and Assembly candidate Mike Weber. “We haven’t decided yet if we will continue to appeal this matter in the court system,” Terhune added.
“Our fight to represent the delegates of the State Convention isn’t over,” said Terhune. “It is unfortunate the court refused to get involved and uphold the rule of law. This ruling seems to indicate that the State GOP leadership can do whatever they want, and the voice of the delegates can be ignored.”

This is only a temporary setback, and was to be expected
I fully expected something like this to happen because the complaint isn't "ripe." The Nevada GOP hasn't done anything wrong, yet (well, that's not really true since they inappropriately "adjourned" but I'm talking about the issue of appointing delegates). If the Nevada GOP names delegates, this matter will be "ripe" and the judges comments (refuting the notion that the convention was "raucus," etc.) were very encouraging.

We're sorry... we tried to make a difference... we tried to participate in what we believed was a fair and open process... we were all elected by the voters in our precincts... and then elected as State Delegates at our county conventions... and then from across Nevada we came and attended the state convention... and we studied parliamentary procedures and followed YOUR rules to the letter... and we did not disrupt the convention in any way as was finally confirmed by the Judge and is now a matter of public record... and yes, we were winning more Delegates throughout the day due to our positions on pertinent issues and your arrogant behavior and underhanded tactics... and yes, we were exercising our right to vote as State Delegates within the guidelines set forth in YOUR private company and still We were winning... Nevada was winning... Freedom was winning... so you CHEAT and then you LIE about our behavior and the events of the day... and then you conspire to STEAL our votes by denying every Nevada Delegate a speedy reconvene as you had promised to do... as you had given your word of honor.
There is no honor in Nevada today... the NVGOP killed it... sucked it dry with it's evil little fangs... Yeah, well suck on this NVGOP... we are not finished with you... if you thought this was about a candidate then "You are gravely mistaken, my friend" to quote your own neocon candidate. The seeds of revolution will change the world as we strive to reap a future of fair and just treatment for each and every American... and each and every member of our global family.
I am a Nevada State Delegate and I will not be silenced... not now... not here... this is our time... America's time to stand up and be heard... from coast to coast and border to border I am coming for you... to expose once and for all the corruption and misrepresentation that is the Republican Party... and I will do it from within... using your own words... your own actions... your own lies.

Now is the time we must not back down...we must not give in...we must do everything possible to garner more and more patriots and put those who would steal our liberties in a corner where they belong.. If not, what do we leave in the rubble for our children and our grandchildren? I cannot face that, and we shouldn't have to...we can and will, and must make a difference.

Let's use this opportunity...
to strengthen our network of Nevada Patriots and empower them with knowledge and direction. A coordinated organization with a specific agenda of exposing corruption and wrong-doing within the party...kind of a "Party Patrol." They have lost a great deal of their credibility and we can continue to chip away at the remaining cracks... a little chip here... a little chip there... and WHAM... a great big ol' chip right there in the middle.
I agree that our primary focus must remain on getting Constitutional Candidates elected but a certain number of stealthy individuals must make it their mission to aggressively monitor these thieves and keep the light of publicity shined upon any future misconduct and immediately expose it for all the world to see... because now the world is watching... they should have just finished the original convention instead of bringing so much attention to this state and how it conducts it's affairs.
I for one will make sure the world continues to watch and monitor these special interests and their unfolding agenda to cheat the citizens of the Great State of Nevada.

I'm not surprised
I didn't say anything beforehand, but going to the government for justice is often a disappointment.
I did predict that one must go through the internal channels of the GOP before going to the courts. No judge will do anything until the proper remedies have been tried.
Look at it this way: the GOP has a right to freedom of association. They have their own rules, and if you don't like them, or they don't uphold them, you have the option of joining another party.
If you were on the other side of the fence, you'd be arguing that the courts have no business (and the state had no jurisdiction) over telling the GOP how to select candidates.
Note that the LP just won a court case for ballot access in Ohio (I think it was) based on the court determining that the state could set reasonable deadlines in order to meet its needs for sending out ballots, for example, but not in such a way as to make it unreasonably difficult for a party to get on the ballot. The defendant was the state, not a political party.
The law that NV passed butting in to the GOP's internal workings is probably unconstitutional in the first place. If they want to pick names from a hat, why shouldn't they? Imagine having to argue that you want the state to meddle in party politics and make them do things a certain way. You'd have a case if you sued for fraud and wanted your convention expenses back.
I guess there's an "equal protection" argument: if they enforce the law against anyone, they have to do it to everyone.
Still, it would have been nice to have government on our side for once. (Having men with guns on one's side is always tempting, but that's how we got ourselves into this mess.)

From one of the guys involved in this suit: Thank you to everyone for your encouraging words. We're only doing what any of you Patriots would have done, if roles were reversed. Ron may have moved on to other pursuits, but we are still here, and we don't plan to go away!
Going into this case, we expected this result. It did not surprise us. The judge basically walked into the courtroom with his mind made up that he wouldn't touch the case. But our Patriot attorney (who worked for days preparing our case, pro-bono) still made an excellent argument, and he deserves all of our thanks and support.
