Maybe *This* Is How The War On Marijuana Ends

A rural Illinois jury has found one of their peers innocent in a marijuana case that would have sent him to prison. Loren Swift (pictured below) was charged with possession of marijuana with intent to deliver, and he faced a mandatory minimum of six years behind bars.

According to Dan Churney at MyWebTimes, several jurors were seen shaking Swift's hand after the verdict, a couple of them were talking and laughing with Swift and his lawyer, and one juror slapped Swift on the back.

The 59-year-old was arrested after officers from a state "drug task force" found 25 pounds of pot and 50 pounds of growing plants in his home in 2007. The Vietnam veteran walks with a cane, has bad knees and feet and says he uses marijuana to relieve body pain, as well as to help cope with post traumatic stress.

This jury exercised their right of jury nullification. Judges and prosecutors never tell you this, but when you serve on a jury, it's not just the defendant on trial. It's the law as well. If you don't like the law and think applying it in this particular case would be unjust, then you don't have to find the defendant guilty, even if the evidence clearly indicates guilt.

JURY NULLIFICATION is the key

Demand a law to be passed that requires Juries to be told of Jury nullification.

but i dont see anything wrong with it moraly, aside from the fact that i believe people should be able to do what they want to so long as they dont infringe on anothers rights.

the war on drugs isn't going to be ending any time soon unfortunately. Waaaay too much money involved for the criminals to just give it up.

A judge cannot overturn a "not guilty" verdict by a jury of your peers, only a "guilty" verdict.

I believe...

the reason they will not legalize it it because it would be too hard to control (seeing how it's a weed), and therefore tax. Would probably put a hugh dent in alcohol and tobacco's business (and related tax receipts) so these two powerful industries are fighting it (for the children, of course).

I think the laws need to be examined at the least. Some ungodly sentences involved with this stuff. Stemming (pun somewhat intentional, give or take) from fear I guess 'n possible greed of some sort.

The war against drugs is and always was a total disaster and a waste of OUR money. We ( I mean ignorant politicians ) have not made any headway in this so-called war and it is time to end it. Why marijuana is illegal and alcohol isn't is the great injustice of the century. I'm not advocating making alcohol illegal, just pointing out the ridiculousness of it all.

Thanks PattyC. This is the reason it is vital we work to keep local control of our police. This shows they (many) do have a conscience, and we need to appeal to that in order to stop the war on drugs as well as the Federal funded and unconstitutional roadblocks. Both are state issues which has been usurped by the feds.

Judges do not tell the truth when instructing juries, which are autonomous, and can ignore a law if they decide to without recourse by the court.
